HomeMy Public PortalAbout1998-055137 Member Thies introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.98-55 RESOLUTION GRANTING FRONT YARD SETBACK VARIANCE TO JOSEPH MALCHOW AND DARCIE MALCHOW WHEREAS, Joseph Malchow and Darcie Malchow (the "Applicants") are the fee owners of property located at 3087 Lakeshore Avenue (the "Subject Property"); and WHEREAS, the Applicants wish to construct on the Subject Property a detached garage which will be located 15 feet from the right-of-way line of Lakeshore Avenue; and WHEREAS, the Subject Property is zoned for single family residential, and the zoning ordinance requires a minimum front yard setback of 30 feet for structures within the residential district; and WHEREAS, the zoning ordinance also requires that a variance be granted in order to reduce any required front yard setback; and WHEREAS, this matter was reviewed by the planning commission at its meeting on August 11, 1998 and by the city council at its meeting on September 1, 1998; and WHEREAS, it has been determined that the variance requested by the Applicants is justified based on the hardships present on the Subject Property. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that a variance be granted to the Applicants to reduce the minimum front yard setback on the Subject Property from 30 feet to 15 feet to construct a detached garage, subject to the following terms and conditions: RHB-149471 ME230-8 98-55 09-14-98 138 1. The detached garage may not exceed 34 feet long by 22 feet wide and must be generally consistent with the plans and specifications thereof submitted to the City by the Applicants; 2. The garage must be constructed within one year of the date of this resolution or the approval hereby granted shall be null and void; and 3. The Applicants must pay to the city an administrative fee in the amount equal to the cost to the city for reviewing this application. NOW THEREFORE BE IT FURTHER RESOLVED by the city council of the city of Medina, Minnesota that the variance hereby granted is justified by specific hardships present on the lot, including the presence of mature trees, the size of the parcel, the topography of the lot, and that the variance is consistent with the pattern of development evident on other lots in the neighborhood.
