Member Johnson introduced the following resolution and moved its adoption
CITY OF MEDINA
RESOLUTION NO.98-33
RESOLUTION VACATING DRAINAGE EASEMENTS IN
LUTZ ELM CREEK ADDITION
WHEREAS, the city of Medina (the "City") currently has an easement for drainage purposes
60 feet in width centered on the rear lot lines of the properties legally described as Lots 1 through 8,
inclusive, Block 2, Lutz Elm Creek Addition, Hennepin County, Minnesota; and
WHEREAS, the City has received a request from some of the affected property owners
asking that the City's easement be reduced to 30 feet in width centered on the rear lot lines of the
above lots; and
WHEREAS, the city council authorized the city clerk- treasurer to cause notice of a hearing
regarding the vacation of 15.00 feet of said easements on each lot to be posted and published in the
official newspaper at least two weeks prior to the public hearing; and
WHEREAS, the notice of said public hearing was published on July 2, 1998, in the official
newspaper; and
WHEREAS, on this date, the city council held the public hearing on the vacation of the
described drainage easements, at which public hearing all interested parties were heard with respect to
said vacation, and the city council determined that the vacation of said easements to be in the public
interest.
NOW, 'I IIEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota as follows:
1. The city council hereby declares that the drainage easements legally described on
Exhibit A attached hereto are vacated.
2. The city clerk -treasurer is authorized and directed to prepare and present to Hennepin
county the notice that the city council has completed these vacation proceedings and

county the notice that the city council has completed these vacation proceedings and
request that the same be reflected in the county's records.

The motion for the adoption of the foregoing resolution was duly seconded by member Thies and upon
vote being taken thereon, the following voted in favor thereof
Ferris, Hamilton, Johnson, Thies, and Zietlow
and the following voted against same: None
Whereupon said resolution was declared duly passed and adopted.

EXHIBIT A
The legal descriptions of the vacated drainage easements are as follows:
The west 15.00 feet of the east 30.00 feet of the drainage easement on the
following lots:
Lots 1 through 4, inclusive, Block 2, Lutz Elm Creek Addition; and
The east 15.00 feet of the west 30.00 feet of the drainage easement on the
following lots:
Lots 5 through 8, inclusive, Block 2, Lutz Elm Creek Addition,
All in Hennepin County, Minnesota.
