The regular meeting of the City Council was called to order by Mayor Merritt at 7: 30 P. M. , followed by invocation given by 2. Councilman Nunamaker , Elder of the Re-Organized Church of Jesus Christ of the Latter Day Saints of Temple City. The Mayor 3. then led the Pledge of Allegiance to the Flag. 4. ROLL CALL: PRESENT: Councilmen-Dickason , Harker , Nunamaker , Merritt ABSENT: Councilman-Tyrell ALSO PRESENT: City Attorney Shatford and City Manager Woollett 5. APPROVAL OF MINUTES: City Manager Woollett corrected the m.inutes of the regular meet- ing of October 26 , 1964, as follows: Page 1 , item 8, 4th line should read "Attorney to draw a Resolution requesting debt limit report," Page 1 item 8 second paragraph last line should read ".brought back to the Business & Industrial Committee" , Page 4 item 10 line 2 should read "with the Master Plan of Street Trees and page 5 item 12 following 4831 Fiesta add the name "Catherine M. Capp" . Councilman Dickason moved to approve the minutes as correctedlof the regular meeting of October 26, 1964, Councilman; Harker seconded, carried by the following called vote: AYES: Councilmen-Dickason, Harker, Nunamaker , Merritt NOES: Councilmen-None ABSENT: Councilman-Tyrell UNFINISHED BUSINESS: 6. RESOLUTION NO. 64-416: City Attorney Shatford read title to Resolution No. 64-416 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY , CALI - FORNIA , ORDERING A REPORT UNDER THE SPECIAL ASSESSMENT INVESTI - GATION, LIMITATION AND MAJORITY PROTEST ACT OF 1931 (Vehicle Parking District No. 3) . Councilman Nunamaker moved to waive further reading and adopt Resolution No. 64-416, Councilman Dickason seconded, and carried by the following called vote: AYES: Councilmen-Dickason, Harker , Nunamaker, Merritt NOES: Councilmen-None ABSENT: Councilman-Tyrell 7. REPORT ON PROPOSED PARKING DISTRICT A. City Manager Wodllett advised since the last Council meeting Councilman Nunamaker secured two additional signatures which makes- 55.61'/0. Another signature was secured on Friday but the papers were not turned in but which will make the percentage over 60%. These are being mailed in and so as not to lose time he recommended the City Attorney be instructed to prepare a Resolution requesting the debt limit report. Councilman Harker so moved, Councilman Nunamaker seconded, . roll call vote to carry as follows: AYES: Councilmen-Dickason , Harker , Nunamaker, Merritt NOES: Councilmen-None ABSENT: Councilman-Tyrell PUBLIC HEARING: 7: 30 P. M. APPEAL ZONE CASE NO. 64=129, Catherine M. Capp ' 4831 N. Fiesta Ray Cushman, Planning Director presented the facts of the Case No. 64-129 and advised the request was for construction of a second house with less than square footage required and without street frontage. Councilman Nunamaker moved to open the Public Hearing, seconded by Councilman Dickason, and carried by the following called vote: AYES: Councilmen-Dickason, Harker, Nunamaker, Merritt NOES: Councilmen-None ABSENT: Councilman-Tyrell �, . - `� . � - _ t \ _ � - � � _ _ ., Council Minutes , November 9, 1964, page 2 The Planning Director advised the Planning Commission 'gr6nted this variance for the second house with the condition of noii- severabiiity which would keep both houses under one ownership, and the appeal was being made against this condition in order that the lot could be split. He also reported on the other adjoining properties as well as the area. The Mayor then asked if anyone wished to speak in favor of this request. Mr. Gerald Capp, 965 El Campo Dr. , Pasadena , came forward and stated he is co--owner of the property in question, and that if the lot split was allowed he felt it would warrant a much better house than if a second house on one lot for rental purposes . No one else came forward to speak in favor or against this re- quest. Councilman Harker moved to close the Public Hearing, Councilman Dickason seconded, carried by the following roll call vote: AYES: Councilmen-Dickason, Harker, Nunamaker, Merritt NOES: Councilmen-None ABSENT: Councilmen-Tyrell Following considerable discussion Councilman Dickason made the motion to grant this request and instruct the City Attorney to draw a Resolution in conformance -with the Council decision, Councilman Harker seconded , roll call vote to carry as follows: AYES: Councilmen-Dickason, Harker, Nunamaker , Merritt NOES: Councilmen-None �.' ABSENT: Councilmen-Tyrell PUBLIC HEARING: 7: 30 P. M. CURB& GUTTER: EAST SIDE HALIFAX , DAINES TO OLIVE, Asst. City Manager Koski advised this was a petition to install curb and gutter as shown above. Councilman Dickason moved to open the Public Hearing, Councilman Merritt seconded, carried by the following called vote: AYES: Councilmen-Dickason , Harker, Nunamaker, Merritt NOES: Councilmen-None ABSENT: Councilman-Tyrell The Mayor requested the report from Mr. Koski on the above peti - tion. Asst. City Manager Koski reported the petition submitted for the above location was signed by 75% of the lineal footage of the properties on: the east side of Halifax, Daines to Olive, Curb & Gutter is already installed on the west side. This im- provement would improve drainage conditions in the area. The Mayor asked if anyone in the audience wished to speak for or against this installation and no one came forward. Council - man Nunamaker moved to close the Public Hearing, Councilman Dickason seconded, and motion carried by the following called vote: AYES: Councilmen-Dickason, Harker, Nunamaker, Merritt NOES: Councilmen-None __ ABSENT: Councilman-Tyrell Councilman Nunamaker moved to find the improvement to be in the public interest and to instruct the Supt. of Streets to cause the work to be done, Councilman Harker seconded, motion carried by the following roll call vote: AYES: Councilmen-Dickason, Harker, Nunamaker, Merritt NOES: Councilmen-None ABSENT: Councilman-Tyrell �. RESOLUTION N0. 64-414: Re-installation of signs and red curb markings west side of Rosemead Blvd. at Pentland Ave. Traffic Engineer George Envall read title to Resolution No. 64-414 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY , CALIFORNIA , APPROVING TRAFFIC COMMISSION REQUEST TO STATE DIVISION OF HIGHWAYS FOR APPROVAL OF SIGNS AND RED CURB MARKINGS ON THE `4EST SIDE OF ROSEMEAD BOULEVARD AT PENTLAND AVENUE. He explained this Resolution was necessary before these signs can be installed and the.;td curb markings put in as this is on a state highway. PROPOSED TRIP TO MAGDALENA , SONORA, MEXICO: SISTER CITY PROGRAM City Manager Woollett advised this -was the last Council meeting �'. before the Fiesta meeting at Magdalena and requested Councilman Nunamaker to report on the progress of the plans. Councilman Nunamaker advised approximately 75 people were going, a' whole bus load except 4 seats , and also some cars are going. He ad- vised the following were going: Councilman Harker, Mayor Merritt, City Attorney Shatford, Councilman Nunamaker, Commissioner C. Ray Johnston, and recommended :the City Manager Nfoollett also -= attend. He also recommended a certain amount of money from fund: set up for this purpose be used to help defray the expenses of the city officials attending on behalf of the City. Councilman Dickason stated since this is an official visit for City offici - als and since it is the first encounter with the Sister City he moved the City allow $50. on each City official including the City Manager and Asst. City Manager and all expenses be paid for the Mayor, Councilman Nunamaker seconded, ca.r�ried by the follow- ing called vote: AYES: Councilmen-Dickason, Harker, Nunamaker, Merritt NOES: Councilmen-None ABSENT: Councilman-Tyrell City Manager ,Atoollett advised he would be unable to go but re- commended the Asst. PLANNING COMMISSION RECOMMENDATIONS: Planning Director Cushman advised in Tract #29569 a condition was imposed for a 6 ft. grapestake fence and the Commission re- commends this be revised to be a 6 ft. concrete block wall fence. Councilman Tyrell arrived at this time, 8: 05 P. M. The- developers have written the city staff approving and re- commending the change of requirements. This will be 5 ft. back from the right of way but as the installation will be in the pub- lic right of way this must be approved by the Council . Council - man Nunamaker moved to approve the recommendation of the Plannin( Commission, Councilman Harker seconded, roll call vote to carry as follows: AYES: Councilmen-Dickason, Harker, Nunamaker, Tyrell , Merritt NOES: Councilmen-None ABSENT: Councilmen-None 1.1 . TRAFFIC COMMISSION RECOMMENDATIONS: Item 5. Recommend City Attorney and Staff review Sect. 3324:, Chapt. 