Member Johnson introduced the following resolution and moved its adoption
CITY OF MEDINA
RESOLUTION NO. 98-63
RESOLUTION GRANTING FINAL APPROVAL OF THE
PLAT OF TWO BIRDS ASPIRING
WHEREAS, Tracy Johnson and Sharon Johnson ("the Applicants") are the fees owners of
property located within Medina (the "Property") and legally described as follows:
and
and
The North 208.72 feet of the East 346.08 feet of the Northeast one quarter of the
Southeast one quarter of the Section 2, Township 118, Range 23 West of the fifth
principal meridian, except the East 40 feet thereof;
WHEREAS, the Applicants have requested permission to plat the Property into two lots;
WHEREAS, the planning commission reviewed the proposed plat of Two Birds Aspiring
at its meeting of May 12, 1998; and
WHEREAS, the city council reviewed the proposed plat at its meeting on June 2, 1998 and
October 20, 1998.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MEDINA, MINNESOTA, that final plat approval be granted to the Applicants for the
plat of Two Birds Aspiring, subject to the following terms and conditions:
1. The Applicants must convey to the city by separate instrument a ten foot trail
easement along Co. Rd. 116 and grade the area within the easement;
2. The existing driveway from Co. Rd. 116 must be removed within one year of the
start of construction of the new house on Lot 1;
3. The Applicants must execute a 30 foot easement for driveway and drainage and
utility purposes along the north portion of Lot 1 for the benefit of Lot 2 and the two
lots must share a driveway to Fox Path Court;

4. The Applicants must pay a park dedication fee for Lot 1 in an amount to be
determined by the city assessor;
5. Plat approval is subject to the terms of approval of the Elm Creek Watershed
District;
6. The existing building on Lot 1 must be removed;
7. The Applicants must extend sanitary sewer to Lot 2 and extend the water main from
Fox Path Court to County Road 116, in return for which the City will give the
Applicants a credit against the area trunk fee which will be due;
8. The Applicants must execute a development agreement in a form satisfactory to the
city attorney to ensure completion of all required improvements on the lots;
9. Each lot must include at least two trees a minimum of two and one-half inches in
diameter. The trees may be existing ones or ones installed prior to issuance of a
certificate of occupancy for the houses;
10. The Applicants must pay to the city an administrative fee in the amount necessary to
reimburse the city for its expenses in reviewing this plat; and
11. The Applicants must file the plat of Two Birds Aspiring with Hennepin County
within 60 days of the date of this resolution or the final plat approval hereby granted
shall be null and void.

The motion for the adoption of the foregoing resolution was duly seconded by member Thies upon
vote being taken thereon, the following voted in favor thereof: Ferris, Hamilton, Johnson Thies,
and Zietlow
and the following voted against same: None
Whereupon said resolution was declared duly passed and adopted.
