HomeMy Public PortalAbout1998-03273 Member Johnson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.98-32 RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO FLAGSHIP TECHNOLOGIES, INC. WHEREAS, Flagship Technologies, Inc. (the "Applicant") is the owner of property legally described on Exhibit A attached hereto (the "Subject Property"); and WHEREAS, the Applicant has requested permission to construct an industrial facility containing approximately 50,000 square feet on the Subject Property; and WHEREAS, the Subject Property has been platted and rezoned to Urban Commercial/Industrial; and WHEREAS, the Applicant's proposed use of the Subject Property is allowed by conditional use permit in the Urban Commercial/Industrial zoning district; and WHEREAS, this matter was reviewed by the planning commission at its meeting of April 14, 1998, and by the city council at its meeting of May 19, 1998; and WHEREAS, following said reviews, it has been determined by the city council that the proposed use of the Subject Property by the Applicant will not adversely affect the development of adjacent properties for purposes for which they are zoned. NOW, 'I ILIEREFORE, BE IT RESOLVED By the city council of Medina, Minnesota, that a conditional use permit is hereby granted to the Applicant for the stated purpose, subject to the following terms and conditions: 1. The Applicant must comply with all requirements of the city engineer as outlined in his letter of May 14, 1998, to the city zoning administrator; 2. There shall be no exterior storage on the Subject Property; RHB145105 ME230-276 98-32 06-16-98 74 3. All signs on the Subject Property must meet city code requirements; 4. Any exterior trash containers on the Subject Property must be enclosed on all sides with the same type of construction material as the principle building (i.e. concrete) and located on the west side of the building; 5. All roof -top mechanical equipment must be screened with pre -finished metal or wood approved by city staff in order to mitigate the visual and sound impact of the equipment on the surrounding residential properties; 6. The Applicant must screen the Subject Property from the property zoned Rural Residential to the north. In order to accomplish the screening, the Applicant must plant a double row of 7 foot Black Hill spruce with a maximum spacing of 12 feet apart beginning at Co. Rd. 116 and extending to the west side of the building; 7. All screening and landscaping must be maintained by the Applicant; 8. A minimum of 85 parking spaces must be constructed on the site; 9. All exterior lighting on the site must be shoe -box style with all sides enclosed at the bottom with the lens or light source not visible from any adjacent property or street right-of-way and the light must be downcast only; 10. If exterior lighting is proposed above the loading dock doors, it must be placed no higher than two feet above the top of the doors; 11. The Applicant must comply with the requirements of Hennepin County regarding the location and design of the driveway at its intersection with Co. Rd. 116; 12. The Applicant must comply with the requirements of the Elm Creek Watershed District regarding the drainage and ponding plan for the site; 13. All driveways, loading areas, and parking areas must be constructed to a 9 ton standard with the exception that the auto parking area at the north side of the building may be constructed to a 5 ton standard, subject to approval by the Hamel fire department; 14. The Applicant must comply with the requirements of the Hamel fire department regarding health and safety matters of the building and site plan; 15. The Applicant must install a fire hydrant near the intersection of the driveway with Co. Rd. 116; 16. The Applicant must install guardrails 42 inches in height along the top of all retaining walls; RHB145105 ME230-276 98-32 06-16-98 75 17. All retaining walls must be designed by a registered professional engineer; 18. The Applicant must provide a letter of credit to the city in an amount tb be determined by the city engineer for utilities and on -site improvements; 19. The Applicant must execute a development agreement concerning construction of utilities and on -site improvements in a form approved by the city attorney; 20. All buildings on the formerly residential portion of the property must be removed, including their foundations; 21. Any well on the site must be abandoned by a licensed well contractor and a record of that abandonment provided to the city; 22. The septic system on the formerly residential portion of the property must be abandoned in accordance with the MPCA and city standards and a record of said abandonment provided to the city; 23. There shall be no outside bells or loudspeakers on the site; 24. The Applicant shall employ proper and approved erosion controls on the site before any construction or site work begins; 25. All sewer and water lines and connections must be approved and inspected by the city engineer; 26. The Applicant must contact DNR Wildlife prior to planting buffer material around the NURP pond; 27. The Applicant must practice water conservation techniques throughout the building; 28. The Applicant must comply with the requirements of Hennepin County, the MPCA, and the city regarding hazardous waste on the site; 29. Storm water ponds on the site shall be designed for the 100 year event; 30. The Applicant shall grant to the city by separate instrument an easement 10 feet in width for trail purposes along Co. Rd 116 and shall grade said easement area; 31. The Applicant shall pay to the city an administrative fee in an amount sufficient to reimburse the city for the cost of reviewing this application.
