MINUTES OF REGULAR MEETING OF APRIL 23 , 1962, - AMENDMENTS
Referring to item 10 TEMPLE CITY IMPROVEMENT #1 SEWERS,

The last paragraph referring to Resolution No. 62-201 should
precede the paragraph just above referring to Resolution No. >
62-202, and should also include the report from the Health
Officer spread opon the minutes as follows:

' SUBJECT: Temple City Improvement No. 1 , Sanitary Sewers in
Woolley Street and Other Rights of Way, Vicinity of
Temple City
RECOMMENDATION: It is respectfully recommended that sanitary
sewers be installed in this district.
ANALYSIS: This Department has made an investigation of the
Woolley Street and Other. Rights of `Jay Sanitary Sewer
District, Temple City Improvement No. 1 , Vicinity of
Temple City. During the course of this investigation
19 house-to-house calls were made. Of this number, '
7 occupants were not at home or did not answer the
door. Of the 12 property owners or tenants actually
contacted, 6 or 50% reported having experienced -i
trouble with their individual subsurface sewage dis-
posal systems. They complained that the seepage pits
filled up causing raw sewage to back up into the house
plumbing fixtures or to overflow onto the surface of
the ground. Also that frequent pumping and cleaning
out of the seepage pits was necessary.
The majority of. the homes in this d i str,i ct are from
five to seven years old. The effective sidewall leach
ing areas of the seepage pits are now becoming sealed
due to their long period of usage. When this condi -
tion occurs, the pits cease to function properly and
soon fill up.

In view of our survey, 1 , the undersigned Health Offi
;i cer of the County of Los Angeles , having been official
ly designated by the City Council of the City of Temp1E
City to perform public health services for the City 'of
Temple City , do hereby recommend that proceedings be
instituted at once for the construction- of sanitary ;
sewers in Woolley Street and Other Rights of Way, City
of Temple City. This recommendation is made as an im
.provement necessary to the protection of public health
and pursuant to. 'Che provisions of Section 2808 of the
Streets and Highways Code.

ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING THE TEMPLE CITY
MUNICIPAL. CODE TO PROVIDE PLANNING COMMISSION DETERMINATION OF
ALL ZONE VARIANCE CASES AND MODIFICATIONS THEREOF WITH RIGHT OF
APPEAL TO THE CITY COUNCIL, Councilman Fitzjohn moved to waive

City Attorney Shatford advised any member of the Council may by
motion within the time limit allotted institute an appeal.
7. PROPOSED LIBRARY CONTRACT: Fickes & Fickes, Architects
- Eugene 14. Fickes and James T. Fickes were both present and to
gether with the Council reviewed the proposed library contract :
page by page revising, adding and deleting to negotiate a con-
tract agreeable to the architects and the City.AfT. Points agreed
upon a new contract will be drawn as corrected to show the
amount of the construction to be $185 ,000., with bona fide bid$
not to exceed 1%. Also upon completion the- Architect shall
be paid $350.00 to furnish the City with as-built drawings
showing construction changes in the work and final locations of
mechanical service lines and outlets . Progressive dates were set
as follows: ( 1) Schematic Design Phase, date of completion to
be Sept. 5th, 1962; (2) & (3) Design Development Phase and
Construction Documents Phase to be completed by Jan. . 5, 1963.

City Manager Woollett presented a report on costs of maintenance

Tunas Drive and recommended the City assume this repsonsibility.

Councilman Merritt moved that the City accept the responsibil-
ity of watering and maintenance of the trees to be planted in
the sidewalk on Las Tunas Drive, Councilman Fitzjohn seconded,
roll call vote as follows:

9. FINAL ACCEPTANCE OF LIVE OAK RE-CONSTRUCTION FROM BODDUM CON-
STRUCTION COMPANY.
The City Manager advised the project is completed with additons
and changes made and requested the Council to authorize the
additional work as detailed on a report from the Road Dept. ,
to accept the work on the cash contract and to approve the esr
timate and pay the contractor , Councilman Fitzjohn so moved ,
Councilman Merritt seconded, roll call vote as follows:

10. PUBLIC HEARING: 8: 00 P. M. Proposed ANNEXATION NO. 4-A, WEST
,. TEMPLE CITY, UNINHABITED.
Mayor Tyrell declared the Public Hearing opened, and asked the
- City Manager for a report on any protests received. City Manar
ger Woollett advised he had received no written protests and
there is no reason why the - City Council cannot proceed and
introduce Ordinance No. 62-86. Mayor Tyrell asked if anyone
in the audience wished to speak for or against this annexation*
No one came forward. Councilman Nunamaker moved to close the
Public Hearing, Councilman Dickason seconded, and carried.
Councilman Merritt moved that the City Council. find. that less
than 50% protests have been filed, Councilman Nunamaker second-

POINTING DONOVANR. JOHNSON AS PARK MAINTENANCE MAN, MARLA
SILVEY AS CLERK-TYPIST , LEONARD BURWELL AS RECREATION LEADER,
AND STEVEN VANNATTA AS RECREATION HELPER. Councilman Fitzjohn
moved to adopt Resolution No. 62-220, Councilman Nunamaker

12. PROPOSED CONTRACT FOR LEGAL SERVICES-PROPOSED PARKING DISTRICT,
City -Attocney Shatford presented the proposed contracts to-
gether with a Resolution appointing O 'Melveny & Myers as Speci -
al Counsel in respect to establishment of a parking district or
districts. He explained the various ramifications of the pro-
posal . Councilman Dickason moved to hold this over until the
next Council meeting for further studyy, and also the proposed
13. contract and resolution appointing William H. Krelle as Engi -
neer for services re the proposed parking district be held over
until next Council meeting for the same reason, Councilman Nun-
amaker seconded, and carried.

