The Georgia Environmental Protection Division administers the rules. However, any given property owner should contact this office prior to intiating work since the determination as to whether authorization is required is made on a case -by -case basis. Mr. Bostwick has been informed of this for future reference. EPD has determined that the proposed activity would be considered a minor land disturbance and therefore a variance will not be required. Please note the following conditions: 1). A house constructed with typical footing -pier construction and/or poured concrete pad within the 25 foot buffer would be considered a major land disturbance and would require that a variance to encroach be obtained from the EPD Director. 2). Using driven wood or concrete pilings and leaving the buffer otherwise undisturbed would be considered a minor land disturbance and a variance would not be required. 3). A Notice of Intent for coverage under the State's General Permit GAR 100003 for the discharge of stormwater from a construction activity must be submitted to the local EPD district office at least fourteen (14) days prior to the start of construction activity if the total estimated land disturbance exceed;; one (1) acre. 4). Best management practices (i.e.; silt fencing and/or other erosion control measures) must be implemented upon the start of the project and maintained for the project's duration in order to minimize impacts on the buffer and the adjoining marsh. 5). A pile driver, if used, should be maintained outside of the buffer as much as feasible. 6). There shall be no grading in the buffer. 7). Any garters installed should drain outside of the buffer. 8).
