HomeMy Public PortalAbout1998-02553 Member Thies introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.98-25 RESOLUTION AFFIRMING FINAL APPROVAL OF '1'11L PLAT OF FOXBERRY FARMS 5TH ADDITION WHEREAS, Wallace Doerr and Lundgren Bros. Construction, Inc. (collectively, the "Applicants") have requested approval to plat certain property in Medina generally located west of Co. Rd. 116, north of T.H. 55 and south of Hackamore Road (the 'Property"); and WHEREAS, portions of the Property have been designated and previously platted as Foxberry Farms, Foxberry Farms 2nd Addition, Foxberry Farms 3rd Addition and Foxberry Farms 4th Addition; and WHEREAS, the Applicants have proposed to plat an additional 26 lots as Foxberry Farms 5th Addition; and WHEREAS, the plat was submitted to and reviewed by the city and found to be consistent with all requirements of previous approvals and city ordinances; and WHEREAS, approval of the final plat was previously granted by the city council on March 4, 1998; and WHEREAS, the Applicants have requested that the city affirm its previous approval and grant them 60 days from the date of the affirmation to file the plat with Hennepin County. NOW,11 LREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that its final approval for the plat of Foxberry Farms 5th Addition is hereby affirmed, subject to the following: 1. The Applicants must file the final plat with Hennepin county within 60 days of the date of this resolution or the approval granted hereby shall be considered null and void; and RHB143399 ME230-157 98-25 98-05-19 54 2. The Applicants must pay to the city a fee in an amount sufficient to reimburse the city for its costs and expenses in reviewing the plat, including the cost of preparing and negotiating the development agreement.
