HomeMy Public PortalAbout1995.11.29 Utility Easement Katherine Troutner 215550GRANT DEED GRANTING EASEMENT For and in consideration of ten dollars and other valuable consideration in hand received, KATHERINE H. TROUTNER, Grantor, of McCall, Idaho 83638, conveys, dedicates, and grants to the CITY OF McCALL, an Idaho municipal corporation, Grantee, an easement in perpetuity (referred to below as "Easement") in, across and under the following described property for use for construction, installation, repair, replacement, and removal (all referred to below as "work"), and operation, inspection, and maintenance (all referred to below as "operation") of underground utilities: See legal description, Exhibit A; and as depicted on drawing, Exhibit B together with the right to enter upon so much of the surface of the land within and adjacent to such Easement as is in Grantee's judgment necessary and appropriate for such work and operation; and Grantor covenants that Grantor is possessed of a fee simple estate in the land and has all authority necessary to grant this Easement, and that Grantor will construct no improvements on the land over the Easement, save and except fencing, without the prior written consent of the Grantee; and Grantee covenants that in each instance Grantee will after such work promptly restore the surface of the ground to a condition as near as practicable to that prior to the beginning of that work, will promptly repair or replace any improvement not constructed in violation of this Grant located on the ground which is destroyed or damaged during that work to the condition in which it existed prior to the beginning of that work, and will not during work prevent access to any home or business overnight; and Grantee will hold and save Grantor harmless from, indemnify Grantor against, and defend Grantor with counsel of Grantor's choosing regarding any losses, claims, actions or judgments for damages or injuries to persons or property arising out of or from or caused by any such work or operation; provided that Grantor shall not unreasonably object to use of the same counsel as that selected by Grantee or Grantee's insurers. Ms. Troutner has asked me to review your September 15, 1995 correspondence and the Grant Deed Granting Easement which was enclosed therewith. Ms. Troutner would be happy to execute the easement in favor of the City providing that certain changes are made to the language of the Grant Deed Granting Easement. In particular, I am requesting that the second full paragraph of the Easement be reworded to read as follows: Grantor covenants that Grantor is possessed of a fee simple estate in the land and has all authority necessary to grant this Easement, and that Grantor will construct no improvements on the land over the Easement, save and except fencing, without the prior written consent of the Grantee; and Grantee covenants that in each instance, Grantee will after such work promptly restore the surface of the ground to the condition in which it existed immediately prior to the beginning of that work, will promptly repair or replace any improvement located on the ground which is destroyed or damaged during that work to the condition in which it existed prior to the beginning of that work, and will not during work prevent access to any home or business overnight; and Grantee will hold and 4- save Grantor harmless from, indemnify Grantor against, and defend Grantor with counsel of Grantor's choosing regarding any losses, claims, actions or judgments for damages, injuries, or death to person or property or for liability of any kind arising out of or from or caused by any such work or operation.
