HomeMy Public PortalAbout1998-062151 _ Member Johnson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.98-62 RESOLUTION CALLING FOR HEARING ON ASSESSMENT FOR MOHAWK DRIVE IMPROVEMENT PROJECT WHEREAS, the city council has directed the improvement of Mohawk Drive from T.H. 55 to the northern border of the city be made and a portion of the cost thereof be specially assessed against the owners of benefited properties; and WHEREAS, some but not all of the owners of benefited properties have executed petition and waiver agreements regarding the assessments to be levied against their properties; and WHEREAS, it is necessary for the city to conduct a public hearing for the assessment of. those property owners who have failed to execute a petition and waiver agreement; and WHEREAS, the city clerk -treasurer, with the assistance of the city engineer, has prepared an assessment roll for such purpose, which indicates that special assessments will be levied with an interest rate of 6.5% over a period of six years; and WHEREAS, the city clerk -treasurer has placed the proposed assessment roll on file in his office for public inspection. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, as follows: 1. A public hearing shall be held on the 17th day of November, 1998 at city hall at 8:00 p.m. to pass on the proposed assessment and at such time and place all persons owning property affected by such improvement will be given an opportunity to be heard with regard to the proposed assessment. 2. The clerk -treasurer is hereby authorized and directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior RHB-151990 ME230-266 98-62 10-20-98 152 to the hearing. He shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than two weeks prior to the date of the hearing. 3. The owner of any property to be assessed may, at any time prior to certification of the assessments to the county auditor, pay the whole of the assessment on such property with interest accrued to the date of payment, except that no interest shall be charged if the entire assessment is paid within thirty days from the date of the adoption of the resolution. The owner may at any time thereafter pay to the city clerk -treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made prior to November 15 in any year or interest will be charged through December 31 of the succeeding year. Dated: October 20, 1998.