Planning Advisor presented the variance case and advised at the
Planning Commission Hearing five- people spoke in favor and:

16. TRAFFIC COMMISSION RECOMMENDATIONS:
11 , Fairhall St. Recommend placement of tut-hill panels east..
end of Fairhall St. Traffic Engineer Envall explained traffic
was crossing the curb in the cul de sac on Fairhall St, to. gai;n
access to commercial properties on El Monte Ave, , and that ad"?
,,. joining property owners on Fairhall St . objected to this , and
the thought was by installing a tut-hill panel it would block:
traffic from crossing this curb and private property. Councils
man Dickason moved to approve, Councilman Merritt seconded, roll
call vote as follows:

13. Placement of stop sign on private street west side of
Golden West south of Val St. , and , also that a speed check be
made on Golden West after school opens . Mr. Envall advised
this was a safety measure as coming from a private street on to
a heavily traveled street it would halt entry, and also that -the
sign itself would be placed on right of way, Councilman Merritt
moved to approve both these recommendations , Councilman Nuna-
maker seconded, roll call vote as follows:

City Manager Woollett stated the Traffic Commission requested
permission - to appear before the School Board to discuss the
Bicycle and Pedestrian Program. Councilman Fitzjohn moved to-

17. CURB & GUTTER IMPROVEMENT: SERENO DR. BETWEEN ROSEMEAD & ENCI'N-.

City Manager Woollett recommended the City Council set a public
hearing for August 13, 1962, at 8: 30 P. M, to complete. the re-
mainder of the curb on Sereno, Dr. between Rosemead & Encinitas
Councilman Nunamaker so moved, Councilman Dickason seconded, '
and carried.
18. RESOLUTION N0. 62-219: WARRANTS & DEMANDS
Following discussion Councilman Fitzjohn moved to adopt Resolu-
tion No. 62-219 in the sum of $7326. 36 Demand Nos. 1678 through
No. 1718, Councilman Merritt seconded, roll call vote as follows

NOES: Councilmen-None

19. COMMUNICATIONS:
City Manager Woollett presented a letter from the County Boun
dary Commission regarding Annexation 1962-3, City of , San Gabr:.iel
Councilman Merritt moved to receive and file, Councilman Nuna-
maker seconded, and carried.
City Manager Woollett read a letter from SERVE , Family Service
Club, requesting Sept. 1 -7 be proclaimed National Fiesta Week.
Councilman Dickason moved to so proclaim, Councilman Fitzjohl
seconded, and carried.
20. TIME RESERVED FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
Mr. Gurevitz, 616 W. Sierra Madre Blvd. , stated he and a partner
proposed to open a restaurant and wished to have music and darjc;-
ing after 2 A. M. until 7 A. M. , the proposed location is at
Rosemead and Las Tunas and will be strictly an eating establish-
ment with no alcoholic beverages served. The City Manager will
make a report back to the Council at their next meeting regard-
ing this request.
Mrs. Phyllis Hall , 4847 Kauffman, asked if when the reports are '
given following the investigation regarding the water problem ;-
on Kauffman, if they will be brought before the Council and
before the; public. The City Manager advised that he expected
to receive reports back on Friday of this week and then he anq
the City Attorney will try and make a determination of what the
solution of the problem is , and that all of this information
will be presented at the next Council meeting on August 13.
Mr. Harker, Chairman of the Planning Commission, reported on
the joint meeting with the Planning Commission of Arcadia, and --
advised it was an informal discussion and - he felt it very worth-
while and informative to both Commissions . Also that it was ,
agreed that they continue these joint meetings quarterly which
may enable them to .solve similar problems.
Mrs. Norma Crouch of Fairhall street requested help as she is
having a problem regarding a yard light shining into a neighbors
window. The City Attorney reported on similar situations and''
suggested she do something to shield the light so it did not
annoy the neighbor.
21 . MATTERS FROM CITY OFFICIALS:
Councilman Nunamaker brought up the question again regarding
better lighting for apartments and garages and it was agreed
that any legislation would be difficult. . The City Attorney
advised that this could come in on building requirements and
be considered in the Building Code.
City Treasurer Walter Griesmeyer reported on City funds and
requested the City Council set a policy of. 40% of funds to -
active account and 60% to inactive account at both First West-
ern Bank and Security First National Bank. Following discussion
Councilman Nunamaker moved to instruct the City Treasurer in

, investing city funds to maintain a balance of 40% active ac---
count and 60% inactive account in both banks, Councilman Mer-
ri-tt seconded, roil call vote as follows:

NOES: Councilmen-None
ABSENT: Councilmen-None
Councilman Nunamaker. brought forth-"'sweet treats" for those
present and the Council in response to various reminders that
he was in the Candy business. Everyone enjoyed the "surprise" .

Councilman .Nunamaker moved to adjourn, Councilman Merritt se-
conded, and carried. Council adjourned at 10: 05 P. M. until
the next regular Council Meetino on August 13, 1962, at 7: 3.0
