HomeMy Public PortalAbout1999-01633 Member Jim Johnson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.99-16 RESOLUTION GRANTING CONDITIONAL USE PERMIT TO POLARIS INDUSTRIES, INC. WHEREAS, Polaris Industries, Inc. (the "Applicant") is the owner of a 33 acre site in Medina at the northwest intersection of T.H. 55 and Mohawk Drive, which property is legally described on Exhibit A (the "Subject Property"); and WHEREAS, the Applicant has proposed to build its corporate headquarters on the Subject Property; and WHEREAS, the city's zoning ordinance requires a conditional use permit prior to the Applicant completing its plans; and WHEREAS, this matter was reviewed by the planning committee at its meeting of February 9, 1999 and by the city council at its meeting on March 2, 1999; and WHEREAS, it has been determined that granting the requested conditional use permit to the Applicant for the stated purpose will not adversely affect the development of adjacent properties for purposes for which they are currently zoned. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that a conditional use permit be granted to the Applicant for the purpose of allowing the construction of a corporate headquarters on the Subject Property, subject to the following terms and conditions: 1. Additional landscaping must be provided by the Applicant at the northwest corner of the building and southeast of the wetlands, which landscaping shall consist of two rows of eight RHB-159568 ME230-274 33 99-16 03-16-99 34 foot Black Hills spruce, 12 feet on center and staggered at the top of the berm. The additional landscaping must be shown on the revised landscaping plan; 2. The Applicant must convey to the public by separate instrument the additional right-of-way required by MnDOT and the city; 3. The height of the light standards in the parking areas and walkways may not exceed 20 feet; 4. All exterior lighting on the site must be downcast only with fixtures designed and installed so that they are enclosed on all sides except the bottom with the globe or other light source not visible from the sides. All lighting on site must meet city ordinances and be in accordance with the submitted and approved lighting plan; 5. Exterior lighting must not be above the first floor level, i.e. no more than 15 feet above grade; 6. The size of the trees used in the landscaping must be specified on the plan and the landscaping plan must be approved by city staff; 7. Exterior trash containers must be completely screened using building materials similar to those used in the construction of the building; 8. The proposed plans must be reviewed and approved by MnDOT; 9. All rooftop mechanical equipment must be completely screened from view from adjacent properties and rights -of -way; 10. The Applicant must provide easements by separate instrument to the city over all wetlands and over the pond in the northwest corner of the site, as required by the city engineer; 11. The drainage plan for the site must be submitted to and approved by the Elm Creek Watershed District and the city engineer; 12. The building plans must be reviewed and approved by the fire department; RHB-159568 ME230-274 34 99-16 03-16-99 35 13. There shall be no outside speakers or bells on the site; 14. The Applicant must pay for an additional 36 SAC units prior to the issuance of the building permit; 15. A letter of credit must be provided to the city on a form approved by the city attorney to cover all site, utility and exterior lighting improvements; 16. The Applicant must execute a petition and waiver agreement in a form approved by the city attorney regarding the improvement of Chippewa Drive and Willow Road; 17. All exterior signs must meet city ordinances and be approved by city staff; 18. The site shall not contain a test track and the Applicant shall not allow the running of snowmobiles or ATVs after 6:00 p.m. on the site; 19. All terms of this conditional use permit must be met prior to occupancy of the facility; 20. All traffic associated with the construction of the facility must use Mohawk Drive until roadway improvements are completed on Chippewa; 21. The trailers on site must be currently licensed, insured, and road -worthy; 22. Any outside storage must be screened from view from adjacent properties and rights -of -way; 23. The Applicant must convey to the City by separate instrument an easement for trail purposes 10 feet in width along the west side of Mohawk Drive; 24. All wells on the site must be abandoned in accordance with state requirements; 25. The Applicant shall be responsible for grading the south side of Chippewa Drive from its intersection with Mohawk to the west property line of the Subject Property; and 26. The Applicant shall pay to the city an administrative fee in an amount equal to the city's costs in reviewing and approving this application.
