CALL TO ORDER: Mayor Merritt called- the regular meeting of the City Council to order- at 7 : 34 p..me on Tuesday, March 21, 1978 in the ,Council .Chamber of� the- City Hall. 2 . INVOCATION: The invocation was given by-Reverend- Edwin Linberg, . Temple City Christian- Church; . 9723 Garibaldi Avenue. 3 . The Pledge- of-Allegiance to the Flag was led by Mayor Merritt. 4. Property owners were notified of the- public -hearing. Mayor Merritt declared the public hearing open and invited anyone wishing - to speak to come forward. There being no one to come forward, Councilman. Atkins moved to close the public hearing; seconded- by Councilman- Greenberg and carried. Councilman- Greenberg moved to- approve the- assessments as shown on staff report dated March 15 ; 1978; anal- direct the- Superintendent of Streets to-notify- the- property owners ; seconded by Councilman Atkins. and carried.. 7 . PRaFOBED-ORDINANCE RELATING-TO BINGO : City Manager Koski .advised that .City- Council, at.. their regular meeting -held-February 21 , - 1978-, - w-ere- presented with--two proposed ordinances for the- conduct of bingo- games, within. the.- City, at which time .Council seemed- to- prefer the,- ordinance. adopted. by the City of South.:Pasadena.. The matter was. :contin.ued to March. 21 with the. -hope. .there.-would be input- from the-'communi.ty- Several communications -h.ave-been-.received-.opp.osing the enactment of a bing.9 ordinance.,.. one from- Church- of.- the Nazarene and one from Reorganized Church .of ,Jesus Ch.ris.t of- Latter Day Saints . There are 41s.o _s.ome residents who- have signed- a- petition opposing the ordinance in. the audience. Mayor Merritt invited anyone wishing- to speak to the issue to come f onward. Chuck Kohnle, 9435 La Rosa Drive, stated- he was .attending the ,"Council meeting to support a bingo- ordinance on. behalf of the Temple City- YMCA. Robert Craig; - 9101 Hermosa Avenue, stated -he was representing Temple City Youth- Football and National- Little- League who were in favor of- a bingo- ordinance. Edwin- Linberg; 6716 Salter, President of- the Temple City Ministerial Association, stated he personally- sees n& Cher value nor harm in legalizing bingo, and thatin a poll of the• Minisberial Association three are opposed and - one favored adoption of a. ._bingo ordinance. -Louis Gilbertson, 9232 Sparklett Avenue, spoke on. behalf of St. Luke's Church ..in. favor of- a bingo ordinance, stating there are certain .occasi.ons- when they may wish. to conduct a bingo game, possibly the.- Golden Agers who have expressed. .a. desire- to have bingo, or during. their annual festival the men may -wish to play.. Mr. Gi.lberts.on further stated- that- there was- evidence-when this matter was on .the state ballot as an initiative the residents do not find bingo offensive. Sam Platamone,. 10601 Sparklett Avenue, stated he would like to see Ingo legalized. in order that senior citizens may enjoy the oppor- tuni.ty to use bi.n.go as a social activity. Reverend- David .Willett, pastor of Grace Brethren. Church, stated his official board- supports. his position in .opposition to a bingo ordinance .fully.. - He stated- there are alternatives to recreation for the senior citizens. Robert Gordon, 6748 Sultana, stated he favors a bingo ordinance, i.ngo Bing a better fund raising alternative to sending children. selling goods from door- to door, Council Minutes , March 21, 1978-Page 3 Vito Bonura, 5341 Halifax, stated he is a member of the Knights of Columbus who,- play bingo in Arcad.i.a; that most of the parti- cipants are middle- aged and- he feels they should have the right to play in Temple City,. He stated be looks at bingo as a past- time , that if-he-wants to gamble h.e, would do so at Santa Anita. Pete Costa, 10216 Olive Street, stated he has never had to worry about the City-,,- that- there- is good- participation from citizens on important- issues and- th.e Council has always acted competently. He stated-he - trusts - the Council- to enact an ordinance for social activities and not- allow- gambling- activities , and he would like to see a bingo- ordinance- passed. Daniel Volni,ck.,. 9827 Daines Drive,. presented a. petition signed by 42 resi.dents.