Member Zietlow introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO.98-67
RESOLUTION GRANTING A CONDITIONAL USE PERMIT
TO JEFF AND CHRIS CATES
WHEREAS, Jeff Cates and Chris Cates (the "Applicants") are the fee owners of property
located at 2400 Cates Ranch Drive, which property is legally described as Lot 1, Block 1, Cates
Ranch, according to the plat thereof on file in Hennepin County, Minnesota (the "Property"); and
WHEREAS, the Applicants have requested permission to construct a over -sized accessory
building on the Property; and
WHEREAS, the Medina zoning ordinance requires a conditional use permit in order to
construct an accessory building in excess of 3,000 sq. feet; and
WHEREAS, this matter was reviewed by the planning commission at its meeting on
October 13, 1998 and by the city council at its meeting on October 20, 1998; and
WHEREAS, it has been determined that the construction of the accessory building on the
Property will not adversely affect development of adjacent properties for purposes for which they
are zoned.
NOW, THLREFORE, BE IT RESOLVED, by the city council of the city of Medina that
a conditional use permit be granted to the Applicants for the purpose of constructing an accessory
building on the Property, subject to the following terms and conditions:
1. The accessory building may not exceed 5,050 square feet in area and must be
constructed in accordance with the plans and specifications submitted to and
approved by the city;

2. The building may be used only for personal use and there shall be no boarding of
animals or leasing of space therein;
3. There shall be no living quarters in the accessory structure; and
4. The Applicants must pay to the city an administrative fee in the amount necessary to
reimburse the city for its costs in reviewing this application.

The motion for the adoption of the foregoing resolution was duly seconded by member Thies and
upon vote being taken thereon, the following voted in favor thereof: Ferris, Thies, and Zietlow
and the following voted against same: None Absent: Hamilton, Johnson
Whereupon said resolution was declared duly passed and adopted.
