RESOLUTION AMENDING RULE NUMSERED XI OF THE PERSONNEL RULES ANA REGLiLATIONS ADOPTED PL'RSUANT TO CITY ` ORDINANCE NUMBERED 671 OF THE CLTY OF LYNWOOD GOVERNING AND REGULATING "ATTEIdDAIdCE AND LEAVES." RESOLVED, that the City Council of the City of Lynwood does. �" '"" h'ereb'y' adopt' the `following amendment to Rule numbered XI of the Personnel Rules and Regulations. Section 1. Rule numbered XI, Section 1, is hereby amended to read as follows: " RULE XI A'I'TENDANCE AND LEAVES " Annual cacation leave The purpose of annual vacation leave is to enabie each eligib7.e employee'annually to return to his work mentally refreshed. All employ?es in the classlfied service shall be entitled to annual vacation leave with pay. Employees not eligible fon vacation leave with pay are: -" `-""` �" -' � � - "Employees still their_ original probationary ~` period in the service of the city; however, vacation credits for the time sha.11 be granted to each such employee who later received a permanent appointment. _ "Employees who work on an in*ermittent or seasonal basis, and all hourly employees. "A11 eligible polioe and fire department employees shall earn vacation credits a.t the rate of 15 calendar^ days per year, All other eligible employees including the City Manager, City Clerk, and City Treasurer shall earn vacation credits at the rate of 14 calendar days (10 work days) per year. Employees having,a continuous 10-year service record will be allowed a vacation credit of 21 calendar days (15 work days) per year. Employees.having a continuous 15-year service record will be allowed a vacation credit of 2g calendar days (20 work days) per.year. -1- • � . . .� ... "Each eligible employee shall be required to have served the equivalent.of one year of continuous service in the city in order to be elig�ble for his full annual vacat��n leave; provided, however, that after six months of continuous service, he may be permitted to take vacation leave not to exceed seven calendar days. In no event, however, will paid vacation be granted in excess of earned vacation _ .. - credits... ,,._ ._� "The times during a calendar year at which an employee may take his_,vacation shall be det,Armined by th? department head with due regard to the wishes of the employees and particu�ar regard for the needs of the service. Subject to the provisions.of the next paragraph, any employee eligibl° f'or aacati�n credit may, not later than the f�r•st day of Oc'tober of any calendar year, make a request of , his department head and the City Manag°r jointly, which request must be in wri't�ng a.nd in duplicate, ona copy of which shail be'filed in the Office of *h2 City Manager and the other copy of which shall be ---- --filed—with--the=departmenz`head,:'for permi'ssion to�de£er taking not � V � to exceed one week o£ the vacation time ro which he is entitled during the year the requ2st is made and i"iled, t,o the following calendar year. The department head and the City Manager, acting jointly, or in their absence, or in case of their inabil_1�y to aat, for any reason, the acting head o*' said.employee's department, or the next in authority and the Administrative Assistant, ac`ing jo�ntly, shall, within five days after the £iling of the requesY,, gi��° the employee written notice of tneir decision, either to grant or to deny the request. If the request.is granted the.employee shall be entitled to said one week',s vacation during the calendar year immediately £ollowing the caiendar year the employee's -request was filed, in addition to any vacation time to which said emp.loyee is entitled during said calendar year to which the one week has been d.°£erred. ' Sick leave shall not•be considered as a privilege which an employee may use at his discretion, but shall be allowed only in case of necessity and actual sickness or disability, Unused sick leave shall be accumulated at the rate of twel�%e days a year for an unlimited number of working days. "At the time of regular service retirement, (excluding dis- ability retirement, resignation, or separation f°or cause} the retiring employee� wi11 be compensated f�� one-hal£ of his unused sick leave which has been accrued to the effecti�e d3t.e oi retlrement � The me*_hod of compensaticn shall be on a straight tirne pay basis at the rate of pay in e£fect at time of regular rerir°ment. "A classified employee is eligible to receive accru°d sick leave benefits after one month of service with the city. Each shift taken as sick leave equals 1.85 work days. "In order tc receive �ompensa,t;�n while absent on sick leave the employee shall notify his immediate superior prior to, or within four hours af�er the tim� set for beginnin� nis daily duties, or as may�be specified by.the head of h�s departm°nt. When absence is for more than one work day, the,employee sha1.J t'ile a physician's certificate or a personai affidavi't with the Per•sonnei Officer stating the cause of his absence. °The City Manager, City Clerk, and City Treasurer,shall have_ _ �the same sick leave privileges as classified employees. " Military Leave Military leave,shall be granted in accord- ance with the provisions of State law. A11 employees entitled to military leave shall give the City Manager an opportunity within the limits o£ military regulations to determine wh.en such leave sha11 be taken. " Leave of Ab�ence The City Council may grant a permanent employee.leave o£ absence without pay i'or a period not to exceed 60 calendar days, Before completion of the !°irst 60-day leave of absence and where extenuatin� c�rcumstances, are shown, the,City Council may . grant a,s'econd 60-day leave. Id� sueh leave shall be granted except upon written,request of *he employee. A copy of the Council's action shall be furnished the employee and the Personnel Officer. Upon. expiration of` �^egularly approved leave, the employee shall be rein- stated in tne pesition held at the time leave was granted. Failure on the-part of an employee on leave to report promptly at the expiration shall be cause for discharge. „ - Y - " Hours of Work Ail offices of :he city, except those, for which special regulations are required, shall be kept open for business on all days of the year except Saturdays, Sundays, and holi.days, con- tinuously frcm 8 a.m� until 5 p.m. "Except in,case of emergency as determined by the Police Chief, uniformed members of the police department shall work f'ive eight-hour shifts per week as.schedu.led by the Police Chief, During ""` an`y"`t"ime" `of'eme`rgency they shall wcrk as d:rected by the Chief. "Oeticers and members of the Fire Department shall work in alternate twenty-f'our (24) hour shifts, the shi.fts being so arranged by the Fire Chief as to provide f^r no more than sixty-five (65) on-duty hours per week beginning January 1, 1968. Officer may, within hi.s discretion, make written request to the head o2' any or all departments that they keep daily attendance � records of employees in the department. When said requests are filed with the d2partment heads they shall furthwith comply with said request and continue to do so until notified, in writing, by the Personnel Officer that said reaords will no longer be required.
