RESOLUTION N0. 68-40
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD SETTING FORTH THE SALARIES BY CLASSIFI-
CATION OF ITS OFFICERS AND EMPLOYEES, AND OTHER
BENEFITS
BE IT RESOLVED by the City Council of the Gity of Lynwood
as follows:
Section 1 . That Resolution No. 62-43 of the City of
Lynwood adopted the 3rd day of July, 1962, prescribes the time and
method of paying salaries and wages of the officers and employees
of said city, as required by Section 37206 of the Government Code �
of the State of California. J
Section 2 . That the bi-weekly salaries and wages for
officers and employees for the various classifications falling in the
basic five-step schedule, included herein, effective at the beginning
of the first regular pay period following the adoption of this reso-
lution, follows:

Additional.compensation, over and above the basic five-
step salary schedule, shall be paid to officers and employees during
such times as they are assigned to the following duties.
Police officers assigned full
time to motorcycles $ 40.00 per mo.
Police employees assigned to photo-

graphy section as an additional duty $ 20.00 per mo.
Utility maintenance men assigned as
full-time sweeper operators, $ 20,00 per mo.
' as half-time operators $ 10.00 per mo.
Water Department employees $ 7.00 each
standby shift
Street Department employees $ 3•50 each
standby shift
A standby shift for all working days is
hereby fixed as a duty period extending
from � p.m. to 8 a.m. of the following
day. From 8 a.m. on Saturdays, Sundays,
and holidays to 8 a.m. of the following
day shall be considered as two (2) standby
shi£ts. A11 employees during the period
they are scheduled for such duty shall
perform such services as may be designated
by the Water Supt., Street Supt., or City
Manager, and shall be available al1 times
during the duty shift for emergency work.
No overtime credit will be allowed employees
working standby shifts.

For those employees under the basic five-step salary plan,
the beginning salary shall be at Step "A," or the lowest salary shown
for the'position. However, where circumstances so warrant, appoint-
ment may be made at other than the first step, or after appointment,
an intermediate step may be skipped when recommended by the City
Manager. Increases throughout the remainder of the steps shall be given
upo'n recommendation of the department head and approval of the City
Manager, until the highest or top step is reached. Step raises shall
generally be at six month intervals from the effective date of employ-
ment, commencing on the next succeeding pay period date from the
actual anniversary date.
That overtime as defined by this resolution shall be compensated
- as follows:
A. Definitions:
1. Overtime is defined as follows:
(a) In the police and fire departments overtime,
except as defined in Paragraphs 4 and 5 hereof, shall consist of the
following: Unfinished work at the end of a regular work day shift which
in the discretion of the person in charge of the watch but subject to
subparagraph (c) hereof should be completed by the personnel of the,
watch before they leave the watch; provided, however, such overtime shall
not be deemed to be compensable either by straight time pay as defined

in this resolution.or by compensating time for overtime until the over-
time extends one-half hour beyong the regular work day shift.
(b) In a11 other departments of the city overtime,
except as defined in Paragraphs 4 and 5 hereof, shall consist of time
worked beyond the first half hour following the end of a regular work
day shift at the direction of.the department head, or the foreman of
a shift, if any, acting within his discretion but, subject to paragraph
(c) hereof, or in the absence of a department head or foreman pursuant
to written department regulations or programs approved by the City
Manager in writing, which define wherein overtime shall be worlced.
(c) Nothing contained in (a) or (b) hereof shall
authorize or empower the person in charge of the watch, the department
head or the foreman to authorize overtime, except when not to authorize
the overtime would be to the detriment of the normal functioning of
the department concerned.
2. Straight time pay for overtime pay purposes is defined
as follows:
(a) The hourly rate of each approved classification
as determined by dividing the bi-weekly rate by 80 hours.
(b) Under no circumstances shall any classified
employee of the city while employed overtime, as "overtime is herein
defined, be deemed an hourly, per diem or seasonable employee and
except as hereina£ter set forth each,such employee is bound to render
services to the city without regard to the number of hours worked and I

whether in this resolution straight time is not granted the overtime �
services of said employee are then included within the regular salary l i i
he is entitled to receive.

