Member Zietlow introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO.98-66
RESOLUTION GRANTING VARIANCE TO
'MICHAEL KERRISON AND DAWN KERRISON
WHEREAS, Michael Kerrison and Dawn Kenison (the "Applicants") are the fee owners of
property located at 1632 Homestead Trail, which property is legally described on Exhibit A
attached hereto (the "Property"); and
WHEREAS, the Property is zoned rural residential, which requires a minimum side -yard
setback for accessory buildings of 20 feet; and
WHEREAS, the Applicants have requested permission to build a 30 foot by 40 foot
detached garage and to locate it within 10 feet of the side -yard lot line; and
WHEREAS, the Medina zoning ordinance requires a variance in order to locate the
accessory structure as requested by the Applicants; and
WHEREAS, this matter was considered by the planning commission at its meeting on
October 13, 1998 and by the city council at its meeting at its meeting on October 20, 1998.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota, that a variance to reduce the required side -yard setback from 20 feet to 10 feet be
granted to the Applicants for construction of a detached garage on the Property, subject to the
following terms and conditions:
1. The building may not exceed 30 feet by 40 feet and must be constructed in
accordance with the plans and specifications submitted to and approved by the city;
2. The Applicants must initiate construction of the garage within one year of the date of
this resolution or the approval hereby granted shall be null and void; and
3. The Applicants must pay to the city an administrative fee in the amount necessary to
reimburse the city for the cost of reviewing this application.

NOW, '1'11LREFORE, BE IT FURTHER RESOLVED, by the city council of the city of
Medina, Minnesota that the above stated variance is justified by the hardships to the lot represented
by the steep slopes to the north and south of the proposed garage location, the need to preserve the
areas in the front yard for septic use and the steep slope of the driveway if moved.

The motion for the adoption of the foregoing resolution was duly seconded by member Thies and
upon vote being taken thereon, the following voted in favor thereof: Ferris, Thies, and Zietlow
and the following voted against same: None Absent: Hamilton, Johnson
Whereupon said resolution was declared duly passed and adopted.

The Property is located in Hennepin County, Minnesota and is legally described as follows:
That part of the South 678 feet of the Southeast Quarter of the Southeast Quarter
lying West of the East 75 feet thereof and lying East of the following described line:
Beginning at a point in the South line of the East half of said Southeast Quarter of
the Southeast Quarter distant 265.5 feet East from the Southwest corner of said East
half of the Southeast Quarter of the Southeast Quarter; thence North parallel with the
East line of said Southeast Quarter of the Southeast Quarter to the North line of said
South 678 feet, and there ending, all in Section 20, Township 118 North, Range 23
West of the 5th Principal Meridian.
