INITIATION :
1 . Mayor Pro Tem Merritt called the regula.r meeting of the City
2. Council to order at 7 :30 P.m. on June 4, 1968. The Rev. William
W. Grasham of the Church of Christ of Temple City, 5272 N.
3. Sereno gave the invocation , following which the Mayor Pro Tem
led the Pledge of Allegiance to the Flag.
4. ROLL CALL:
PRESENT: Councilmen-Harker, Merritt , Tyrell
ABSENT : Councilmen-Beckley, Briggs
ALSO PRESENT : City Manager Koski , City Attorney Martin ,
Planning Director Dragicevich , Engineering Assist-
ant William Hintze
Mayor Pro Tem Merritt reported that Councilman Beckley was ill
and Mayor Briggs was away on business. Councilman Tyrell moved
to excuse the absence of the two councilmen , and the motion
carried unanimously.
y 5 . APPROVAL OF MINUTES : Regular meeting of May 21 , 1968.
Regarding the first three lines of the 3rd paragraph , page 2 ,
Councilman Harker questioned the wording of Mr. Phillips '
comments , saying he thought he had asked what the City would
do about paying him. City Manager- Koski suggested changing to
a question and transposing a word to cause the sentence to read
"Mr. Phillips asked, if he dedicated, would the City pay him
50� per lineal foot , take care of his lawn sprinkler system,
and set back his water meter. " Councilman Tyrell moved to
approve the minutes with this amendment , Councilman Harker secon-
ded, and the motion carried unanimously,
UNFINISHED BUSINESS :
PUBLIC HEARING . 7 :30 Pomo , CURB, GUTTER, and DRIVEWAY APPROACH :
DAINES DRIVE, SOUTH SIDE BETWEEN BALDWIN AND NADINE.
William Hintze, Civil Engineering Asst. , presented this proposed
improvement project , stating that 74% of the property owners had
signed the petition but that three parcels of property have not
been dedicated for the necessary right-of-way.
The Mayor Pro Tem declared the public hearing opened, and asked
if anyone in the audience desired to speak regarding this
project.
Mr. James Phillips , 10036 Daines Dr. , inquired whether the coun-
cilmen were familiar with the project and was told. that they
were. On the wall map, City Manager Koski pointed out the area
proposed for curb, gutter and driveway approaches , with special
note of the three undedicated parcels which are owned by Phillips,
Bailey and Ebersole. Mr. Phillips said the City was asking him
to give 2400 sq. ft. of his property for which he had paid good
money--and he was not "a Rockefeller or anyone of that nature"--
and the City had the audicity to ask him to pay the costs of
curb, gutter and driveway approach as well . He stated that he
wanted to go on record as being against "your asking me to give
over my property. " Councilman Tyrell suggested that Mr. Phillips
felt that the City was forcing him; and said if he didn ' t want
,1 to dedicate, then he should not.
Mr. Russell Bailey, 10030 Daines Dr. , also spoke briefly against
the proposal going through as it stands.
Mr. Jack Montgomery, 5504 Robinhood, corner of Daines and Robin-
hood, spoke in favor of the improvement , mentioning the hazards

caused by such a narrow street and the increased traffic to Live
Oak Park. , He said several years a little girl was hit by a car
and he felt that if Daines had been of normal width , the car
would have swerved to avoid her. He also stated that , at one
time, the man who owns the sanitarium proposed to improve Daines
at his own cost but was refused.
Mrs. Mary Phillips , 10036 Daines , referred to the little girl
who had been injured and stated that she felt it is the duty of
a mother to know where her child is after 4:00 p.m. because of
homeward-bound traffic, and that other streets are as much of a
hazard as Daines when children play ' in the street.
Mr. Joe Kr i skov i c, 10022 E. Daines Dr.. , spoke b r i of 1 y i n favor of
the proposed improvements , mentioning that he was one of those
who had dedicated property for the purpose.
Mrs. Jean Montgomery, 5504 Robinhood, also urged that the City
proceed with the widening before there is a fatality.
There being no one else who wished to speak, Councilmen Harker
moved to close the public hearing and Councilman Tyrell seconded
the motion , which carried unanimously.
Councilman Harker asked the City Attorney whether, in the event
of condemnation, the property would be subject to appraisal and
fair value paid for same, and how would this affect the other
property owners who dedicated theirs free. City Attorney Martin
replied that appraisal and payment at fair value would be neces-
sary, and that apparently those who have dedicated feel that they
have received fair va1ue.
