HomeMy Public PortalAbout1999-00615 Member Hamilton introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.99-06 RESOLUTION GRANTING A VARIANCE FOR SIGN HEIGHT FOR MEDINA ENTERTAINMENT CENTER WHEREAS, Medina Entertainment Center (the "Applicant") is the owner of a business located at 500 T. H. 55 (the "Property"); and WHEREAS, the Applicant has requested permission to construct a new free-standing sign 31 feet in height on the Property; and WHEREAS, Section 815.11 of the Medina code of ordinances restricts free-standing signs of the type proposed by the Applicant to 20 feet in height; and WHEREAS, this matter was reviewed by the planning commission at its meeting of December 8, 1998 and by the city council at its meeting on January 5, 1999. NOW THEREFORE, BE IT RESOLVED by the city council of the City of Medina, Minnesota that a variance be granted to the Applicant to allow construction of a free-standing sign on the Property not to exceed 31 feet in height, subject to the following terms and conditions: 1. The Applicant must construct the sign no more than 31 feet high and in substantial conformance with the illustration submitted to and approved by the planning commission and city council; 2. The sign must be constructed within one year of the date of the adoption of this resolution or the variance hereby granted shall be null and void; and 3. The Applicant must pay to the city an administrative fee in the amount necessary to reimburse the city for the cost of reviewing and approving this variance. RHB-156601 ME230-8 99-06 01-19-99 16 NOW THEREFORE BE IT FURTHER RESOLVED by the city council of the City of Medina, Minnesota that the above variance is justified by the hardship imposed on the Property by the fact that the right-of-way of T. H. 55 in front of the Property is elevated above the site.
