HomeMy Public PortalAbout1998-03891 Member Johnson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 98-38 RESOLUTION GRANTING CONDITIONAL USE PERMIT TO DONALD KARINIEMI AND PHILIP KARINIEMI FOR AN OFFICE/WORKSHOP FACILITY AT 62 HAMEL ROAD WHEREAS, Donald Kariniemi and Philip Kariniemi (the "Applicants") have requested permission to construct an office and workshop facility on property located at 62 Hamel Road, which property is legally described as Lot 41 and the Southeasterly 38.00 feet of Lot 42, Auditor's Subdivision No. 241, Hennepin County, Minnesota (the "Subject Property"); and WHEREAS, the Medina zoning ordinance requires a conditional use permit for this use in the urban commercial zone; and WHEREAS, this matter was reviewed by the planning commission at its meetings on June 9, 1998; and WHEREAS, it has been determined that proposed facility will not impede the normal and orderly development of adjacent lands for purposes for which they are zoned. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicants for the stated purpose, subject to the following terms and conditions: 1. In an attempt to preserve the look of the "Uptown Hamel" area, the Applicants are requested to keep the fanade of the proposed building in character with the existing buildings in Hamel; 2. The building may not exceed 5,800 square feet in size or one story in height; 3. There shall be no exterior storage permitted on the site; 4. There shall be no exterior trash containers on the site; 5. The exterior of the building must be painted concrete block; RHB-147186 ME230-232 98-38 07-21-98 92 6. All signs on the property must meet city code requirements; 7. All landscaping must be installed in accordance with the approved site plan; 8. All landscaping must be maintained and replaced if it dies; 9. All mechanical equipment must be screened from view from other properties and rights -of -way; 10. The driveway and parking area must be constructed to city standards and requirements, including 9 ton capacity, a 10 foot turning radius for the parking lot and a minimum of ten (10) parking spaces; 11. The number of employees may not exceed ten; 12. Exterior lighting must be designed and installed so that the globe is recessed and enclosed on all sides except the bottom and no light is cast directly on any other property or on any right-of-way; 13. Site drainage must be according to the approved site plan; 14. There shall be no outside loudspeakers or telephone bells on the site; 15. The Applicants must execute a development agreement and provide a letter of credit to the city in the amount to be determined by the city engineer to insure completion of site improvements; 16. The plans for the building, including the sprinkler system, must be approved by the fire department; 17. The building and parking lot must be constructed according to the approval site plan and the setback variances which are hereby granted; 18. An administrative conditional use permit is required for any part of the building to be leased; and 19. The Applicants must pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this application. NOW, '1'HJREFORE, BE IT FURTHER RESOLVED by the City Council of the City of Medina, Minnesota that the following setback variances be granted to the Applicants: a. Reduce two side yard setbacks for the building from 30 feet to 10 feet; and b. Reduce the front yard setback for the building from 30 feet to 0 feet; RHB-147186 ME230-232 98-38 07-21-98 93 , subject to the conditions that the canopy cannot extend over the lot line and that there is a through street on the west side (Eugenie Drive) which can be used for access. The reason for granting the above variances is to match the setbacks of other buildings in the Hamel area. Dated: July 21,1998.
