® AN ORDINANCE AMENDING THE GREENCASTLE PLANNING
AND ZONING ORDINANCE BY AMENDING THE ZONING MAP
WHEREAS, the Plan Commission of the City of Greencastle, pursuant to the Petition of
LaWayne & Carol Engelstad, has prepared this Ordinance to amend the Greencastle Planning and Zoning
Ordinance by amending the zoning map; and
WHEREAS, the Greencastle Plan Commission has reported that it held a public hearing
concerning this ordinance on May 27, 2003, after timely notice of the hearing was given by publication in
the Banner-Graphic Greencastle, Indiana on May 16, 2003; and
WHEREAS, the Greencastle Plan Commission has reported that it paid reasonable regard to the
following factors enumerated in I.C. 36 -74-603 in consideration of the ordinance and determination of a
recommendation to be made to the Common Council:
1. the Comprehensive Plan;
2. current conditions and the character of current structures and uses in each district;
3. the most desirable use for which the land in each district is adapted;
4. the conservation of property values throughout the jurisdiction; and
5. responsible growth and development; and
WHEREAS, the Greencastle Plan Commission has certified this Ordinance to the Common
Council with a recommendation by a majority vote in favor of adoption; and
® WHEREAS, the Common Council has considered the recommendation of the Greencastle Plan
Commission and has paid reasonable regard to the factor enumerated in I.C. 36 -7-4 -603 before acting on
this Ordinance; and
WHEREAS, the Common Council has determined that this Ordinance should be adopted without
amendment as certified by the Greencastle Plan Commission.
--- NOW THEREFORE be.. it ordained and adopted by the _Common - Council of the City of
Greencastle, Indiana, that:
The City of Greencastle Zoning Map of the City of Greencastle Code, is hereby amended by
changing the zoning classification for the following described real estate from LI to SDI in accordance
with I.C. 36 -74-614:
Situate in the State of Indiana, County of Putnam and being a part of the Northeast quarter of
Section 20, Township 14 North, Range 4 West of the Second Principal Meridian more particularly
described to -wit:
Beginning at a point 162 feet South of the Northeast corner of the West half of the Northeast
quarter of Section 20, Township 14 North, Range 4 West; thence North 60 degrees 30 minutes
West 268.00 feet to the East right -of -way line of a railroad thence Southwesterly 420 feet, more
or less, with said right -of -way; thence South 58 degrees 37 minutes East 302.9 feet; thence East
169.8 feet to an existing property line; thence North 394.7 feet with said property line; thence
North 60 degrees 30 minutes West 37.0 feet to the point of beginning, containing 3.7 acres, more

e This ordinance shall have full force and effect upon passage. The Clerk- Treasurer of the City of
Greencastle is ordered to have this Ordinance published by inserting a copy of the Ordinance in each of
the two (2) sets of the City of Greencastle Code maintained on file for public inspection in the office of
the Clerk- Treasurer.
PASSED AND ADOPTED by the City of Greencastle Common Council this 8C` day of

Amendment to Zoning Map of the City of Greencastle Code to rezone approximately 3.7 acres
located at 1181 Carriage House Lane from LI zone to SDI zone.
Petitioner: LaWayne and Carol Engelstad
WHEREAS, the Plan Commission of the City of Greencastle initiated and prepared the attached
Ordinance to amend the Greencastle Planning and Zoning Ordinance by amending the zoning map; and
WHEREAS, the Greencastle Plan Commission has reported that it held a public hearing concerning this
ordinance on May 27, 2003, after timely notice of the hearing was given by publication in the Banner
Graphic Greencastle, Indiana, on May 16, 2003; and
WHEREAS, the Greencastle Plan Commission has reported that it paid reasonable regard to the following

favorable recommendation, subject to the conditions or commitments attached hereto and/or stated in the
minutes of the Plan Commission, and incorporated herein and made a part of this certification.

RE: 1881 Carriage House Lane, Greencastle, LaWayne and Carol Engelstad
Dear Property Owner,
On February 28, 2003 The City of Greencastle passed a new zoning ordinance and
zoning map. When we were re- drawing some of the zoning lines and districts we
® inadvertently put part of the Engelstad's property into Light Industrial along with the
sewer plant which we intended to put into Light Industrial. Since the zoning map is now
part of an ordinance we need to re -zone the Engelstad's property back to residential
(SDI) through the Planning Commission and City Council just as any citizen seeking
rezoning would do. Part of this process is giving legal notification to surrounding
property owners that a hearing will take place. The petition to rezone part of 1881
Carriage House Lane (see attached legal description) from Light Industrial (LI) to Single
Family Dwelling (SDI) will come before the Planning Commission on Tuesday May 27,
2003 at 7:30 P.M. at City Hall, 1 N. Locust St. Greencastle, IN.
