Member Johnson introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO.98-46
RESOLUTION VACATING DRAINAGE AND UTILITY
EASEMENT - KELLY'S WRECKER SERVICE ADDITION
WHEREAS, the city council of the city of Medina, Minnesota authorized the city clerk -
treasurer to cause notice of a hearing regarding the vacation of a 5.00 foot easement for drainage
and utility purposes located on Lot 1, Block 2, Medina Industrial Park Second Addition, Hennepin
County, Minnesota to be published in the official newspaper and to be posted in accordance with
law property at least two weeks prior to the public hearing; and
WHEREAS, the notice of said public hearing was published on August 6, 1998, in the
official newspaper; and
WHEREAS, on this date, the city council held the public hearing on the vacation of the
described drainage utility and street easement, at which public hearing all interested parties were
heard with respect to said vacation, and the city council determined that the vacation of said
easement to be in the public interest.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota as follows:
1. The city council hereby declares that the drainage and utility easement legally
described on Exhibit A attached hereto is vacated.
2. The city clerk -treasurer is authorized and directed to prepare and present to
Hennepin county the notice that the city council has completed these vacation
proceedings and request that the same be reflected in the county's records.

The motion for the adoption of the foregoing resolution was duly seconded by member Thies upon
vote being taken thereon, the following voted in favor thereof: Ferris, Hamilton, Johnson, Thies,
and Zietlow and the following voted against same: None
Whereupon said resolution was declared duly passed and adopted.

EXHIBIT A
The legal description of the vacated drainage and utility easement on Lot 1, Block 2, Medina
Industrial Park Second Addition, Hennepin County, Minnesota is are as follows:
That part of an existing drainage and utility easement, created by document
No. 6261680, which is described as follows:
The East 5 feet of Lot , Block 2, Medina Industrial 2nd Addition, according
to the plat thereof record in Hennepin County, Minnesota; excepting that
part of said East 5 feet contained within the South 10 feet of said Lotl.