�opposing an ordinance l.egal.izing .bingo or any other form of gambling,- - stating- he-was at- a: loss - to understand why in order to- have- social recreation, any money has to change hands . Boyce O `Bannon., 10316 Olive Street, stated- he feels bingo is a form of recreation, and- there is no question Temple City electorate voted in favor of bingo when- ft was -on the state ballot Bruce Carson, 6043 Reno, stated he is opposed to legalizing bingo and the statment made by one of the Councilmen that surrounding cities allow it why not- Temple City, isa poor justification. Gordon. Cutler, 8845 Ardendale, San Gabriel, stated he is opposed to legalizing gambling and feels something more u.plifing than the exchange of money could be offered senior citizens . He feels it will set a poor example for the youth of the community. Lou Smaidino4 6252 -Rosemead Boulevard-, stated that after listening to the testimony for and- against, he feels a bingo ordinance should be adopted- and- the- citizens can chose for themselves whether they . wish to participate. ' He reminded- Council it is not beyond their power to revoke the ordinance if it creates problems . Councilman Dennis stated the issue of whether to enact a bingo ordinance is not a religious one, nor is the issue whether bingo is gambling - or a form- of recreation° He felt the fact that two- thirds - of the- electorate in Temple City voted in favor of bingo when- the issue was on the state ballot., and the fact there was a representative group. testifying this evening who have an interest in. .bingo, .he.-would- be in- favor of enacting an ordinance with strict control_,to provide those- groups who want-to participate .the oppor- tunity to -do- so - and-at- the-- same time-keep:-tho-se elements that might cause- someone- to- consider- it gambling- for - profit out of the ordinance,.. Councilman Dennis stated-he-would be in favor of an ordinance similar to the one- drafted-- by- City Attorney Martin for the-.City of South Pasadena- with the modification to restrict bingo to a once a week operation and--to those organizations who may have established in the- community fora period of time. Councilman Atkins stated he agreed this is not a religious issue, however strong the beliefs and moral- values of those testifying in opposition; the people voted in favor., of Propostion 9 ; the City Attorney has- prepared an ordinance which. provides a great deal of control. He felt the additional restriction of once a week operation will keep the opportunists out of the community, and view's bingo as a recreational activity by some groups and a benign form of fund raising by others and would favor the adoption of a bingo ordinance. Coun.ci:.lman- Greenberg stated when this issue. first came before the • Council, he was not convinced there is a need. for, bingo in the community-, that- City Council dial -not necessarily have to enact one because other cities had- done so, and he was opposed. for philosophical reasons . His feelings have not changed;. he does not feel bin.go is a recreational pastime.,. and the City.- recrea.ti.on department provides for- the- recreational needs- of th.e- people of- this-.communi.ty o The South- Pasadena- ordinance defines- bin.go. as- a game of chance played - - for prizes and- he- opposes adoption. of a bingo ordinance, _ Y Council Minutes , March. 21, 1978�Page 4, Mayor Merritt stated- that- annually t.h.ere is a form of- gambling associated with th.e- Camellia- Festival_which. supports the youth groups in •th.e. community and-h.e=views an ordinance permitting bingo not unlike. that. activity; that he-would- be.- in favor of an ordinance similar to - t.h.e one- adopted. by- Soutb.- Pasadena with.-the added re- striction- that bingo- activity be limited- to one dray per week. Councilman Atkins moved- to in.clu.de the letters and petitions received as a part of the- minutes , seconded- by- Councilman- Dennis and carried . Councilman Dennis- inquired- of th.e City Attorney whether, under State law, it would be- perm.issible to establish- a criteria that organizations be established- in- the community for a specific .period of time. City Attorney Martin advised it- would, probably be unconstitutional . Councilman Atkins -moved- to- instruct the- City-Attorney to prepare an appropriate- ordinance authorizing- bingo- in . the: City to include a limitation on - any- organization conducting bingo more than one time per week, the hours of- operation limited to 10 ao.m,. to 12 : 00 a.m. , and signs beteg. limited to - the- day- bingo- is being. played, seconded by Councilman- Dennis- and- carried; - Coun.cilma"n-Greenberg noting his objection. 9 . ACCEPTANCE OF BID : LIVE OAK PARK. TENNIS -COURT DEVELOPMENT City Manager Koski p.r.esented- background info nation stating that City Council, at their regular meeting held March.- 7 , 1978., requested staff investigate- the qualifications of .the- three bidders as to their meeting- the- criteria established in the- specifications regarding .experience in the- construction of tennis court facilities- within th.e last five years-.. Staff-has prepared a memo- setting -for.th the bidders qualifications and a- revised bid- spread sheet sho,4pg the bas.e. bid and deducts- 1 and 2 for Council consideration-. Council determination this evening, will be review the bidders qualifications and determine-whether th.e low bidder bas- substanti.ally met th.e specifications and-whether.