HomeMy Public PortalAbout1998-01533 Member Thies introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.98-15 RESOLUTION GRANTING FINAL APPROVAL TO 1'Hk: PLAT OF FOXBERRY FARMS 5TH ADDITION WHEREAS, Wallace Doerr and Lundgren Bros. Construction, Inc. (collectively, the "Applicants") have requested approval to plat certain property in Medina generally located west of Co. Rd. 116, north of T.H. 55 and south of Hackamore Road (the 'Property"); and WHEREAS, portions of the Property have been designated and previously platted as Foxberry Farms, Foxberry Farms 2nd Addition, Foxberry Farms 3rd Addition and Foxberry Farms 4th Addition; and WHEREAS, the Applicants have proposed to plat on additional 261ots as Foxberry Farms 5th Addition; and WHEREAS, the final plat has been submitted to and reviewed by the city and found to be consistent with all requirements of previous approvals and city ordinances. NOW, 'THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that final approval is hereby granted to the Applicants for the plat of Foxberry Farms 5th Addition, subject to the following: I. No lot within the approved plat may be developed with a single family home or accessory use until Lundgren Bros. Construction, Inc. and the city have executed a development agreement regarding said lot; II. Final approval of this plat is conditional upon a favorable report on the condition of title from the city attorney; 3. The Applicants must file the final plat with Hennepin county within 60 days of the date R1i13123015 M8230-157 98-15 03-04-98 34 of this resolution or the approval granted hereby shall be considered null and void; and 4 The Applicants must pay to the city a fee in an amount sufficient to reimburse the city for its costs and expenses in reviewing the plat, including the cost of preparing and negotiating the development agreement.