There was considerable additional discussion , with Councilman
Tyrell suggesting that the project be approved upon condition
that the work will be done upon dedication. It was brought out
that the dedication needed would be 30 feet deep, with a total
of 213 lineal feet for the three parcels .
City Manager Koski suggested as an alternative that if the prop-
erty were dedicated , the City would pay the cost of curb and
gutter.- improvements. Councilman Tyrell questioned whether it
would be considered reasonable to the other property owners if
the City required them to pay for the improvements and did not
require it of the three undedicated parcels. A discussion of
the cost of the project disclosed that it would be an average of
$1 .80 per foot, which would be somewhat less than the cost of
condemnation. When asked if the three undedicated property
owners would accept this alternative, Mr. Bailey stated that he
would be willing to dedicate only 20 feet as he did not see the
necessity of a 12-ft. parkway. It was explained that the 12-
foot area was needed for future uti 1 ities. Mr. Phillips was in
agreement with Mr. Bailey ' s proposal of dedicating only 20 feet
if the City wou1d pay the cost of curb and gutter.
Councilman Tyrell moved, on the condition that all the parties
dedicate the 30 feet requested, that the City pay the cost of
curb, guttei,, and paveout , on that basis , that the Council
approve the project and find it in the public interest and in-
struct the Superintendent of Streets to cause the work. to be
cone,
After further discussion of 30 feet versus 20 feet of dedication ,
Mayor Pro Tem Merritt seconded the motion , which carried by the
following roll -call vote:

6. ORDINANCE NO. 68-2660 2nd reading, Re Amendments to Temple City
Zoning Code regarding uses in M- 1 and C-2 zones and residential
zones.
City Attorney Martin presented , for second reading, Ordinance No.
68-266, AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTIONS
9202 , 9390, AND 9410 OF THE TEMPLE CITY MUNICIPAL CODE RELATING
TO ZONING REGULATIONS. Councilman Tyrell moved to waive further
reading, approve, and adopt. Councilman Harker seconded, and the
motion carried unanimously.
7. REPORT ON PROPERTY IMPROVEMENT : 6329 Sultana Ave. , Leiland Shaw
Planning Director Dragi.cevich reported that he and Mr. Musso of
the County :Building Dept. inspected Mr. Shaw' s property Friday
noon , May 31 , 1968, and again on the present date, and found
most of the conditions corrected as recommended on May 7 , 1968.
Councilman Tyrell suggested that the report be made an exhibit
rather than read, and the other councilmen concurred. The Plan-
ning Director explained that the planting and landscaping had
not been done because of other work which had to precede yard
work. Councilman Harker moved to extend the date for completion
from June 4 to August 1 , 1968. Councilman Tyrell suggested that
there might be someone in the audience who wished to speak on
the subject.
Mr. A. L. Van Houten , 9076 Woolley , two doors from Sultana where
Mr. Shaw is building, said that he and many other people were
glad to see the progress which. had been made recently, and it
appeared that Mr. Shaw is sincerely attempting to complete the
job.
Mayor Pro Tem Merritt said he had viewed the project and it seemed
to be quite an improvement over what it has been in the past.
Councilman Tyrell seconded Mr. Harker' s motion , which carried
unanimously.
NEW BUSINESS :
8. FIREWORKS STANDS :
The Mayor Pro Tem read the list of applicants and locations for
fireworks stands , and the City Manager added two more which had
\ . not been received until after the agenda was printed. City Mana-
ger Koski reported that all . locations are either in C-2 or C-M
zones , copies of insurance policies were filed with each appli -
cation , and proper fees and deposits were received. There was a
discussion of two posts having been left from year-to-year on the
parking lot at 5721 Rosemead. Councilman Tyrell moved to grant
the applications on the condition that if they do not clear the
premises , then a permit will not be granted next year. Council -
man Harker seconded, and the motion was unanimously passed.
9. AWARD OF CONTRACT : Street improvement , Olive Street between
Temple City Blvd. and Encinita Ave.
City Manager Koski presented a resume of bids received on the
Olive Street improvement, indicating that Fred Weisz & Associates
of Walnut , Calif. , submitted the lowest bid, in the amount of
$27 ,975 , which was $5 ,691 , or 16. 9%, under the engineer' s esti -
mate of $33 ,666. The City Manager and City Attorney had prev-
iously reviewed all bid proposals , and checked the qualifications
of Fred Weisz & Assoc. with the County Road Dept. who regarded
them as responsible and capable. Councilman Tyrell moved to
accept all the bids and award the contract to Fred Weisz & Assoc, ,
Mayor Pro Tem Merritt seconded, and the motion passed unanimously.
