RESOLUTION NO„ 69-68
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD AMENDING RESOLUTION N0. 2843, PERSONNEL
RULES AND REGULATIONS, ADOPTED PURSUANT TO CITY
ORDINANCE N0. 671 OF THE CITY OF LYNWO.OD.
WHEREAS, the City of Lynwood did enter into negotiations
with various employee associations of the city. during the 1g68-69
fiscal year, in accordance with Section 3500 et seq. of the
Government Code, and
WHEREAS, by mutual agreement of all parties conce�ned,
certain amendments to Resol'ution No. 2843 were recommerided;
NOW, THEREFORE, BE IT RESOLVED that the City Council:.:of'.w
the City of Lynwood does adopt the following amendments to the
Personnel Rules and Regulations. ,
" Section l . Rule XI, Section l, paragraph'4,. is amended to
read as follow's:
"Al1 eligible uniformed Police Department employees shall
earn vacation credits at the rate.of fifteen �(15)��calendar days pe"r
year (eleven woxk days) for service'between the first through the
severith'year. Twenty.-one (21). calendar days (fifteen work days)
off will be allowed £rom the eighth year. through the fourteenth year;
and twenty-eight (28) calendar days (twenty work days) shall be
allowed f�om the fifteenth year of service on.
"All eligible Fire Department employees shall earn vacation
credits at the rate of six (6) 24-hour fire shifts. off after the first t
year of service through the seventh year of servic'e; eight 24-hour '
fire shifts will be allowed from the eighth year through'the'fourteenth
year of service; and nine (9) 24-hour fire shifts shall be'allowed
from the fifteenth year of service on.
"All other eligible employees, including the CitS� Manager,
City Clerk, and City Treasurer, shall earn vacation credits at the
rate of ten (10) worlc days for employee's after one year of service
through the seventh year of service; fifteen (15) work days will be

allowed from the eighth year through the fourteenth year o�.service;
and twenty work days shall be allowed from the fifteenth year of
service ori."
Section 2 .. Rule XI, Section 1; paragraph 5, is amended to
read as follows:
"Each eligible employee shall be required to have served
the equivalent of one year of service in the city in order to be
eligible for his fulT annual vacation leave; provided, however, that
after six months of service he ma;� be permitted to take vacation
leave not to exceed s,everi calendar days. In no event, however, will
paid vacation be granted in excess of earned vacatiori credits."
S'e'ction 3 • Rule XI, Section 2, "Sick Leave" shall be
amended as follows:
"' Sick Leave Sick leave with pay shall be granted by the
City Manager at the rate of one work day for each calendar' month of
service. Sick leave shall not'.be considered as a privilege which
an employee may use at his discret=ion, but shall_be allowed_only in
case o£ necessity and actual sickness or disability. Unused sick
leave shall be accumulated at .the rate of twelve days a year for an
unlimited number of working days.
"In order. to receive compensation while abserit on sick leave,
the'employee shall noti£y his immediate ,superior'prior to.,' or within
fou� hours after the time set for beginning his daily�duties, or as
may be specified by the head of his depa�tment. When absence is
for more than one worlc day, the employee .shall file a physician's
certificate or a personal affidavit with the Personnel Officer
stating the cause of his absence.
"Erriployees'to Whom Sick L'eave SYiall' Apply: Sick leave
privileges shall apply to all classified employees,. the City Manager.,
the City Clerk, and the City Treasurer.
"At the time of the regular service retirerrient of a
classified employee (excluding disability retirement, resignation,

