RESOLUTION N0. 67-25
RESOLUTION OVERRULING PROTESTS IN CONNECTION
WITH THE HEARING ON DEBT LIMITATION FOR TI-IE
PROPOSED IMPROVEMENT OF JOSEPHINE AVENUE ET
AL, BY THE CONSTRUCTION OF CONCRETE CURB AND
GUTTER AND DRIVEWAY APPROACHES, TOGETHER WITH
ALL INCIDENTAL AND APPURTENANT WORK.
WHEREAS, the City Council of the City of Lynwood did,
on the 21st day of February 1967 approve an investigation
report under the provieions of Division 4 of the Street and
Highway Code, cited as "Special Assessment Invesfigation,
Limitation and Majority Protest Act of 1931," as amended, upon
the proposed improvement of Josephine Avenue et al, by the
conetruction of concrete curb and gutter and driveway approaches,
• together with all incidental and appurtenant work, as shown on
Plan No. 1967-C-2 on file in the office of the City Clerk of
said city, and
WHEREAS, said report having been duly prepared and
_ fileel, a hearing wae held by said City Council on fhe 4th day of
April., 1967 in the manner provided in said Act above referred
to, and
WHEREAS, more than thirty daye have expired since the
date of mailing noticee of hearing on said report,
NOW, THEREFORE, the City Council of the City of Lynwood
does hereby resolve as follows:
l. That the protests made at said hearing on said
investigation report be and the aame ane hereby overruled;
2. That the public interest, convenience, and necessity
require the doing and making of the public improvement set £orth
and deeeribed in said report above referred to and subatantially
in the manner eet forth;
, 3. That the pro,ject consisting of the proposed
improvement above referred to is feasible, and that the land to
be assessed will be able to carry the burden o£ said proposed
assessment;

4. That the estimated total amount proposed to be
assessed upon any or all lots or parcels of land for the, coste and
expenees of said propoaed improvement does not exceed the limitation
of indebtedness e�tablished and set forth in said act above referred
to and will nof, by the levy thereof, cause said limitation to be
exceeded in any instance;
5. That no majority protest has been £iled with the
Clerk of fhe legislative body.by the owners of the property proposed
to be aesessed to pay the costs and expenses of said proposed
improvement;
6. That it is hereby ordered that the proceedings for
the rnaking of said proposed improvement be undertaken pur�uant
to the provisions of an Act of the Legislature of the State of
California designated aa Division 7 of the Streets and Highways
Code, cited as the "Improvement Act of 1911, and amendmenta
thereto". ,
