THIS ADDENDUM is made and entered into this _22nd ______ day of _February___ 2011, by and between the City of Richmond, Indiana, a municipal corporation acting through its Board of
Sanitary Commissioners, (hereinafter referred to as the “City“), and Heritage Environmental Services, LLC, (hereinafter referred to as the “Contractor”).
WHEREAS, City and Contractor entered into Contract Number 75-2009 on May 26, 2009 for the removal and disposal of certain household hazardous waste; and
WHEREAS, such contract contains an option for the City to renew such
Agreement for such services for two additional years upon the same terms stated in Contract Number 75-2009; and
WHEREAS, the City desires to renew and extend such contract for 2011 pursuant to such option.
NOW, THEREFORE, in consideration of the mutual promises and covenants herein contained, including the above stated recitals, City and Contractor hereby agree as follows:
SECTION IV. TERM OF AGREEMENT of Contract 75-2009 will be revised as follows:
The term of this Agreement shall continue, without interruption, until December 31, 2011.

2. City and Contractor expressly agree that all other terms,
conditions and covenants contained in Contract Number 75-2009, shall be applicable to the work performed pursuant to this Addendum, unless such term, condition or covenant conflicts
with this Addendum, in which case this Addendum shall be controlling.
IN WITNESS WHEREOF, the parties execute this Agreement effective the day and year first above written, although signatures may be affixed at different times.
