, 1 . INITIATION: The regular meeting of the City Council was called
to order by Mayor Tyrell at 7: 30 P. M. The Mayor then led the

3. INVOCATION: Invocation was given by Rev. Roger Hillis of West-
minster Presbyterian Church, 964.2 Live Oak, Temple City.
4. ROLL CALL:

5. APPROVAL OF MINUTES: REGULAR MEETING OF MARCH 11 , 1963.
The Deputy City Clerk corrected the minutes of March 11 , 1963,
to add the adoption of Resolution No. 63-270, titled A RESOLU-
TION OF THE CITY OF TEMPLE CITY RECOGNIZING SAINT PATRICK' S DAY
which was adopted unanimously by the City Council . Councilman
Fitzjohn moved to approve as corrected, Councilman Nunamaker se-
conded, carried by the following roll call vote:
AYES: Councilmen-Dickason, Fitzjohn, Merritt, Nunamaker , Tyrell
NOES: Councilmen-None
ABSENT: Councilmen-None

6. ORDINANCE N0. 63-103: 2nd reading.
Attorney Lumsdon read title to Ordinance No. 63-103 AN ORDINANCE
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING THE MUNI -
CIPAL CODE TO PROVIDE REQUIREMENT THAT ALL LOTS FRONT ON A PUBLIC
THOROUGHFARE . Councilman Dickason moved to waive -further reading
of Ordinance No. 63-103, Councilman Munamaker seconded, roll call
vote as follows:

adoption of this ordinance:

Mayor Tyrell explained the adoption of this ordinance is taking
off the carte blanche right of obtaining a lot split, and the
Commission can grant a lot split. This ordinance is a further
ground for them to use in denying one, but it may or may not be
denied. Each request will be judc!ed on the particular facts of
the case. Anyone has the right to make application for such a
variance if it does not qualify as limited by this. The ordi -
nance does not say they will be denied, but if your property
cannot - be developed in any other manner, and you have a reasonable
plan you can submit it to the Planning Commission and it will be
considered.
Councilman Nunamaker made a motion to adopt Ordinance No. 63-103,

9. PUBLIC HEARING: 3: 00 P. M. Curb it Gutter
Mr. Koski , Administrative Assistant, advised this Hearing con-
cerned the spread of assessments for curb and gutter on the east
and west side of Farago Ave. between Freer and Grand Ave. on the
east side of Farago the assessment levied was to be for 130.0'
at $2.25 per lin. ft. at 5240 Farago Ave. , total $292.50. On
the west side of Farago Ave. was to be for 75.0' at $2.25 lin.
ft. at 5105, Farago Ave. , total $163.75. Mayor Tyrell opened the
Public Hearing, and asked if anyone wished to speak for or again-
st. No one came forward. Councilman Dickason moved to close
the Public Hearing, Councilman Nlunamaker seconded, and carried.

10, PUBLIC HEARING: 8: 15 P. M. Curb and Gutter, North side of
Broadway between Temple City Blvd. and Golden West.
Administrative Assistant advised this area required 1225' of
curb and nutter and the petition contains signatures represent-
892 ' of 72%. Mayor Tyrell opened the Public Hearing, and re-
quested anyone wishing to speak for or against the project. No
one came forward. Councilman Dickason moved to close the Public
Hearing, Councilman Nunamaker seconded; and carried. Council-
man Nunamaker moved to determine that the installation is in
public interest and to instruct the Supt. of Streets to cause
the work to be done, Councilman Merritt seconded, carried by
the following roll call vote:

Mr. Knight asked regarding properties with lot splits with
houses in the rear and their relation to the cost of curb and
gutter and Mr. Koski advised him usually the owner of the
front property where the curb was located was responsible for
their frontace..
ll . REQUEST FOR PUBLIC HEARING: for curb and gutter on east and west
side of Doreen between Freer and Key West. Administrative asci :
ant Koski advised on the west side 77.8% of the footage had
signed the petition and on the east side 80.5%. Councilman
Dickason moved to set a Public Hearing for April 22, 163, at
8: 00 P, M. , Councilman Nunamaker seconded, carried by the follov

