CITY COUNCIL
MINUTES
JUNE 7, 1983
INITIATION:
1. CALL TO ORDER:
Mayor Gillanders called the regular meeting of the City Council to
order at 7:30 p.m. on Tuesday, June 7, 1983, in the Council Chamber
of the City Hall.
2. The invocation was given by Reverend Albert Frederico, Seventh Day
Adventist Church, 9664 E. Broadway.
3. The Pledge of Allegiance to the Flag was led by Mayor Gillanders.
4. ROLL CALL:
Present: Councilmen - Atkins, Dennis, Swain, Tyrell, Gillanders
Absent: Councilmen -None
. Also Present: City Manager Koski, City Attorney Martin, Assistant
'City Manager Kimbrough, Planning Director Shaw, Parks
and Recreation Director Kobett, District Engineer
Buchan, Municipal Service Consultant French, Julie
Estrada, Temple City Times and David Gero, the
Pacesetter.
5. CONSENT CALENDAR:
Councilman Swain requested Item 5, B -1 be removed and Councilman
Tyrell requested Item 5,.B -2 be removed from the Consent Calendar.
On motion of Councilman Atkins, seconded by Councilman Tyrell, Items
A, and C through J on the Consent Calendar were approved as recom-
mended and carried.
A. APPROVAL OF MINUTES - Regular Meeting of May 17, 1983.
Approved as written.
C. RECOMMENDATION FROM PARKS AND RECREATION COMMISSION - Meeting of
May 18, 1983: REQUEST FOR USE OF LIVE OAK PARK AND TEMPLE CITY
PARK - CHAMBER OF COMMERCE
Approved recommendation from Parks and Recreation Commission for
use of portions of Live Oak Park and Temple City Park by the
Chamber of Commerce for the First Annual "Gold Miner Days" com-
mencing July 10 through August 6,1983, subject to the required
Certificate of Insurance.
D. REQUEST FOR PARTIAL PAYMENT - RECREATION SYSTEMS, INC.
Authorized partial payment to Recreation Systems, Inc. for design
of proposed improvements for Live Oak Park in the sum of $2,395
pursuant to the terms of the agreement.
E. PROPOSED BUDGET - FY 1983 -84
Received the proposed budget for fiscal year 1983 -84 and set
public hearing June 21, 1983.
F. PROGRESS PAYMENT - STATE CONSTRUCTION DIVISION: PHASE III, STREET
LIGHTING CONVERSION (Kauffman,. Camellia, portions of Las Tunas)
Authorized progress payment in the sum of $4,673 to State Con-
struction Division of Union Metal Mfg. Co. for street lighting
work performed pursuant to the agreement.

G. ACCEPTANCE OF WORK: UNDERGROUND UTILITY DISTRICT NO. 5 (Civic
Center)
Accepted work performed; authorized payment in the sum of $525;
authorized filing Notice of Completion and authorized the payment
of 10% retention at the end of the 35 -day lien period in the'sum
of $617.
H. PLANNING COMMISSION ACTION: Meeting of May 24, 1983
Received and filed memo relating to action taken by the µPlanning
Commission at their regular meeting held May 24, 1983.
I. RESOLUTION No. 83 -2169: EMPLOYMENT OF PERSONNEL
Adopted Resolution No. 83 -2169 A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL.
J. RESOLUTION NO. 83 -2168: WARRANTS AND DEMANDS
Adopted Resolution No. 83 -2168 A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM
OF $293,376.63 DEMAND NOS. 5762 THRU 5917.
CONSENT CALENDAR ITEM. 5 B(1) POSTING OF TWO -HOUR TIME LIMIT PARKING
SIGNS - ROSEMEAD BOULEVARD, SOUTH OF ELM AVENUE.
Councilman Swain stated that due to the nature and demands of the
businesses along this section of Rosemead that she wanted to insure
that the signs included Saturday and Sunday restricted parking.
Councilman Tyrell moved to approve the signs for a two hour parking
zone restriction with effective hours daily including Saturday and
Sunday from 7:00 a.m. to 6:00 p.m. on the east side of Rosemead
Boulevard South of Elm Avenue, seconded by Councilman Swain and
unanimously carried.
CONSENT CALENDAR ITEM 5 B(2) REQUEST FOR PERMIT TO PRACTICE WITH MARCH-
ING BAND ON TRELAWNEY AVENUE - TEMPLE CITY HIGH SCHOOL ,
Councilman Tyrell stated there was some objection to the hours during
which the band was scheduled to conduct their practice, and not to
the activity itself. The band requested commencing practice at 8:00
a.m. which is inconvenient to some of the residents who work nights
and need to sleep through the morning hours.
City Manager Koski stated the High School has a limited area and
they like to practice on the street to gain experience marching on__
a_street surface which they do not have access to on the school
grounds.
Councilman Atkins moved to approve the request for a permit for the
Temple City High School Marching Band to conduct their practice on
Trelawney Avenue subject to a revision in the hours during which the
practice would take place and subject to the required Certificate of
Insurance, seconded by Councilman Tyrell, and unanimously carried.
6. UNFINISHED BUSINESS:
A. PUBLIC HEARING: 7:30 p.m. - ADOPTION OF THE
.982 LOS ANGELES
COUNTY ELECTRICAL CODE: ORDINANCE NO. 83 -539.
City Manager Koski presented background information stating the County
Board of Supervisors adopted the 1981 Edition of the National Electri-
cal Code on October 17, 1982. The national model code is upgraded
every three years. The significant changes in the Los Angeles County
Electrical Laws include clarification of plan checking requirements
and approval of electrical material and equipment. There are no
changes proposed to the permit fee schedule.

