Councihnember Byrd, Henning, and Richards answered the roll call. Also present were City Manager Gonzales, City Clerk Hooper and Department Heads. City Clerk Hooper announced the Agenda had been duly posted in accordance with The H o o p e r Brown Act. Mayor Richards read the title of the ordinance into the record. Richard s PUBLIC ORAL COMMUNICATIONS-AGENDA ITEMS ONLY Arturo Reyes discussed Councils abuse of power and disregard for democracy. Reyes Rick Sanchez 3152 Norton Ave. discussed the expectancy of an election this November S a n c h e z by the residents of the City. Irene Garcia 2737 E. 111th St. discussed a monopoly of democratic process. Garc i a Adolph Lopez stated opposition to the change of election dates. Lopez Caffie Greene questioned Councils reasoning behind the change of election date. Greene AGENDA ITEMS FOR CONSIDERATION Mayor Richards clarified Government Code 36503.5 related to elections, and the change by previous councihnembers of Lynwood moving from even year election to odd year. Richard s Also discussed the major instability that could be caused by the vacancy of numerous seats on the Council. -- It was then moved by Councilmember Henning, seconded by Councilmember Byrd to WAIVE READING AND INTRODUCE: "AN ORDINANCE OF THE CITY OF LYNWOOD MOVING THE DATE OF ITS GENERAL MUNICIPAL ELECTION FROM THE FIRST TUESDAY AFTER THE FIRST MONDAY IN NOVEMBER OF ODD-NUMBERED YEARS TO THE FIRST TUESDAY AFTER THE FIRST MONDAY IN NOVEMBER OF EACH EVEN-NUMBERED YEAR, PURSUANT TO GOVERNMENT CODE SECTION 36503.5" ROLL CALL: AYES: COUNCILMEMBER BYRD, HENNING, RICHARDS NOES: NONE ABSENT: COUNCILMEMBER REA f- Mayor Richards then clarified an item also listed on the agenda of April 15, 1997 was the option to conduct a Special Election to fill the vacant seat on the Council, and after further consideration would like to reconsider an ordinance calling for a Special Election to fill the unexpired term of Councilman Heine, and requested the City Clerk read the caption of the ordinance, so that the Council may consider this as a subsequent need item. Henning Byrd ORD Moving date of General Municipal Election Richards City Clerk Hooper clarified that the aforementioned item is a resolution, and can be Hooper adopted by Council at this meeting. It was moved by Councilmember Henning, seconded by Councihnember Byrd to adopt: RESOLUTION NO. 97-49 ENTITLED: "A RESOLUTION OF THE CITY Henning COUNCIL OF THE CITY OF LYNWOOD ORDERING, CALLING, AND GIVING NOTICE OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN RES 97- 49 THE CITY ON TUESDAY, NOVEMBER 4, 1997, FOR THE ELECTION OF A Special Municipal Election i ~0~ MEMBER OF THE CITY COUNCIL TO FILL AN EXISTING VACANCY AND REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES TO CONSOLIDATE THAT SPECIAL MUNICIPAL ELECTION WITH THE SCHOOL DISTRICT ELECTION TO BE HELD ON THAT DATE, IN ACCORDANCE WITH SECTION 10403 OF THE ELECTIONS CODE". ROLL CALL: AYES: COUNCILMEMBER BYRD, HENNING, RICHARDS NOES: NONE ABSENT: COUNCILMEMBER REA PUBLIC ORALS Mel Brown 5229 Beechwood thanked Council for the explanation and clarification on the Brown Special Election. Arturo Reyes discussed monarchy. Mayor Richards discussed the actions of the Council are in the best interest of the Richards community. Hearing no further discussion, it was moved by Mayor Richards, seconded by Richards Councilmember Byrd and carried to adjourn at 8:30 a.m. to a meeting on to be held on Tuesday, Apri122 97 at 7:30 a.m. ~7 ~~ AUL H.
