Member Johnson introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO. 98-50
RESOLUTION VACATING DRAINAGE AND UTILITY
EASEMENT
WHEREAS, Thomas D. Sawvel (the "Applicant") is the owner of property legally
described as Lots 2 and 3, Block 1, Hickory Haven, Hennepin County, Minnesota (the "Property");
and
WHEREAS, the Applicant has proposed to combine the two lots constituting the Property
into a single lot and to vacate the drainage and utility easements centered on the common lot line;
and
WHEREAS, the city council of the city of Medina, Minnesota, (the "City") has caused a
notice of public hearing regarding the vacation of said easements, which easements are legally
described in Exhibit A attached hereto, to be published in the official newspaper and to be posted
according to law at least two weeks prior to the public hearing; and
WHEREAS, on September 1, 1998, the city council held a public hearing on the vacation
of the described utility and drainage easements, at which public hearing all interested parties were
given an opportunity to be heard; and
WHEREAS, following said public hearing, the city council determined that the vacation of
the easements is in the public interest.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota, as follows:
1. The city council hereby declares that the drainage and utility easements legally described on
Exhibit A attached hereto are vacated.

2. The city clerk -treasurer is authorized and directed to prepare and present to Hennepin
County a notice that the city council has completed these vacation proceedings and to
request that the same be reflected in the county's records.
3. The city clerk -treasurer and other staff members are hereby authorized and directed to take
any additional steps necessary or convenience to effect the vacation of said easements.

The motion for the adoption of the foregoing resolution was duly seconded by member Zietlow
and upon vote being taken thereon, the following voted in favor thereof:
Ferris, Hamilton, Johnson, and Zietlow
and the following voted against same: None Absent: Thies
Whereupon said resolution was declared duly passed and adopted.

EXHIBIT A
LEGAL DESCRIPTION FOR VACATED EASEMENT
8 foot drainage and utility easements along each side of the shared boundaries between lot 2 and lot
3, Block 1, Hickory Haven, Section 23, Township 118, Range 23, Hennepin County, Minnesota
except an 8 foot portion of the drainage and utility easement along the western border of lots 2 and
3, Block 1, Hickory Haven, Section 23, Township 118, Range 23, Hennepin County, Minnesota on
property owned by Thomas D. Sawvel.