- to include or delete the deduct items 1 and 2 and award bid- to the- appropriate bidder. Councilman- Atkins stated- he fee.Ls. four tennis courts is the best optiori, . doubting that it would- be economically feasible to build three at this .time and- add another at a later date.; it's consistent with -the--.general plan established for- Live Oak Park; tennis courts are used- consistently throughout the year, .and h.e would be in. favor of the four court-base bid and awarding the bid to include irrigation to tb.e- low bidder . Councilman Greenberg agreed that the four court option is the best economically and is satisfied the low bidder has met th.e qualifications . Councilman Dennis stated- he has.-.some concerns that th.e. City needs four additional- courts - in- th.at there is. no- guarantee of their continued use, however would not object. George Peebles , Pacific Tennis , Ince addressed the Council to their concern regarding- th.e use of local.. union workers , stating that th.e- rotary finish requires six finishers , that four will be his own employees and-he will hire two more from the union, local in this area. Councilman Greenberg moved to accept the low bid from Pacific Tennis. Courts, Inc.. for four courts to include-irrigation in th.e amount of $117 , 300 , and to appropriate additional funds in the amount of $30,571 and amend the - adopted - budget- accordingly, seconded by Councilman Atkins and carried. 10.. APPEAL OF- TRAFFIC COMMISSION DECISION RE . OVERNIGHT PARKING PERMIT , DANIEL YAHNIAN=; 5702 Rowland ,Avenue City. Manager Koski advised City Council, at th.eir regular meeting held. March 7 , 1978, received appeal. from Daniel Yah:nian., at subject address-, .regarding Traffic- Commission denial, of an overnight. parking perii it . Mr. Yahn.ian. stated he could not. park. his Cadillac in the garage and lock the garage door wh.i.ch. was essential as his home is accessible from the garage and Council moved to continue the. matter f Council. The current. Assumption. .of• Liability..Amendmen.t expired on March. 14 and the- .County is asking City Council to approve the new Assumption of Liability Agreement which. incorporates the provisions of the self-.insurance: program-which was developed in cooperation with. representatives of the League of California Cities ' Los Angeles County.. Appeal of Traffic- Commission decision re: Overnight Parking Permit , Beverly Culebro, 5020 Daleview City Manager- Koski presented appeal of overnight parking permit denial by- Traffic Commission for- Beverly Culebro, 5020 Dalevi.ew stating the appeal- is- based. on the contention th.at neither her Cadillac nor the- truck could be parked. in th.e single car garage because of a washer and dryer placed there by th.e landlord. Staff investigation discloses that the Cadillac which. is .1.8 "10 long would fit in the 19 "5" garage if the- washer and dryer are removed , and the truck could then be- parked- in. the- driveway in front of the garagiao Beverly Culebro; 5020 Daieview, stated her landlord has promised many times - to widen the driveway, but nothing happens_; that sh.e lives in the front house and. she-.cannot block the driveway which. - serves the rear house and th.ey have three cars . Councilman Greenberg felt there are extenuating- circumstances and a permit should be granted. Councilman Dennis stated the landlord's responsibility- is to provide adequate- off-street parking to their tenants and moved to deny the appeal and grant an overnight parking permit for 120 days to allow staff to contact the landlord., seconded by Coun.ci d.n Atkins and carried. C. Claim for Damages-James Kleen, 4430 Temple City B:Oulevard City Manager. Koski presented claim. fo.r damages on behalf of James Kleen, 4430 Temple City Boulevard for .injuries alleged, to have occurred December 5 , 1977 on, Lower Azusa Road while riding a bicycle at subject location. Councilman. Greenberg moved to deny claim and refer to City's insurance carrier for further processing,; seconded by Councilman Atkins and- carried., D. Claim for Damages-Robert- Petry, 2546 Partrero, El Monte City Manager Koski presented claim for, damages on behalf of Robert Petry, 2546 Partrero, El Monte, for injuries alleged to have. been " sustained while operating a motorcycle on Lower Azusa Road January 14, 1978 . Councilman Greenberg moved to deny claim and. -refer to City' s insurance carrier for further -processing, seconded by. Counc.i.l.man. Atkins and carried. 16 . TIME -FOR THOSE IN' TH.E-, AUDIENCE WHO WISH- TO SPEAK!.'