or separation for cause), the retiring classified employee will be
compensated for one-half of his unused sick leave which has been
accrued to the effective date of retirement. The method of compensa-
tion shall be on a straight time pay basis at the rate of pay in
effect at time of regular retiremerit.
"At the expiration of any regular term of office for vahich
the City Clerk or the City Treasurer have beeri elected beginning with'
the expiration of the second term of office', provided said terms of
office have been served consecutively and provided they, or either
of. them have either not sought re-election, or have not been re-elected
to the same office, the City Clerk or tl City Treasurer, as the case
may be, shall be compensated for one-half of his unused sicic leave
which has beeri accrued to the expiration of said term of office.
Except as herein provided, the City Clerk and the City. Treasurer
shall be compensated for one-half of his unused sick leave at the
time of regular service retirement in the same manner as a classified
employee. �
"The City Manager shall, at the time of his separation from
the office of City Manager, whatever the cause, or by whatever means
the separation takes place, be compensated for one-half of his unused
sick leave which has been accrued to the effective date of his
separation, except that i£ the City Manager at the date of his separation
from this office is already an employee of the city- cover,ed by the
classified service in a different capacity, and he continues as a
classified employee of the city, he shall not be so compensated at
the date of his separation as City Manager and his right to be so
compensated shall be deferred to the time of his regular service
retirement.
"In no event will sick leave with pay be granted in excess
to that tiatiich is accrued.
"L�7he'ne�ce;c:.ari�'empioyee: is disabled by injury or illness
arising out of and in the course of his duties, as determined by the

. State Compensation Insurance Fund or the Accident Commission,
such time off is not deductible from accumulated si'ck leave for a
, period of not to exceed ninety (90) days.
� °Sick leave for members of the Fire Department who work on
-, a shift or �platoon system shall be co,mputed in the follocaing manner:
"Sick leave shall be converted to shifts and granted
_ at the rate o£ six-shifts per year, All sick leave:earned
- . prior to January l, 1g70,. shall be converted to shifts
using the factor of 1..90 days per shift. Any fraction o£
a shift exceeding one-half shift sha11 be credited as a
- whole shift; any fraction.less than one-hal£ shift shall
' be deleted." , _
Section 4 . Rule XI, Section 5, paragraph 2, is hereby
' amended to read as follows:
- "Except in case of. emergency, as determined by the Chief of
Police, uniformed personnel of .the' Police Depa�tment shall work an
_, e�ght.(8) hour wor.k'day, including lunch, plus a fifteen (15)
minute'briefing period. In addition, until an employee has worked
,, thirty, mimites beyond his assigned work shift, he shall not receive
overtime credit. During any time.of emergency, uniformed personnel'
, shall work as directed by the Chief of Police,"
� Section 5 . Ru1e XI, Section 7, is hereby amended to xead
' as follows: .
"Holidays: Municipal offices, e'xcept Police and Fi�e�
• Departments, shall be closed on the £ollowing'legal holidays; New '
Year's Day, Lincoln's Birthday, Washington's Birthday,_Memorial Day,
Independerice Day, Admission Day, Labor Day, Columbus Day,.Armistice .
Day, Thanksgiving, Christmas, and every other. day as follows:

throughout'the State;
,. °2. Every day.which has been declared to be a holi-
day by'an Act of Con�ress of the United.States, by•an Act ,

of the Legislature of the State of California, and by. the
proelamation of the Governor of the State of Cali�ornia
wherein he has power to do so.
"3. Whe'n a holiday falls on Sunday, the following
Monday shall be observed, and when a holiday falls on
,_ _.-._�.._.__ Saturday, employees will be g-ranted a Friday off - -�.
immediately preceding the holiday..
"The holiday schedule applies to all employees except uniformed
Police and Fire employees who are allowed the fo11'owing holiday credits;
"1, All uniformed Police Personnel sha11 be permitted
eleven (11) calendar days off in lieu of holi,days.
� "2: Uniformed employees of the Fire Dep'artment shall
accrue holiday credit at the rate of five (5) shifts per
yea�." ,
Section 6 . Rule'7�III, Section 5, is amended to read as
follows:
"Reinstatement: A classified service 'employee who �esigns
in good standing may apply within one (1) year after resignation for
�einstatement to the current eligible list for the same classifica-
tion from which his original appointment was made. If reinstatement
is recommended by. the appointing authority, the Boa�d may order the
name of the employee restored to,the app�opriate eligible list.
"In the event of rehire, seniority will'be established
from the,,,�latest hiring date,"
