HomeMy Public PortalAbout70-017 (03-03-70) RESOLUTION N0. 70-17 RESOLUTION OF THE CITY COUNCIL THAT BUILDINGS ARE SUBSTANDARD AND CONSTITUTE A PUBLIC NUISANCE AND DIRECTING THE OWNER OT RECONSTRUCT, OR PROPERLY REPAIE SAID BUILDINGS OR REMOVE THE SAME WITHIN THIRTY DAYS FROM THE DATE A COPY OF THIS RESOLUTION IS POSTED UPON SAID BUILDINGS, AND AUTHORIZING THF BUILDING OFFICIAL TO REMOVE OR RAZE SAID BUILDINGS SHOULD THE OWNER NOT COMPLY. WHEREAS, there came for public hearing on March 3, 1970, a proceedings to determine whether or not buildings located in the City of Lynwood, as hereinafter described, are substandard and constitute a public nuisance, and WHEREAS, said real property is described as follows: Lot 190, Tract �572, County of Los Angeles, State of California, as recorded in Map Book 82, pages 22 and 23, commonly known as 4032 Virginia Avenue, City of Lynwood, California, and WHEREAS, the City Council of the City of Lynwood, on February 3, 1970, at a regular meeting of the City Council , enacted Resolution No. 70-10, wherein the City Council directed the Building Official and the City Clerk to notify the owner of the buildings located on the lot or parcel of land hereinabove described and any mortgagee or beneficiary of any mortgagee or deed of trust which is an encumbrance upon said lot or parcel of land, to appear on March 3, 19�0, at the hour cf �:30 p.m, before the City Council at the City Hall, located at 11330 Bullis Road, Lynwood, then and there to show cause why the buildings alleged to be substandard and unfit as defined by Uniform Building Code would not be declared by the City Council to be substandard and a public nuisance. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lynwood at a public hearing of the above described -1- matter, at a regular meeting of the City Council on March 3, 1970, finds: l. That notice of the time and place of said hearing has been duly and regularly given by the Building Official and the City Clerk in accordance with said Resolution No. 70-10, and as required by law. 2. That the matter came on regularly for hearing before the City Council on March 3, 1970. 3. That the City Council read and considered the report of the Building Official filed with the City Council and the same was introduced into evidence at the hearing and made a part of the record of these proceedings. 4. That certain members of the City Council interrogated the Building Official at said hearing and the Building Official answered said interrogatories and verbally testified to matters material to the hearing. 5• As there was no appearance by any owner, mortgagee or beneficiary, the hearing was declared closed. 6. That said buildings located on the lot or narcel of land hereinabove described are substandard, unfit and constitute a public nuisance as defined by the Uniform Building Code in the following particulars: a. Dry grass and weeds to be removed. b. Cut hedge at front property line to a maximum of 42" high. c. Window and foundation vent screens. d. Wiring to garage. e. Driveway approach. 7. That UJilliam John Thompson, Jr. is the owner of the lot or parcel of land described as follows: Lot 1g0, Tract 7572, County of Los Angeles, State of California, as recorded in Map Book 82, pages 22 and 23, commonly known as 4032 Virginia Avenue, City of I,ynwood, California, and -2- that the City of Los Angeles has a mortgage and the County of Los Angeles has a substantial lien of record, upon said real property. NOW, THEREFORE, BE IT FURTHER RESOLVED that l. The City Council of the City of Lynwood declares the buildings located on the lot or parcel of land hereinabove described are a public nuisance. 2. That William John Thompson, Jr., owner of said buildings, is directed to abate the same within thirty (30) days after the date of posting on said premises a notice of passage of said resolution by having said buildings properly reconstructed or repaired, or by having the same razed or removed and, 3. That if said owner does not abate said public nuisance, said buildings will be razed or removed by the City of Lynwood, on force account or by contract and the expense thereof made a lien on the lot or parcel of land upon which the buildings are located. BE IT FURTHER RESOLVED that unless the nuisance is abated by the owner within thirty (3�) days of the posting of said notice as hereinabove described, the Building Official is directed to call for bids for the razing or removal of the buildings and subject to compliance with bid procedures,contract for the removal or razing o£ said buildings, or to remove said buildings under force account. The City Clerk is hereby authorized and directed to £orward a certified copy of this resolution to the County Recorder of Los Angeles County for recordation.
