CITY COUNCIL
MINUTES
OCTOBER 4, 1983
INITIATION:
1. CALL TO ORDER:
Mayor Gillanders called the regular meeting of the City Council to
order at 7:30 p.m. on Tuesday, October 4, 1983, in the Council Cham-
ber of the City Hall.
2. The invocation was given by Bishop Payne, Church of Jesus Christ of
Latter Day Saints, 6249 Kauffman.
3. The Pledge of Allegiance to the Flag was led by Mayor Gillanders.
4. ROLL CALL:
Present: Councilmen - Atkins, Tyrell, Gillanders
Absent: Councilmen- Dennis, Swain
Also Present: City Manager Koski, City Attorney Martin, Assistant
City Manager.Kimbrough, Planning Director Shaw, Parks
and Recreation Director Kobett and Julie Estrada,
Temple City Times
Councilman Atkins moved to excuse Councilmembers Dennis and Swain
for cause while representing the City in another area, seconded by
Councilman Tyrell and carried.
5. CONSENT CALENDAR:
Councilman Atkins moved to Approve Items A through I on the Consent
Calendar as recommended, seconded by Councilman Tyrell and unanimously
carried.
A. APPROVAL OF MINUTES - Regular Meeting of September 20, 1983.
B. RECOMMENDATION FROM PARKING COMMISSION - MEETING OF SEPTEMBER 14,
1983: HOLIDAY PARKING ENFORCEMENT, PUBLIC PARKING LOTS - CENTRAL
BUSINESS DISTRICT
Approved increased parking enforcement four hours per day, Monday
through Friday, beginning December 5 and continuing through
December 23, 1983.
C. RECOMMENDATION FROM PARKS AND RECREATION COMMISSION - MEETING
OF SEPTEMBER 21, 1983
(1) REQUEST FOR USE OF LIVE OAK PARK FACILITIES - TEMPLE CITY
AMERICAN LITTLE LEAGUE
Approved American Little League use of the north and south base-
ball diamonds and a portion of the grassed area west of the
athletic field light poles and the concession stand from February
1 through July 30, 1984, Monday through Friday from 4 to 10 p.m.
and Saturdays from 7 a.m. to 10 p.m. subject to conditions, in-
cluding the required Certificate of Insurance as set forth in
staff memo dated September 22, 1983.
(2) SALE OF EXCESS PROPERTY LOS ANGELES COUNTY FLOOD CONTROL
DISTRICT
Concurred with Parks and Recreation Commission recommendation not
to purchase Parcel No. 104.1 (which is landlocked without public
access) being offered for sale by the. Los Angeles County Flood
Control District.

(1) PROPERTY NUISANCE CASE NO. 83 -101: 51102 SERENO DRIVE,
TEMPLE CITY
Adopted Resolution No. 83- 2201, A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF TEMPLE CITY DECLARING CERTAIN PREMISES TO BE A
PUBLIC NUISANCE, AND ORDERING ABATEMENT THEREOF.
(2) PLANNING COMMISSION ACTION
Received and filed memo from Planning Commission, relating to
action taken at their regular meeting held September 27, 1983.
E. PROGRESS PAYMENT NO. 1: REPAINTING OF PAVEMENT MARKINGS AND
STRIPING SCHOOLS, SELECT SYSTEMS STREETS, AND MAINTENANCE AREAS
4, 5, and 6
Approved progress payment in the sum of $7,862.86 to Safety
Striping Service, Inc. for, work completed under the contract.
F. RESOLUTION NO. 83 -2198: VACATION OF ALLEY - EDWARDS THEATRE
DEVELOPMENT
Adopted Resolution No. 83 -2198 A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF TEMPLE CITY VACATING THE ALLEY NORTH OF LAS TUNAS
DRIVE, SOUTH OF ELM AVENUE, RUNNING BETWEEN ROSEMEAD BOULEVARD
AND SULTANA AVENUE, IN SAID CITY.
G. PROPOSAL FOR ELECTION SERVICES - GENERAL MUNICIPAL ELECTION 1984
Accepted proposal from Martin & Chapman Company for election ser-
vices for the General Municipal Election to be held April 10,
1984, as outlined in their letter of September.26, 1983.
H. RESOLUTION NO. 83 -2199: EMPLOYMENT OF PERSONNEL
Adopted Resolution No. 83 -2199 A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL.
I. RESOLUTION NO. 83 -2200: WARRANTS AND DEMANDS
Adopted Resolution No. 83 -2200 A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE
SUM OF $165,676.96 DEMAND NOS.6433 THRU 6551.
6. UNFINISHED BUSINESS:
A. ORDINANCE NO. 83 -540: 2nd .reading AMENDING THE TEMPLE CITY ZONING
CODE RE LODGES, MEETING HALLS,. AND SOCIAL CLUBS TO BE PERMITTED
ONLY WITH A CONDITIONAL USE PERMIT
City Manager Koski presented background information stating this was
the second reading of the Ordinance revision amending the Temple City
Zoning Code relating to lodges, meeting halls and social clubs
being permitted only with a conditional use permit.
Councilman Atkins moved to adopt Ordinance No. 83 -540 AN ORDINANCE OF
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 9380
AND 9202 OF THE TEMPLE CITY ZONING'CODE RELATING TO LODGES, MEETING
HALLS, AND SOCIAL CLUBS, seconded by Councilman Tyrell and unanimously
carried.
B. RESOLUTION NO. 83 -2197: INTENT TO AMEND PERS CONTRACT RE SUR-
VIVORS BENEFITS
City Manager Koski presented background information stating at the
time of the adoption of the 1983 -84 fiscal year budget, City Council
approved changes in the covera,e provided by Public Employees Retire-
ment System (PERS) to City employees. Staff has prepared the required
Resolution of .Intent to initiate the addition of the Post- Retirement
Survivors Allowance.

