HomeMy Public PortalAbout70-007 (02-03-70) RESOLUTION N0. 70-7 RESOLIITION OF TAE CITY COIINCIL THAT BUILDINGS ARE SIIBSTANDARD AND CONSTI'I`[TTE A PUBLIC NUISANCE AND DIRECTING TAE OWNER TO RECONSTRIICT, OR PROPERLY REPAIR SAID BUILDINGS OR REMOVE THE SAME WITHTN THIRTY DAYS FROM THE DATE A COPY OF THIS RESOLUTION IS POSTED UPON SAID BUILDINGS, AND AUTHORIZiDIG THE BUILDING OFFICIAL TO REMOVE OR RAZE SAID BUILDINGS SHOIILD THE OWNER NOT COMPLY. Wf�REAS there came on for public hearing on February 3, 1970, a proceeding to determine whether or not buildings located. in the City of Lynwood, as hereinafter described, aresubstandard and constitute a public nuisance, and. WHEREAS said real property is described as follows; The south 30 feet of Lot 406, Tra.ct 7984 Gounty of Los Angeles, State of California, as recorded in Map Book 90, page 34, commonly known as 10965-10967 Duncan Avenue, City of Lynwood, California; and WHEREAS, the City Council of the City of Lynwood, on January 20, 1970, at a regular meeting of the City Council, enacted. Resolution No. 70-5, wherein the City Council d.irected the Building Official and the City Clerk to notify the owner of the buildings located on the lot or parcel of land. hereinabove described. and any mortgagee or beneficiary of any mortgagee or deed of trust which is an encumbrance upon said lot or parcel of land, to appear on February 3, 1970, at the hour of 7:30 p.m. before the City Council at the City Hall, 11330 Bullis Road, Lynwood, then and there to show cause why the build.ings alleged to be substandard. and unfit as defined by the Uniform Building Cod.e should not be d.eclared, by the City Council to be substandard and a public nuisance. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lynwood at a public hearing of the above described matter, at a regular meeting of the City Council on February 3, 1g70 find.s: (1) l. That notice of the time and place of said hearing has been duly and regularly �iven by the Building Official and the City Clerk in accordance with said Resolution No. 70-5, and. as required by 1aw. 2. That the matter came on regularly for hearing before the City Council on February 3, 1970. 3. That the City Council read and condidered. the report of the Building Official filed with the City Council, and the same was introd.uced into evid.ence at the hearing and, mad.e a part of the record of these proceed.ings. 4. That certain members of the City Council interrogated the Building Official at said hearing and the $uilding Official answered said interrogatories and verbally testified to,matters material to the hearing. 5. That Ken Heineman appeared at said hearing and. tes�ified that he is the owner of a second trust deed on the lot or parcel of land, upon which is located the buildings alleged to be substandard and unfit and that he had no objections to the proceeding. As there was no appearance by any other owner, mortgagee or benefieiary, the hearing was declared. closed.. 6. That said build.ings located. on �he lot or parcel of land hereinabove described. are substand.ard, unfit and constitute a publie nuisance as defined, by the IIniform Bixild.ing Code in the following particulars: 1. Foundation vents and crawl screens 2. All Screens and windows 3. Replace existing electrical service with new 100 amp. service per code. All electrical wiring to be check� by licensed electrician, and repaired. as needed. All exterior boxes, fixtures and wiring to be in waterproof condition. Cover plates on all switch and outlet boxes. 4. Repair holes in interior walls. 5. Bathroom fixtures to be in good repair 6. Bathroom and kitchen to be santized; floors to be in sanitary condition. (2) 7. Ex�erior of building to be in a waterproof condition. 8. Paint as needed. 9. Remove all weeds, trash and debris from property. 7. That Betty Louise Schultz is the owner of the lot or parcel of land described as follows: The south 30 feet of Lot 406, Traet 7984, County of Los An�es, State of California, as recorded in Map Book 90, page 34, commonly known as 10965-1og67 Duncan Avenue, City of Lynwood, California, and L. J. Stanley, and K. A. and M. R. Heinemann are the beneficiaries (mortgagees) of an encumbranc� of record, upon said real property. NOW, THEREFORE, BE IT FIIRTHER RESOLVED that (a) the City Council of the City of Lynwood declares the buildings located on the lot or parcel of land hereinabove described are a public nuisance. (b) that Betty Louise Schultz, owner of said buildings, is directed to abate the same within thirty t30) days after the date of posting on said premises a notice of passage of said resolution by having said buildings properly reconstructed or repaired, or by having the same razed or removed, and, (c) that if said. owner does not abate said. public nuisance, said buildings will be razed or removed by the City of Lynwood, on force account or by contract and the expense thereof made a lien on the lot or parcel of land upon which the buildings are located. BE IT FURTf�R RESOLVED that unless the nuisance is abated by the owner within thirty (30} days of the posting of said notice as hereinabove d.escribed., the Building Official is directed to call for bids for the razing or removal of the buildings and subject to compliance with bid procedures contract for the removal or razing said buildings, or to remove said. buildings under force account. The City Clerk is hereby authorized and directed to (3) forwaFd a certified copy of this resolution to the County Recorder of Los Angeles County for recordat3on.
