EXCAVATORS, INC., Grantors, and THE CITY OF McCALL, a municipal corporation
of the State of Idaho, 216 East Park Street, McCall, Idaho 83638, Grantee.
WITNESSETH: That the Grantors, for value received, do by these
presents, grant, bargain, sell and convey unto the Grantee, the following
described real property together with all rights of access between the
right of way of Deinhard Lane, Project No. STP-3270(101) Highway Survey and
the remaining contiguous real property belonging to the Grantors, situated
in the County of VALLEY, State of Idaho, to -wit:
A parcel of land for right-of-way purposes for Deinhard Lane, Project No.
STP-3270(101), situated in the W1/2 of the SW1/4 of the NW1/4 of Section
17, T.18N., R.3E., B.M., Valley County, Idaho, more particularly described
as follows:
COMMENCING at the ;.1 corner common to said Section 17 and 18, from which
corner the northwest corner of said Section 17 bears N.00°11'18"E., 807.094
meters, (2647.94 feet); thence, along the westerly line of said section,
A) N.00°11'18"E., 90.837 meters, (298.02 feet) to the westerly
prolongation of the southerly line of that certain 2.82 acre parcel
of land as shown on Record of Survey recorded in Book 5, Page 435,
Instrument No. 221525, Valley County Records thence, along said
prolongation and southerly line,
B) S.89°52'02"E., 68.942 meters, (226.19 feet) to a non -tangent point
on a curve and the POINT OF BEGINNING; thence,

TO HAVE AND TO HOLD the said premises, with their appurtenances unto
the said Grantee, and Grantee's assigns forever. And the said Grantors do
hereby covenant to and with the said Grantee, that Grantors are the owners
in fee simple of said premises; that said premises are free from all
encumbrances, EXCEPT those to which this conveyance is expressly made
subject and those made, suffered or done by the Grantee; and subject to
reservations, restrictions, dedications, easements, right of way and
agreements, (if any) of record, in use, or visible on the property and
general taxes and assessments, (includes irrigation and utility
assessments, if any) for the current year, which are not yet due and
payable, and that the Grantors will warrant and defend the same from all