­_ Louis Gilbertson, 9232 Spark.l.ett, presented a publication received rom the Presidential office, which. contained a. summary- of th.e. distribution of federal funds , listing Temple City as- having received $7 , 414000 in total federal assistance. Mr. Gilbertson, also c.ommen.ted on the position- taken-.by Councilman, Greenberg on bingo, stating he respected him for voting his conviction.; also commenting that he has Council Minutes , March 21. , 19787Page 7 heard one of the candidates for Council is advising his supporters to vote for only one rather than the three votes. allowed. to fill the vacancies , - stating he- is sorry to see a candidate encouraging persons to disenfranch.ise- their vote. Mary• Lou Swain-, - 5758,- Agnes Avenue, stated she had- recently commented at a Chamber-meeting that occasionally it was--difficult to follow .the- agenda because the- agenda items were not sufficiently explained;. that- tonight- an- explanation was .given .regardi.ng each item-which-made'- it- easier to- follow the- action- being taken by- Councilo RECESS TO- CRA: The City Council recessed .at 9 .31 p .m.. to meet as the Community Redevelop- ment Agency, Mr-.. Tyrell being- absent; approved the minutes of the regular meeting held M-arch-- 7 ; ' 1978; adopted- procedures for imp-lementa.tion of California- Environmental- Quality Act ; and- adopte.d--resolution- approving warrants and demands-. The-minutes are set- forth- in- full - in the records of the Agency. RECONVENE AS CITY- COUNCIL 17 . ACTION-- ON-1-REQUEST- BY CRA There was no action to be taken. 18-. MATTERS---FROM' CITY OFFICIALS A. Los. Angeles County Prelininary General Plan City Manager Koski advised that subsequent to placing this item on the agenda, City was informed that additional information is being. forwarded- relating- to the Los Angeles County Prelininary General Plan. City Council continued the matter- to April 4, 1978. Bo. Request to attend AIP conferencee .Monterey-April 19-22, Planning Director City Manager presented- request from. th.e' Planning Director to attend the 1978- Calchapter Conference, American Institute of Planners to be held in. Monterey April 19-22, 1978 .. Funds have been allocated. in the 1977-78 budget. Councilman- Atkins moved to- approve Planning Director' s attendance at the AIP conference to include attendant costs in the amount of $320 , seconded by 'Councilman Greenberg and, carried.. C. Milestone .Report City Manager Koski presented the Milestone Report-A Regional. Profile prepared by the Southern California Association. of Govern- meats .as a result of Section 208 of the Federal Water Pollution Control Act amendments of 1972 . This is a completion. of Phase I of SCAG' s 208- program- which involves date acquisition and problem analysis:.: . The. .report states that SCAG has ten policies on water quality without listing them, and indicates they have four solid. waste management policies without listing th.em. Phase II should involve policies after evaluating Phase- I and therefore, a number of agencies , including the Los. Angel.e.s Cou.n.ty Regional Planning Commission- and the Flood Control District are opposed to the report. A written statement to oppose the report may, be sent to SLAG by March 27 or SCAG will assume the report: haz been approved. Councilman Greenberg moved- to disapprove the Milestone Report and instruct the City Manager to- convey Council ' s opposition. to SCAG, seconded by Councilman Atkins and carried D. Emergency Operations Center City Manager Ko.sk.i presented background information-, stating the City Council, at their regular meeting held October 4, 1,977 , approved. a license Agreement with. Los Angeles County for the purpose. of 'o Council Minutes , March 21, 1978-Page 8 leasing and rehabilitating the County-owned. Temple City Library basement as a City Emergency Operations .Center_, Use of the basement will require modifications to the existing southerly stairwell, modifying existing northerly stairwell for use as an emergency exit, and construction of an entry including an airconditioner and equipment room. Council expressed- some concern that a plan for the emergency operations. center has not been prepared. City Manager Koski advised this would be primarily to house a communication system. How the emergency reserve will develop with. volunteers will depend a great deal on citizen response, but this would- provide facilities to operate under emergency conditions .. At this time the City does not have emergency communication capabilities . Councilman Atkins moved to authorize staff to initiate design. work for the .improvement of the Lo.s Angeles County Library basement as an Emergency Operating Center to include access stairs , air- conditioning system, and equipment room, not to exceed $2, 500, seconded- by Councilman Dennis and carried. E... Councilman Greenberg referred to petition received from residents in the- area of Honda-.of- Temple City located at 9228 Las Tunas Drive and requested stafresolve the situation before Council has to take action. Councilman -Greenberg commented on the lack of representation from among elected officials at the SCAG spring assembly. F. Councilman Atkins requested a letter be forwarded to those organizations who generally request permit to sell fireworks , advising them of Council policy that local groups only be given the privilege of selling fireworks . 21.