3• Compensating time for overtime is defined as follows:
(a) That°portion of time that an employee is author-
ized by this resolution to take off, subject to the direction of his
department head as to when and over what periods he may do so, to
' compensate him for overtime worked except as provided by paragraph (b)
hereof.
(b) Except as hereinafter set forth the employee
is bound to render services without regard to the number of hours worked
and wherever in this resolution compensating time for overtime is not
granted, it is then included within the period for.which the employee
is being paid his regular salary and is time which he may be required
to perform services.
4. Emergency overtime pay on a shift basis is defined
as follows:
(a) Emergency'overtime pay on a shift time,basis in the
police and fire departments when the line operating force is reduced
by lay-off, resignation, or retirement.
5, Emergency call back overtime is defined as follows:
(a) It is that overtime incurred by dir.ection of the
department head or his authorized agent, wherein city personnel are
ordered and required by their superiors to work additional hours or
shifts for the welfare of the public and the city.
6. How overtime as defined in paragraphs A-1, through
A-3• differs from overtime as defined in A-�. and A-5.
(a) The overtime provided in paragraph A-4. through
A-5. is not limited to, although it may include, unfinished work at
the end of a regular work day shift and the overtime shall begin from
the time the employee reaches his place of employment, or, if he is

already at work, at the termination o£ his regular work day shift, and
not one-half hour thereafter.
' B. Straight Time for Overtime to Include All Classi£ied
Employees.
1. That except pursuant to employee's option, as herein-
after set forth, all employees of the city sha11 be eligible to
receive straight time pay, as defined in this resolution, for all over-
time as defined in this resolution, effective the first pay period
following adoption of this resolution. This shall include, but is not
limited to, what has been referred to in previous resolutions a� "off
duty court time" and "emergency call back time."
Option and Withholding. The City Treasurer is directed to
withhold all overtime pay due and payable to each classified employee
during each six months period following the effective date of these.
provisions unless an employee during such period files with the City
Treasurer, through the department head, a statement in writing that
he forever waives his option to take compensating time off for over-
time in lieu of straight time pay earned during said six months period.
Upon the filing of such a waiver the City Treasurer shall include in
the said employee's payroll cneck compensation for such overtime at
the next succeeding regular bi-weekly payroll,
At any time during said six months period said employee
may, at his option, elect to take compensating time off for all or
part of his overtime in lieu of straight time pay, provided however,
that this option is conditional upon the head of the department,
acting within his reasonable discretion as hereinafter defined,
' having sufficient personnel to enable him to grant the time off. i

Such election to exercise said option must be contained in a written
statement by the employee filed with the City Treasurer via the depart- '
ment head, that he elects to take a designated number of hour or
fractions thereof as compensating time for overtime in lieu of straight
time pay and that upon receiving said compensating time o£f he forever
waives and discharges city from payment £or said services so taken.
An employee sha11 not be permitted to accumulate overtime which is
eligible for compensating time for overtime in excess of 40 hours and
all hours exceeding forty in number remaining on the books of the city
to the credit of the employee at the end of any six months period sha11
be compensated for by payment therefor in the next succe,eding regular
bi-weekly payroll check. I£ the said written election to take compensat-
ing time off for overtime in lieu of straight time pay is not on file
in the City Treasurer's office before the expiration of said six months
period, the employee shall be deemed to have waived his right to take
compensating time off for said overtime and he shall be paid straight i
time therefor as hereinabove set forth. I
tJothing herein contained shall prevent the said employee
from requesting fu11 payment for all overtime on a straight time basis
on the books of the city to the credit of said employee, irrespective
of previous notices of election to take compensating time for overtime
in lieu of straight time payment. A11 such requests shall be made in i
writing to the City Treasurer via the department head and such overtime
shall be compensated for in the next succeeding regular bi-weekly
salary check for said employee, provided however, that said employee I
shall have no right to straight time payment or other payment for over-
time accumulated prior to the e£fective date of this resolution.