12. CONSTRUCTION OF STORAGE BU-ILDING AT LIVE OAK PARK:
Administrative Assistant Koski advised the Council this building
was for storage of park maintenance equipment and supplies.
Mayor Tyrell read title to Resolution No. 63-274 A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA , INSTRUC
ING THE CITY MANAGER TO PUBLISH NOTICE INVITING BIDS FOR IN-
STALLATION OF A STORAGE BUILDING IN LIVE OAK PARK. This is a
budgeted item. Councilman Merritt moved to adopt Resolution No,
63-274, Councilman Nunamaker seconded, roll call vote to carry

13. CASH CONTRACT #41252 Olive St. et al
Administrative Assistant Koski advised we had received a letter
from the Road Dept. , County of Los Angeles , stating A-1 Concret
Inc. , had satisfactorily completed the work on Olive St. et al ;
Cash Contract #41252 , on March 6, 1963, and recommend acceptanc,
of the work by theC i ty. Counc i 1 and authorization of the f.i nal l
payment of $15,864.80. less 10% retention. Councilman Dickason
so moved, Councilman Fitzjohn seconded, roll call vote to carry
as follows:

14. REQUEST FOR ON-SALE BEER LICENSE - 4812 N. Temple City Blvd.
This was discussed by the Council , the eating place at this
location chanced hands and this was a request to be licensed to
rsell beer. No further action was taken.
15. RESOLUTION NO. 63-275: Warrants & Demands. Following discussior
Councilman Merritt moved to adopt Resolution No. 63-275 , warran;
and demands , Mos. 2427 through No. 2454, in the sum of $11 ,587.:

COMMUNICATIONS:
16. Mayor Tyrell presented letters from the Los Angeles County .
Boundary Commission regarding proposed annexations #311 , #316,
#317, and #313, City of El Monte. Councilman Fitzjohn moved
to receive and file, Councilman Nunamaker seconded,and carried.
17. TIME FOR THOSE IN THE AUDIENCE H0' V1ISH TO SPEAK
Mr. Bob Saddoris, 5570 Ryland Ave. , requested information re-
garding the location, etc. of the new maintenance building to
be built in Live Oak Park as his property backs up to this
serVice area. Mr. Koski advised it would be located just north
of the existing building and there would be a 6 ft. masonry wall
between his property and the storage area. The building will be
set five feet from the property line and 20 ft. from Bogue St.
in accordance with the building code.
13. MATTERS FROM CITY OFFICIALS:
- Councilman Fitzjohn stated he had been informed that the Masonic
Lodge is interested in laying the cornerstone at the new library
_and if the Council is interested in this it is just a matter of
requesting them to do so. This ceremony would include every
service club, church, or organization in the city to participate.
He has folders regarding some of the corner stones they have
laid, and it would be a very fine affair, and if the Council
approves this we could set a tentative date in August. This
would give the people an opportunity to go through the new
library. Mayor Tyrell thought this a good idea and suggested
this be discussed with the County library people. Councilman
Dickason moved to approve this and refer the matter to the staff
for liason with the -County, Councilman Nunamaker seconded and
carried.
Councilman Fitzjohn asked if there is anything to stop the City
legally enforcing the restrictions as stated in Resolution 63-
26 placed on the Dancing License at the Jolly Coachrean. Mr.
Koski advised the City Attorney' s office stated the restraining
court order is on only the entertainment license restriction,
and that we can go ahead with the restrictions on the dancing
license. The staff will proceed on the enforcement of the res-
trictions, and will take up the matter of the parking lot being -
used at the shoe shine establishm&nt with the City Planning
Advisor and determine proper procedure and follow through.
Mayor Tyrell gave the Council a run down on the Hearing. The
City Attorney' s office on behalf of the City filed a stipulation
or order as follows: the restraining order issued by Judge
Chantry is continued until the matter can be heard on merits.
Mayor Tyrell advised the license continues in status quo until
the trial which will depend on the date City Attorney Shatford
files pleadings, and upon receipt of pleadings the Court will
set a date for the Hearing.
Councilman Dickason mentioned there were quite a few of the Jr.
Chamber of Commerce members who testified at the Jolly Coachman
and that many who testified were involved in the Jr. Chamber
Smoker last Saturday evening which he felt did much to discredit
their standards -for the community. He advised the T. C. Jr.
Chamber were hosts to the party. Attorney Lumsdon stated in
• r- case were the patties who testified at the Hearing involved.
Mayor Tyrell stated one thing is important, the arrest of any
person does not presume his guilt, that will be determtned at
a later date.
Councilman Fitzjohn referred to over-night parking and advised
it was unanimous on ,the part of the Traffic Commission, and

