Member Jim Johnson introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO.99-11
RESOLUTION GRANTING PRELIMINARY APPROVAL OF
THE PLAT OF CATES MEDINA ADDITION
WHEREAS, C.C.&M. Partnership (the "Applicant") is the fee owner of land in Medina generally
located north of T.H. 55 and west of County Road 101 (the "Subject Property"), which land is
legally described in Exhibit A attached hereto; and
WHEREAS, the Applicant has requested approval to plat the Subject Property into one lot and one
outlot, which plat will be known as Cates Medina Addition; and
WHEREAS, this matter was considered by the planning commission at its meeting of January 12,
1999; and
WHEREAS, the city council reviewed the proposed preliminary plat of Cates Medina Addition at
its meeting on February 2, 1999.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota,
that preliminary approval is hereby granted to the Applicant for the plat of Cates Medina Addition,
subject to the following terms and conditions:
1. The preliminary plat must be reviewed and approved by Elm Creek Watershed District;
2. The final plat must dedicate to the public the right-of-way and drainage and utility
easements required by the city engineer;
3. The Applicant must extend Clydesdale Trail to the west and construct a temporary cul-de-
sac in accordance with city standards;
4. The Applicant must permanently close the old driveway to the southwest prior to issuance
of any building permit;

5. Access to both the lot and outlot will be obtained from Clydesdale Trail;
6. The Applicant must pay to the city a park dedication fee in an amount to be determined by
the city assessor;
7. The Applicant must completely remove the old theater sign at the southwest entrance prior
to the issuance of any building permits;
8. The Applicant must execute a development agreement in a form acceptable to the city
attorney to assure completion of the Clydesdale Trail and other improvements;
9. The Applicant must submit a final plat to the zoning administrator within 180 days of the
date of this resolution or the approval granted by this resolution shall be null and void. The
final plat must be in compliance with all city ordinances and standards and in accordance
with this preliminary plat approval; and
10. 'The Applicant must pay to the city an administrative fee in an amount necessary to
reimburse the city for the cost of reviewing and approving this application.

The motion for the adoption of the foregoing resolution was duly seconded by member Carolyn
Smith and upon vote being taken thereon, the following voted in favor thereof:
Ferris, Johnson, Smith, and Zietlow
and the following voted against same: None Absent: Hamilton
Whereupon said resolution was declared duly passed and adopted.