Upon payment for overtime for whatever reason, the City,Treasur-
er shall forthwith notify the City Manager and the department head the
number of hours that have been compensated for by payment and the
department head shall upon receipt of said i�otice, forthwith remove the
accumulated overtime thus compensated from the records of the department.
C. Resolution Not Retroactive. Nothing contained in this
resolution shall apply to any overtime whatever accumulated on the books
of the city to the credit of any classified employee before the
effective date of these provisions.
D. Awarding of Compensating Time for Overtime Discretionary.
Whether or not compensatory time off shall be given to the employee and
at what times and over what periods shall be within the discretion of.
the department head.
E. Eligibility for Overtime. The overtime provisions of this
resolution shall include classified employees below the rank of Lieutenant,
Fire Captain and Superintendent. Those employees, towit: police officers
assigned full-time to motorcycles, police officers assigned to photo-
graphic section as an additional duty, utility maintenance man assigned
as full-time sweeper operators, and water and street department employees
who receive by virtue of the provisions of this resolution compensation,
over and above the basic five-step salary schedule during the time they
are assigned to duties specified in this resolution, except employees
of the street and water departments on "standby shift" shall be entitled
to the same benefits of and shall be subject to the same limitations
and conditions of this resolution as other classified city employees.
F. Reasonable Discretion Defined. As used in this resolution
"reasonable discretion" is defined as the exercise of that kind of

judgment as will accord to.each employee within a given categcry, fair
and equal treatment, having due regard for the public health, safety
and general welfare.
Prior to disability retirement, service retirement, or death
of the employee, compensatory time off or, in the case of death,
straight time pay, for all accumulated overtime accrued subsequent
to March 15, 1966, shall be granted. This provision does not apply
to voluntary termination or termination for cause.
Section 3 • That the compensation for officers and employees
in the various classifications not included in the basic five-step
salary schedule shall be as follows:

Section 4 , That the hourly compensation for part-time workers
not included in the classified service shall be as follows:

Section 5. Premium.Pay. To encourage employees in under-
taking outside study to the end that they may perform their duties in
a more efficient manner, a system of premium pay, over and above es-
tablished pay schedules, is hereby established.
Premium pay is allowab].e for completed courses of approved
sub,jeet at accredited schools, and is £ixed at $1.00 per month for each
semester hour of work satisfactorily completed by the employee with a
grade of C or better. Maximum pay is fixed at $40.00 per month.
A semester hour is defined as ene hour of classroom work per
week for one semester of 18 weeks, plus necessary outside study. All
courses of study must have prior approval by the department head and
City Manager in ordex to receive premium credit.
Accredited schools are herein defined as colleges, junior
colleges, or universities, or such other institutions as may be approved
by the City.Mana.�er,

Suitable written certification from the school showing �
satis£actory completion of each course shall be submitted to the
Personnel Of£icer for personnel records. Premium pay will commence
the first pay period after the first of the month following the
submission of the written certification.
The city will contribute 50% of the cost of tuition over
$10.00 where the cost of such tuition exceeds the sum of $10.00 per
semester course while the employee is accruing the $40.00 per month
maximum pay.
The provisions of this section do not apply to hourly
employees or employees undertaking an approved course between the
hours of 8 a.m. and 5 p.m., Mondays through Fridays.
Section 6. Employee's Insurance Coverage: The city will I �
contribute tl�e employee's share toward any health insurance, accident �
insurance, or li£e insurance policies which the City Council agrees '

to provide. If desired, the employee may obtain coverage for members �
I
of his family. Such premium shall be borne by the employee and pay- �
ment will be made by payroll deduction. I
Section 7. Car Allowance Compensation for use of employee- �
owned automobile for city business is established as follows: I

Section 9 . This resolution shall be effective at the beginning