Mayor Gillanders declared the,.public hearing open and invited any-
one wishing to speak to come-forward. 'There being no one to come
forward to speak, Councilman Atkins moved to close public hearing,
seconded by Councilman Swain, and unanimously carried.
Councilman Dennis moved to waive further reading and adopt Ordinance
No. 83 -539 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
AMENDING SECTION 7300 OF THE TEMPLE CITY MUNICIPAL CODE BY ADOPTING
BY REFERENCE THE LOS ANGELES COUNTY ELECTRICAL CODE AS CONTAINED IN
THE 1982 EDITION OF THE LOS ANGELES COUNTY ELECTRICAL CODE, seconded
by Councilman Tyrell and unanimously carried.
B. PUBLIC HEARING: 7:30 p.m. - 1972 LANDSCAPING AND LIGHTING ACT
1983 -84 ASSESSMENT
City Manager Koski presented background information, stating the City
Council at its regular meeting held May 17, 1983, reviewed the Engi-
neer's Report for the City -Wide Lighting District for fiscal year
1983 -84 and adopted Resolution declaring the City's intent to order
the FY 1983 -84 levy and fixing June 7, 1983, to hear objections.
Notices were published as required by law. No change is proposed in
the current assessment rates of $11.50 per dwelling unit in Zone A
residential, and $3.50 per dwelling unit in Zone B residential, and
64.4 cents per front foot, commercial.
Mayor Gillanders declared the public hearing open and invited any-
one wishing to speak to come.forward. There being no one to come
forward to speak, Councilman Atkins moved to close public hearing,
seconded by Councilman Dennis and unanimously carried.
Councilman Atkins moved to adopt Resolution No. 83- 2167A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ORDERING THE LEVY AND
COLLECTION OF ASSESSMENT FOR FISCAL YEAR 1983 -84 WITHIN,:THE CITY -WIDE
LIGHTING MAINTENANCE DISTRICT PURSUANT TO THE LANDSCAPING AND LIGHT-
ING ACT OF 1972, seconded by Councilman Dennis and unanimously carried.
C. PROPOSED ORDINANCE NO. 83 -538 PROHIBITING SECOND UNITS IN THE
R -1 (single family) RESIDENTIAL ZONE
City Manager Koski presented background information stating the
City Council at its regular meeting of May 19, 1983, held a public
hearing to develop policies with respect to allowing a second unit
r� „on a single family lot as required by SB 1534. The City Council
instructed the City'Attorney to prepare an ordinance which would
prohibit second units within the R -1 (single family) residential
zones.
City Attorney Martin introduced Ordinance No. 83 -538 AN ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ADOPTING AN AMENDMENT TO
THE TEMPLE CITY ZONING CODE RELATING TO THE R -1 (SINGLE FAMILY) RESI-
DENTIAL ZONE WITH RESPECT TO THE PROHIBITION OF SECOND UNITS AS
GRANNY FLATS AND CONTAINED IN SB 1534 (MELLO) CHAPTER 1440, 1982
STATUTES, by title only. Councilman Tyrell moved to waive further
reading, seconded by Councilman Atkins and unanimously carried.

RECESS TO CRA:
At this time, Council recessed to meet as the Community Redevelopment Agency,
all members being present, approved the minutes of the regular meeting of
May 17, 1983, approved signa.e for Foot Health Center, and adopted . resolu-
tion approving warrants and demands. The minutes are set forth in full in
the records of the Agency.

RECONVENE AS CITY COUNCIL:
10. ACTION ON REQUEST BY CRA:
There was no action to be taken.
11. MATTERS FROM CITY OFFICIALS:
A. 1984 LEAGUE OF CALIFORNIA CITIES PENDING DUES INCREASE
Councilman Atkins moved to refer the matter of the dues
increase to City Council's adjourned meeting scheduled for
June 13, 1983, seconded by Councilman Swain and unanimously
carried.
B. CLAIM FOR DAMAGES:
Referred the claim by Benigno Flores- Linares to City.
insurance carrier.
C. JOINT POWERS INSURANCE AUTHORITY - MAIL BALLOTS
Mayor Gillanders expressed concern over correspondence from
the JPIA regarding admission of new members and requested City
staff to communicate his concern to the Authority Staff,
specifically that the mail -in ballot contain a provision for
objections as well as consent.
D. JOINT POWERS INSURANCE AUTHORITY - ELECTION OF PRESIDENT
City Council directed staff to obtain position papers from the
two candidates for president to enable them to make an evalua-
tion.
12. ADJOURNMENT:
On motion by Councilman Swain, seconded by Councilman Tyrell, meet-
ing adjourned at 8:00 p.m. Next regular meeting of the City Council
will be held Tuesday, June 21, 1983, 7:30 p.m. in the Council Chamber
of the City Hall.
