Member Zietlow introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO. 98-59
RESOLUTION GRANTING FRONT YARD
SETBACK VARIANCE TO JAMES EIDUM
WHEREAS, James Eidum (the "Applicant") is the fee owner of property located at 3175
Cedar Avenue (the "Subject Property"); and
WHEREAS, the Applicant wishes to construct on the Subject Property an attached garage
which will be located 23 feet from the front lot line (Fern Street side); and
WHEREAS, the Subject Property is zoned for single family residential, and the zoning
ordinance requires a minimum front yard setback of 30 feet for structures within the residential
district; and
WHEREAS, the zoning ordinance also requires that a variance be granted in order to
reduce any required front yard setback; and
WHEREAS, this matter was reviewed by the planning commission at its meeting on
September 9, 1998, and by the city council at its meeting on September 14, 1998; and
WHEREAS, it has been determined that the variance requested by the Applicant is
justified based on the hardships present on the Subject Property.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota, that a variance be granted to the Applicant to reduce the minimum front yard setback
towards Fern Street from 30 feet to 23 feet to construct an attached garage, subject to the following
terms and conditions:

1. The garage must be generally consistent with the plans and specifications thereof submitted
to the City by the Applicant except that the garage must be at least 30' wide (as viewed
from Fern Street) in order to prevent independent development of the lot to the west;
2. The garage must be constructed within one year of the date of this resolution or the approval
hereby granted shall be null and void; and
3. The Applicant must pay to the city an administrative fee in the amount equal to the cost to
the city for reviewing this application.
NOW THEREFORE BE IT FURTHER RESOLVED by the city council of the city of
Medina, Minnesota that the variance hereby granted is justified by specific hardships present on the
lot, including the location of the house on the lot, the fact it is a corner lot, the presence of mature
trees, the size and dimensions of the parcel, the topography of the lot, and that the variance is
consistent with the pattern of development evident on other lots in the neighborhood.

The motion for the adoption of the foregoing resolution was duly seconded by member Hamilton
upon vote being taken thereon, the following voted in favor thereof: Ferris, Hamilton, Thies, and
Zietlow
and the following voted against same: None Absent: Johnson
Whereupon said resolution was declared duly passed and adopted.