3 of Article 111 of the Municipal Code. Item 9. Installation of 3 ton weight limit signs west side of Fiesta at south line of Lower Azusa and north side of Bisby at west line of Temple City Blvd. Item 15. (b) recommend removal of stop sign on private street Olive, south line of Olive St. , - . (d) add stop sign and stop bar markings on Cloverly at Wfoodruff. Traffic Engineer Geo. Envall presented the above recommendations . Following discussion Councilman Dickason moved to approve the above recommendations of the Traffic Commission , Counci-)man Nunamaker seconded, carried by the following called vote: AYES: Councilmen-Dickason, Harker, Nunamaker , Tyrell , Merritt NOES: Councilmen-None ABSENT: Councilmen-None 12. RESOLUTION NO. 64-415: ,,°Jarrants & Demands The City Manager presented Resolution No. 64-415 and recommend- ed the Council adopt the Resolution. CORRESPONDENCE: a . City Manager �,%►oollett presented a letter from the Los Angeles County Boundary Commission re proposed annexation No. 1964-4, City of San Gabriel . Councilman Tyrell moved to receive and file, Councilman Nunamaker seconded and carried. b. The City Manager presented a request from Girl Scout Troop #377 requesting a charitable solicitation permit for a rummage sale. Councilman Dickason moved to grant , Councilman Tyrell se- conded , and carried. 14. T IME .FOR THOSE IN THE AUDIENCE ,,..H',_) 1;l I SH TO SPEAK: No one came for- ward to speak at this time. 15. MATTERS FROM CITY OFFICIALS: Councilman Harker reported on the meeting of the League of Calif. Cities advising they were trying to develop a cooperative plan for emergency services of jurisdictional equipment moving into other areas . City Attorney Shatford advised a figure had been arrived at for purchase of the Kettle property in the amount of $33,250. for Parkina District #1 . Also the Vokoun property , the small parking lot behind the old City Hall in the sum of $5500. Negotiations for the Saunders property have been worked out for the sum of $18,500. He advised the City can now act on these three parcels Yf. and that he has the Agreements prepared by O 'Melveny & Myers. -� Councilman Nunamaker asked regarding the Byron `.,fells ;property and the City Attorney advised the City has an option on that and can act at any time. Councilman Nunamaker moved to authorize the Mayor and City Clerk to eXecute these Agreements as recommended by the City Attorney, Councilman Dickason seconded , roll call vote to carry as follows: AYES: Councilmen-Dickason , Harker, Nunamaker , Tyrell , Merritt NOES: Councilmen-None ABSENT: Councilmen-None Councilman Dickason asked about the Kauffman drainage problem and the City Attorney advised no further action had been taken . Follow, ing discussion Councilman Tyrell moved to get the issue forth and instruct the City Attorney to proceed and serve notice, Council - man seconded, carried by the following called vote: AYES: Councilmen-Dickason, Harker, Nunamaker, Tyrell , Merritt NOES: Councilmen-None ABSENT: Councilmen-None City Manager ';toollett advised a tree survey had been made on Garibaldi at 9811 , 5815 , 9831 and 9335 and recommended removal of five pepper trees which create a hazardous condition to be replaced by four crepe myrtle trees properly spaced, according to the Master Tree Planting program. Councilman Tyrell moved to approve, Councilman Harker seconded, carried by the following roll call vote:. AYES: Councilmen-Dickason, Harker , Nunamaker , Tyrell , Merritt NOES: Councilmen-None ABSENT: Councilmen-None City Manager 'Afoollett read a letter from the Temple City Junior Chamber of Commerce requesting use of the front part of the build- ing owned. by the City fronting on Temple City Blvd. for the pur- pose of a meeting place and place to keep records and supplies. This would be rent free with limited signing and liability insur- ance coverage, no heating or telephone. Following discussion the Councilman Tyrell moved to instruct the City Attorney to draw a written Agreement between the Junior Chamber and the City cover- ing these items and granting the request , Councilman Dickason se- conded and carried by the following roll call vote: AYES: Councilmen-Dickason , Harker, Nunamaker, Tyrell ,, Merritt NOES: Councilmen-None ABSENT: Councilmen-None Asst. City Manager Koski advised he had received a curb & gutter petition with 100% sign up on Dairies Dr . , north side, Hallowell to Halifax.
