, WHEREAS on May 7, 1969, the City Council enacted'Resolution

its duly constituted governing body, to talce any and all legal action
and proceedings that he may.�deem appropriate to recover for the City
� of Lynwood'such.monetary damages and other compensation to which '
f�, it may be entitled under applicable law, federal or state, by reason' ��
'o£'legdl'injuries in the,course of purchasing asphaltic �
� petroleum products,�and � " �
: WHEREAS, the Attorney General's offer to join City of.
Lynwood-in'a Class�action and the,State, as plaintiff wherein the
State, as Plaintiff, will sue on behalf o£ itself arid the political
' subdivisions within California, was made contingent upon the City of

Lynwood's purchases exceeding 3500 tons'over the period of January
' 1, 1957, to December 31, 19E7, and� �
. WHEREAS, before the enactment of said Resolution No. 69-23

. � period of January l, 1957 ,.to December_ 31, 1967, and ,
WHEREAS, the records"of.the Ci•ty of Lynwood have been •
�' . re-examined and it has now been_determined that said�purchases'were�.
_ less than�3500 tons.over the period of January l, 1957, to December

BE IT P�ESOLVED that the Attorney General be notified.that�
� the requirements of the.Attorney General cannot be•met and that tlie '
, � Attorney General be requested to take no action to recover for the