The City Manager presented the recommendation of the Public Works
Dept. that, since the bid was considerably lower than the engi -
neer ' s estimate, sidewalks be installed under the alternate

provisions of the bid. After discussion of various aspects , in-
cluding removal of trees , Councilman Tyrell moved to authorize
removal of trees and the construction of sidewalks on the north
side of Olive St. between Temple City Blvd. and Cloverly Ave. for
an estimated $ 1600 bid proposal . Councilman Harker seconded the
motion , which carried unanimously.
10. RESOLUTION NO. 68-822 : Warrants and Demands
City Manager Koski presented Resolution No. 68-822 , A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, ALLOWING CLAIMS
AND DEMANDS IN THE SUM OF $19 ,220. 69, DEMAND NOS. 11187 THROUGH
11226. Councilman Tyrell moved to adopt Resolution No. 68-822 ,
Councilman Harker seconded , and the motion was unanimously passed.
11 . SET PUBLIC HEARING : 1968-69 Proposed Annual Budget
The City Manager advised that each member of the City Council had
received a copy of the proposed annual budget for 1968-69 and it
was appropriate to schedule dates for public hearings on same.
Councilman Tyrell moved to accept the proposed budget , seconded
by Councilman Harker, and unanimously carried. Following a dis-
cussion of dates , Councilman Harker moved to adjourn to 7 : 30 p.m. ,
June 10 , June 20 , and June 27 , 1968, for public hearings on the
budget for 1968-69. Seconded by Mayor Pro Tem Merritt , the motion
carried unanimously.
12. COMMUNICATIONS : City Manager Koski presented a letter from the
City of Manhattan Beach recommending adoption of a resolution, by
each city i n Los Angeles County, to the Board of Supervisors
urging economy and a "hold the line" policy with respect- to the
Los Angeles County Budget for 1968-69. After discussion , Coun-
cilman Tyrell moved to adopt such a resolution and instruct the
City Attorney to prepare one requesting fiscal responsibility.
The motion was unanimously passed.
13. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
A. Mrs. Alfred C. Ri l los , 6327 N. Livia , spoke regarding the
plans of the Junior Woman ' s Club to promote "Americanism" week
September 21 to 28 , for which a proclamation was requested. Mrs.
Rillos explained the ideas which the Club has for a parade in
connection with the Temple City Picnic- in-the-Park on Sept. 21
and a display of the original painting "Spirit of ' 76" in the
Temple City ' Library. Mrs. Ri1los mentioned also the contest
i, which is being held among high school students for a design for
some type of monument to honor the founders of Temple City and
its early history, and she said the Council would be asked to
select the type of monument which the Club hoped to place in
Temple City Park.
Councilman Tyrell moved to proclaim Sept. 21 -28 as ''Americanism
Week. " Seconded by Councilman Tyrell , the motion was unanimously
passed. Since Mrs. Rillos did not. have a copy of a proclamation ,
City Attorney Martin was asked to prepare one for the Mayor' s
signature. With respect to the further plans for the monument
and the parade, Mrs. Rillos was asked by Councilman Tyrell to
outline their plans and bring to the attention of the Council at
a later date.
B. Mrs. Fleta Gallagher, 6413 N. Reno, San Gabriel , spoke on
behalf of the Los Angeles Zoo and the project being sponsored by
the Junior Woman ' s Club to assist the zoo to acquire more ani -
mals , particularly those which are in danger of extinction . She
requested permission to solicit donations from the various orga-
nizations in Temple City and also that July 13 , 1968, be proclai -
med as "Temple City Day at the Zoo. " City Manager Koski advised
that July 13th was so proclaimed on May 7 . Mayor Pro Tem Merritt
moved to approve the request for a charitable solicitation permit.
Seconded by Councilman Harker, the motion passed unanimously.

14. MATTERS FROM CITY OFFICIALS :
i The City Manager presented . a request from Robert Feagans for use
of Live Oak Park on June 30th for a baseball game between the
Little People of America and the employees of the Black Watch
Steak House. Councilman Harker moved to approve, Councilman
Tyrell seconded, and the motion was passed unanimously.