moved to instruct the City Attorney to prepare an ordinance in
accordance with recommendations of the Traffic Commission, Coun-
cilman Nunamaker seconded, and carried.
City Treasurer Griesmeyer requested a copy of the resolution
appointing Karl Koski as Acting City Manager, and Acting City
Clerk. . Tile deputy city clerk wi 1 l prepare an excerpt of the
minutes and certify to same for the City Treasurer.
Mr. Koski , Administrative Assistant, advised the Los Angeles
County Engineer- requests Council approval for circulation of
a petition for sewer on Green St. , which on Febr. 7 the Council
authorized the County Engineer to prepare. Councilman Nunamaker

Mr. Koski read a letter from the Road Dept, requesting permissior
of the City Council for Tract No. 27309, J. B. N eber Development
Co. , to annex to county lighting district #1395, petition No.
158-122. Mayor Tyrell read title to Resolution No. 63-276 A
RESOLUTION GRANTING CONSENT AND JURISDICTION TO THE COUNTY OF
LOS ANGELES IN THE MATTER OF COUNTY LIGHTING MAINTENANCE DISTRICT
NO. 1395 PETITION NO. 158-122. Councilman Fitzjohn moved to
adopt Resolution No. 63-276, Councilman Merritt seconded,
carried by the following roll call vote:
AYES: Councilmen=Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell -
NOES: Councilmen-None
ABSENT: Councilmen-None
Mr. Koski advised the Council regarding two Boulevard Stops
one at Miloann St. & Agnes St. , and the other at Lowland Drive
& Agnes St . Investigation showed these to be very hazardous in-
tersections per the Traffic Engineer and through authority or
Ordinance No. 6544, Section 4005 EMERGENCIES had caused these
to be installed and at present this is before the Council for
their approval . Councilman Fitzjohn moved to adopt the recommen.
dations of the Traffic Engineer, Councilman Nunamaker seconded,
roll call vote to carry as follows:

Mr. Koski read a letter from the Pan American Union, Washington
D. C. , requesting April 14 be proclaimed as Pan American Day
and April 14 to April 20 as Pan American Week. Councilman Mer-
ritt moved to so proclaim, Councilman Dickason seconded and
carried.
Mr. Koski advised the Council we had today received from Fickes
& Fickes a proposal for the development of the preliminary plans
for remodeling existing library for use as a City Hall and he
will furnish copies to the Council .
The question of soliciting for money was raised and Lt. Baker
informed the Council unless the officer sees someone give the
soliciter money that he cannot do anything regarding enforcements
Also regarding religious solicitations it is very difficult to
enforce due to the federal law regarding religious freedom. Mr
Koski will check further with Capt. Pascoe regarding enforcement
pertaining to the denial of a permit for solicitation requested
by the ','Western Missionary Army.
Mayor Tyrell read a letter from Urs. Kaufman and Naess regarding
their recormnendation that the City Manager absent himself from
the City for medical purposes , and this would be sick leave for