Councilman Tyrell moved to adopt Resolution No. 83 -2197 A RESOLUTION
OF INTENTION TO APPROVE AN°AMENDMENT. -TO CONTRACT BETWEEN THE BOARD
OF ADMINISTRATION OF THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND THE
CITY COUNCIL OF THE CITY OF TEMPLE CITY and approved the Schedule
for Implementation including the public hearing set for November 1,
1983, seconded by Councilman Atkins, and unanimously carried.
7. NEW BUSINESS:
None.
8. COMMUNICATIONS:
None.
9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
Ed Jenkins, 9714 Callita, Arcadia, stated he was here on behalf of
the newly formed "Homeowners for Water Rights" representing approxi-
mately 2600 families who are serviced by the East Pasadena Water Dis-
trict, approximately 200 to 300 of which live in the Temple City area.
Petitions are being prepared and will be circulated throughout the
area which will direct the County of Los Angeles and affected local
governments to undertake condemnation proceedings under the Public
Utilities Code Section 1402. The homeowners want to remove the pre-
sent utility and take whatever action is necessary to align the area
with a proper utility which can better serve the community.
Mayor Gillanders stated he felt the group would be benefited by
taking the appropriate steps to arrange for condemnation proceedings
themselves and form their own water district.
Mr. Jenkins stated he felt the Council's attitude was inappropriate
and would relay this attitude in his next newsletter. (See further
remarks in 11. F - Matters From City Officials)
RECESS TO CRA:
At this time, Council recessed to meet as the Community Redevelopment
Agency, all members being present, approved the minutes of the regular
meeting of September 20, 1983. The minutes are set forth in full in the
records of the Agency.
RECONVENE AS CITY COUNCIL:
10. ACTION ON REQUEST BY CRA:
There was no action to be taken.
11. MATTERS FROM CITY OFFICIALS:
A. ICMA CONFERENCE /VACATION
Councilman Atkins moved to approve City Manager's vacation for the
period of October 14 through 29th; seconded by Councilman Tyrell and
unanimously carried.
B. CLAIM FOR DAMAGES
Councilman Tyrell moved to deny and refer the claim of Mr. Brashear
for property damages to JPIA, seconded by Councilman Atkins and unan-
imously carried.
C. DESIGN CRITERIA FOR COUNTY ENGINEERING BUILDING
Councilman Atkins stated he had reviewed the draft of the design
criteria and felt it was well done, comprehensive, and the kind of
document the architect will appreciate receiving when developing the
preliminary plans for the remodeling of the building.
Since two of the Councilmembers were absent due to other City business,
further action on this matter was deferred until the November 1 meeting.

D. SUBVENTIONS
Mayor Gillanders stated our subventions have been restored for at
least one year and expressed his appreciation to the Chamber of
Commerce and our citizens for their efforts and communications to
the Legislatures.
E. COUNTY ENGINEERING BUILDING
Councilman Tyrell presented a copy of the approved, duly executed
Resolution, Contract and Grant Deed for the County Engineering
Building which had been passed by the County Board of Supervisors
at their September 29th meeting.
F. EAST PASADENA WATER DISTRICT
Mayor Gillanders expressed concern regarding Mr. Jenkins' comments
and felt he had a lack of knowledge in the workings of the Municipal
Government and in the efforts expended by the offices of the Council.
Councilman Tyrell stated since the water district encompasses more
than one governmental jurisdiction, it is totally impossible for any
one of these jurisdictions to even consider condemnation proceedings
against the water district either. individually or collectively be-
cause if the condemnation proceedings were successful, the money
involved in the cost of repairs and trying to set up an adequate
water district is prohibitive. On the other hand, should the
people through the "Homeowners for Water Rights" desire, the Public
Utilities Code does authorize them to initiate condemnation proceed-
ings which. may entitle them as an individual group to certain bene-
fits. However, any group which undertakes this task would still have
the great problem of purchasing the company and bringing it up to
standards which would cost untold millions of dollars and it may be
just as impractical for them to d� it as it would be for combined
jurisdictions. Unfortunately, it is a situation that exists which
cannot be remedied by the City.
G. SISTER CITY
Mayor Gillanders stated he had received communications from Hawkesbury
Shire Council in Australia expressing their desire to proceed with
the Sister City program.
12. ADJOURNMENT:
On motion by Councilman Tyrell, seconded by Councilman Atkins,
meeting adjourned at 7:50 p.m. Next regular meeting of the City
Council will be held Tuesday, October 18, 1983, 7:30 p.m. in the
Council Chamber of the City Hall.
