HomeMy Public PortalAbout1998-03065 Member Johnson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.98-30 RESOLUTION GRANTING FINAL APPROVAL FOR 'IJILL PLAT OF REGENCY ESTATES WHEREAS, Michael S. Kelly and Mary J. Kelly (the "Applicants") are the fee owners of property located within Medina (the 'Property") and legally described as follows: Par 1: That part of Government Lot 1, Section 2, Township 118, Range 23 which lies North of a line parallel with and 800 feet South measured at right angles to the North line of said Government Lot and West of a line drawn parallel with and 600 feet East measured at right angles to the West line of said Government Lot and its Southerly extension. Par 2: That part of Government Lot 1, Section 2, Township 118, Range 23 and that part of the accretions to said Government Lot 1, all described as follows: Beginning at the Northwest corner of said Government Lot 1; thence on an assumed bearing of South 00 degrees 24 minutes 35 seconds West along the West line of said Government Lot 1 and its extension a distance of 608.56 feet; thence South 06 degrees 47 minutes 43 seconds West to a line which is parallel with and 800 feet South, measured at right angles, from the North line of said Government Lot 1 and its Westerly extension; thence East along said parallel line to a line which is parallel with and 600 feet East, measured at right angles, from the West line of said Government Lot 1 and its Southerly extension; thence North along the last -described parallel line to the North line of said Government Lot 1; thence West along said North line to the point of beginning; except that part of the above described land lying within said Government Lot 1. Subject to an easement for County Ditch No. 26; (as to land in Par 2) and WHEREAS, the Applicants desire to plat the Property into 10 lots and dedicate a street and easements to the public; and WHEREAS, on February 17, 1998 the city council of the city of Medina, lrnnesota, (the "City") granted preliminary approval to the Applicants for the plat of the Property to be known as Regency Estates; and RHB145050 ME230-272 98-30 06-16-98 66 WHEREAS, the Applicants have prepared the final plat of Regency Estates in accordance with the preliminary approval and the ordinances of the City and now hereby request final approval of said plat. NOW,'1'HEREFORE, BE IT RESOLVED By the city council of the City of Medina, Minnesota, that final approval be granted to the Applicants for the plat of Regency Estates, subject to the following terms and conditions: 1. The plat is subject to the terms and conditions of approval by the Minnesota Department of Natural Resources and the Elm Creek Watershed District; 2. No filling shall be allowed within the drainage and utility easements on the western border of the site; 3. The developers of the lots are encouraged to plant landscaping appropriate for filtration and stabilization of soils; 4. Development of the site may not be commenced without moving the silt fence as shown on the preliminary plat; Development of each lot will require planting of a minimum of two deciduous trees at least 2-1/2 inches in diameter; 6. The Applicants must execute a development agreement regarding construction of the improvements within Regency Estates in the form approved by the city attorney; 7 The Applicants must pay to the City an administrative fee in the amount necessary to reimburse the City for its expenses in reviewing this plat; 8. The Applicants must pay a park dedication fee of $5000 prior to issuance of building permits on any of the lots; and 9. The Applicants must file the final plat of Regency Estates with Hennepin County within 60 days of the date of this resolution or the final plat approval hereby granted shall be null and void. NOW,'1HEREFORE, BE IT FURTHER RESOLVED By the city council of the City of Medina, Minnesota, that the plat of Regency Estates is approved with a variance for Lot 3, Block 2 having less than the required width of 100 feet at the front building setback line, the hardship being the location of the existing house on the property and its consistence with the development of nearby plats, RHB145050 ME230-272 98-30 06-16-98 67 subject to the following conditions regarding said lot: 1. Driveway construction must be approved by the public works director and fire chief including a pullover area built to seven ton standards and a 20 foot minimum width before a building permit is issued; 2. A fire hydrant must be located near the road and driveway; 3. Parking and turn around area be provided at the house; and 4. Driveway must be paved. Dated: June 16,1998. .
