LYNWOOD CITY COUNCIL, SPECIAL MEETING-JULY 22, 1997 The City Council of the City of Lynwood met in a Special Session in the City Hall, 11330 Bullis Road, on the above date at 5:52 p.m. Mayor Pro-Tem Henning presiding. Councilmember Byrd, Rea and Henning answered the roll call. Mayor Richards was absent. Also present were City Manager Gonzales, City Attorney Rudell, City Clerk Hooper, and City Treasurer Pygatt. I City Clerk Hooper announced the Agenda had been duly posted in accordance with The yooper Brown Act. PUBLIC ORAL COMMUNICATIONS -AGENDA ITEMS ONLY Ada McZeal, Representative of Concerned Citizens of Lynwood discussed the proposed McZeal initiative petition, and requested the item be placed on the ballot, and council let the voters decide. ITEMS FOR CONSIDERATION It was moved by Councilmember Rea, seconded by Councilmember Byrd to: Rea RECEIVE AND FILE, THE CERTIFICATION BY THE CITY CLERK OF THE Byrd REGISTRAR-RECORDERS SIGNATURE VERIFICATION. ROLL CALL: AYES: COUNCILMEMBER BYRD, REA, HENNING NOES: NONE ABSENT: COUNCILMEMBER RICHARDS It was then moved by Councilmember Rea, seconded by Councilmember Byrd, to adopt: RESOLUTION NO. 97-109 ENTITLED: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ORDERING, CALLING, AND ~~' GIVING NOTICE OF A SPECIAL MUNICIPAL ELECTION, TO BE CONSOLIDATED WITH THE SCHOOL DISTRICT ELECTION TO BE HELD ON NOVEMBER 4, 1997, FOR THE PURPOSE OF SUBMITTING TO THE VOTERS AN ORDINANCE, PROPOSED BY I1~TITIATIVE PETITION AUTHORIZING THE TRANSFER OF FIRE PROTECTION, EMERGENCY MEDICAL SERVICES, AND HAZARDOUS MATERIALS PROTECTION SERVICES, AND HAZARDOUS MATERIALS PROTECTION SERVICES FROM THE LYNWOOD FIRE DEPARTMENT TO THE CONSOLIDATED FIRE PROTECTION DISTRICT OF LOS ANGELES COUNTY, AUTHORIZING A CONTRACT TO PROVIDE RETIREMENT BENEFITS FOR FIRE FIGHTERS, AND AUTHORIZING THE TRANSFER OF CERTAIN RETIREMENT BENEFITS FOR FIRE FIGHTERS". Councilmember Byrd, Henning, Rea and Richards answered the roll call. Also present were City Manager Gonzales, City Clerk Hooper, City Treasurer Pygatt and Department Heads. It was moved by Councilmember Henning, seconded by Councilmember Byrd and carried to approve the following minutes: a) Regular Meeting, July 15, 1997 b) Special Meeting, July 22, 1997 It was moved by Councilmember Rea, seconded by Councilmember Henning, and carried to approve the presentation to Council by the Washington Elementary 5th and 6th Grade Gate Program. It was then moved by Councilmember Henning, seconded by Councilmember Rea and carried to recess to the Lynwood Redevelopment Agency and the Lynwood Information, Inc., at 7:38 p.m. Council reconvened at 7:40 p.m. PUBLIC HEARINGS ~"" Mayor Richards introduced the first item, Appeal of Planning Commission Denial of Conditional Use Permit CUP 97-08 and Variance 97-OS to Sell Beer and Wine in a Billiard Parlor at 11410 Long Beach Boulevard. It was moved by Councilmember Henning, seconded by Councilmember Rea and carried to open the public hearing. Hearing no discussion, it was moved by Councilmember Rea, seconded by Councilmember Henning and carried to close the public hearing. It was then moved by Mayor Richards, seconded by Councilmember Henning and carried to continue this hearing to an adjourned meeting on August 6, 1997 at 5:45 p.m. Mayor Richards introduced the next item, conducting an Emergency Hearing to Determine that a Nuisance is Being Maintained on Certain Real Property Generally Known as 11041 Carson Drive, Legally Known as Tax Assessor's Book No. 6173, Page 016, Lot 003, in the City of Lynwood. I It was moved by Councilmember Henning, seconded by Councilmember Byrd and carried to open the public hearing. Hearing no discussion, it was moved by Councilmember Henning, seconded by Councilmember Rea and carried to continue the hearing to August 6, 1997 at 5:45 p.m. Mayor Richards introduced the next item, conducting an Emergency Hearing Determining that a Nuisance is Being Maintained on Certain Real Property Generally Known as 3131 A & B, Euclid Avenue/12438 Peach Street, Legally Known As Tax Assessor's Book No. 6176, Page 002, Lot 003, in the City of Lynwood. It was moved by Councilmember Henning, seconded by Councilmember Byrd and carried to continue the hearing to August 6, 1997 at 5:45 p.m. Mayor Richards introduced the next item, conducting an Emergency Hearing, Determining that a Nuisance is Being Maintained on Certain Real Property Generally Known as 3525 Euclid Avenue, Legally Known as Tax Assessor's Book No. 6177, Page 002, Lot 027, in the City of Lynwood. It was moved by Councilmember Byrd, seconded by Councilmember Henning and carried to continue the hearing to August 6, 1997 at 5:45 p.m. Mayor Richards introduced the next item, conducting an Emergency Public Hearing Determining that a Nuisance is Being Maintained on Certain Real Property Generally Known as 11655 Louise Avenue, Legally Known as Tax Assessor's Book No. 6188, Page 006, Lot 023, in the City of Lynwood. It was moved by Councilmember Henning, seconded by Councilmember Byrd and carried to continue the public hearing to August 6, 1997 at 5:45 p.m. Mayor Richards introduced the next item, a Public Hearing for the Purpose of Finding the City of Lynwood to be in Conformance with the Congestion Management Program (CMP) and Adopting the CMP Local Implementation Report, in accordance with California Government Code Section 65089. It was moved by Councilmember Henning, seconded by Councilmember Rea and carried to continue the public hearing to August 6, 1997 at 5:45 p.m. CONSENT CALENDAR It was moved by Councilmember Byrd, seconded by Councilmember Rea and carried to continue the Consent Calendar and the remainder of the Agenda, to an adjourned meeting to be held on August 6, 1997. ADJOURNMENT It was then moved by Councilmember Henning, seconded by Councilmember Byrd and carried to adjourn to a continued meeting on August 6, 1997 at 5:45 p.m. MAYOR PAUL H.