The proposed State Plan of Community Action Agency was outlined
by the City Manager. There was a discussion of the various
aspects of the public health and welfare agencies in relation
to citizens of Temple City, and also of the EYOA with a- history
of problems. It was determined that if no action were taken
within 30 days (from date of Lt. Gov. Finch ' s letter) , or by
June 13th , such failure to respond would signify acceptance of
the proposed State Plan of Community Action Agency, so the mat-
ter was left on that basis.
OPENING OF BIDS FOR CITY INSURANCE :
City Manager Koski announced that only three bids had been re=
ceived by 10 :00 a.m. , the time for opening of bids , on June 3 ,
and that one other had been delivered after that time. A review
of the bids received disclosed that none of them had bid -uni -
formly as requested nor on all the items. In ans-we-r --to ques- -
tions by the Council , Mr. Charles Robinson , the Insurance Con-
sultant who assisted in evaluating the bids , stated that , in
his opinion , it would be possible to negotiate with the three
companies and come to an agreement before July 1 . Councilman
Tyrell moved that Mr. Charles Robinson be authorized to nego-
tiate for a comprehensive insurance policy. Councilman Harker
seconded and the motion carried unanimously.
RESOLUTION NO. 68-823 : Authorizing Examination of Sales and Use
Tax
City Manager Koski proposed the need for a trip to the Board of
Equalization in Sacramento for purposes of reviewing the sales
tax receipts for the prior year. The City Manager also ex-
plained that the Chamber of Commerce had requested information
of sales taxes in Temple City for use as a basis of computing
assessments for a proposed .promotional district.
Councilman Tyrell moved to adopt Resolution No. 68-823 , A RESO-
LUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AUTHORIZING
J EXAMINATION OF SALES AND USE 'TAX. Seconded by Councilman Harker,
the motion carried unanimously.
Councilman Tyrell then moved to authorize payment of expenses
for City Treasurer Buchan- and City Auditor File to go to Sacra-
mento to examine the sales tax records. Councilman Harker
seconded the motion , which pass unanimously.
RESOLUTION NO. 68-824: Appointing personnel - tree trimmer.
The City Manager presented Resolution No. 68-824, A RESOLUTION
OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL. Councilman
Tyrell moved to adopt Resolution No. 68-824, Councilman Harker
seconded, and the motion was approved unanimously.
RESOLUTION NO. 68-825 : Appointing personnel - administrative
assistant.
City Manager Koski presented Resolution No. 68-825 , A RESOLUTION
OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL. It was moved
by Councilman Tyrell , seconded by Councilman Harker , and unani -
mously passed, that Resolution No. 68-825 be adopted.
APPEAL RE CONDITIONAL USE PERMIT, 5508 Rosemead - Union Oil Sta-
tion. The City Manager recommended that a date be set for

public hearing. Councilman Tyrell moved to set June 18, 1968,
at 7 :30 p.m, , for public hearing of the appeal . Seconded by
Councilman Harker, the motion passed unanimously.
RESOLUTION NO. 68-826: Appoint alternate to City Selection
Committee
City Manager Koski brought up the matter of Councilman Beckley ' s
illness and the possibility that he would be unable to attend
the meeting of the City Selection Committee on June 6, It was
the consensus of those Councilmen present that the City desired
to vote for the candidate from Rosemead, Mr, Grady Weddon, It
appearing that there was no alternate representative to the City
Selection Committee, Councilman Tyrell moved to adopt Resolution
No. 68-826, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TEMPLE CITY, CALIFORNIA, APPOINTING A MEMBER OF THE SAID COUNCIL
OF SAID CITY TO THE CITY SELECTION COMMITTEE PURSUANT TO PART 3
OF DIV, 10 OF THE PUBLIC UTILITIES CODE. Seconded by Mayor Pro
Tem Merritt , the motion carried unanimously.
The City Manager called attention to the tree planting report
which showed a schedule for 222 trees to be planted at 'an approxi -
mate cost of $1800, Mayor Pro Tem Merritt inquired about new or
replacements and was told that most were new plaintings, The
Mayor Pro Tem mentioned that vandals had damaged several trees
on Cloverly, near the school , and suggested better supports for
protection.
Councilman Tyrell moved to adjourn to June 10 , 1968 , at 7 :30 P.m. ,
Councilman Harker seconded, and the motion carried unanimously.
Council adjourned at 9 : 15 p.m.
