CALL TO ORDER: Mayor Gillanders called the regular meeting of the City Council order at 7:30 p.m. on Tuesday, October 18, 1983, in the Council Chamber of the City Hall. to The invocation was given by Reverend Paul Montoya, St. Luke's Catholic Church, 9451 E. Broadway. 3. The Pledge 4. ROLL CALL: of Allegiance to the Flag was led by Mayor Gillanders. Present: Absent: Also Present: Councilman Councilmen - Atkins, Dennis, Swain, Gillanders Councilman - Tyrell City Attorney Martin, Assistant City Manager Planning Director Shaw, Parks and Recreation Kobett, and Julie Estrada, Temple City Times Atkins moved to excuse Councilman Tyrell for cause, by Councilman Dennis and unanimously carried. 5. CONSENT CALENDAR: Councilman Atkins moved to approve Items A through F on the Consent Calendar as recommended, seconded by Councilman Swain and unanimously carried. Kimbrough, Director seconded A. APPROVAL OF MINUTES - Regular Meeting of October 4, 1983. Approved as written. B. PROGRESS PAYMENT NO. 2: REPAINTING OF PAVEMENT MARKINGS AND STRIPING SCHOOLS, SELECT SYSTEM STREETS,AND MAINTENANCE AREAS 4, 5, and 6 Approved progress payment No. 2 in the sum of $1,961.84 to Safety Striping Service, Inc. for work completed under the contract. C. ACCEPTANCE OF BID: RE- ROOFING OF LIVE OAK PARK FACILITIES Accepted low bid from Sears Roofing Service, Inc. inthe amount of $9,000, and authorized Mayor and City Clerk to sign. D. UNFINISHED BUSINESS: A. PUBLIC HEARING: 7:30 P.M. ASSESSMENTS FOR STREET LIGHTING IMPROVE- MENTS - PERSIMMON AVENUE, GRAND TO FAIRVIEW (Pursuant to Chapter 27, Improvement Act of 1911, Streets and Highways Code) City Council Minutes, October 18, 1983 - Page 2 Assistant City Manager Kimbrough presented background information stat- ing City Council, at their regular meeting of September 20, 1983, set public hearing for this evening to approve the assessments to property owners regarding installation of four street lights on marbelite stands with overhead service. The installation has been confirmed by staff and energized by Southern California Edison on August 10, 1983. The cost of installation was $516 resulting in an assessment of $20.64 per property owner. Mayor Gillanders declared the public hearing open and invited anyone wishing to speak to come forward. There being no one that came forward to speak, Councilman Dennis moved to close public hearing, seconded by Councilman Swain and unanimously carried. Councilman Atkins moved to approve the assessments as detailed in the staff report dated October 6, 1983, and directed the Superintendent of Streets to notify property owners, and collect the assessments, seconded by Councilman Dennis and unanimously carried. 6. B. PUBLIC HEARING: 7:30 P.M. ASSESSMENTS FOR STREET LIGHTING IM- PROVEMENTS - LA ROSA DRIVE, AGNES TO BALDWIN AVENUE (Pursuant to Chapter 27, Improvement Act of 1911, Streets & Highways Code) Assistant City Manager Kimbrough presented background information stat- ing City Council, at their regular meeting of September 20, 1983, set public hearing for this evening to approve the assessments to property owners regarding the installation of four street lights with overhead service, three of which were installed on existing poles, and one on a new marbelite standard pole. The installation has been confirmed by staff and energized by Southern California Edison on August 10, 1983. Cost of installation was $129 resulting in an assessment of $8.60 per property owner. Mayor Gillanders declared the public hearing open and invited anyone wishing to speak to come forward. There being no one that came forwar to speak, Councilman Swain moved to close public hearing, seconded by Councilman Atkins, and unanimously carried. Councilman Dennis moved to approve the assessments as detailed in the staff report dated October 6, 1983, and directed the Superintendent of Streets to notify property owners and collect the assessments, seconded by Councilman Atkins and unanimously carried. C. PUBLIC HEARING: 7:30 P.M. ASSESSMENTS FOR STREET LIGHTING IM- PROVEMENTS - ROCCUS LANE, 8600 BLOCK (Pursuant to Chapter 27, Improvement Act of 1911, Streets & Highways Code) Assistant City Manager Kimbrough presented background information stat- ing City Council, at their regular meeting of September 20, 1983, set public hearing for this evening to approve the assessments to property owners regarding the installation of two street lights on new marbelite standards with overhead service. The installation has been confirmed by staff and energized by Southern California Edison on August 10, 1983. Cost of installation was $258 resulting in an assessment of $28.66 per property owner. Mayor Gillanders declared the public hearing open and invited anyone wishing to speak to come forward. There being no one that came forwar to speak, Councilman Atkins moved to close public hearing, seconded by Councilman Swain and unanimously carried. Councilman Atkins moved to approve the assessments as detailed in the staff report dated October 6, 1983, and directed the Superintendent of Streets to notify property owners and collect the assessments, seconded by Councilman Dennis and unanimously carried. D. PUBLIC HEARING: 7:30 P.M. ALLEY RECONSTRUCTION BETWEEN PERSIMMON AVENUE AND EL MONTE AVENUE, FROM GRAND AVENUE TO SOUTHERLY CITY • BOUNDARY (Pursuant to Chapter 27, Improvement Act of 1911, Streets and Highways Code) City Council Minutes, October 18, 19,83 - Page 3 Assistant City Manager Kimbrough presented background information stating City Council, at their regular meeting held September 20, 1983, set public hearing for the reconstruction of the public alley between El Monte Avenue and Persimmon. The petition for the recon- struction was returned with the approval of property owners repre- senting 82.527 of the front footage in favor of the reconstruction. A Negative Declaration of Environmental Impact was prepared in accord- ance with the requirements of the California Environmental Quality Act. The Los Angeles County Road Department has estimated the cost of reconstruction at $11,000 and pursuant to Chapter 27 the City is requesting that property owners assume one -half of the construction costs which are estimated to be approximately $3.32 per lineal foot of frontage property facing the alley. Property owners have been notified of the public hearing and are aware of the estimated costs Councilman Atkins inquired of staff if any contacts with the City of El Monte about participating from the southerly City boundary farther south to Lower Azusa Road have been made; and if they would participate, if it would affect the schedule. Assistarit City Manager Kiinbrough stated he would contact El Monte to see if they wanted to participate and did not feel any deviation in our schedule would result if they did. Mayor . Gillanders declared the public hearing open and invited anyone wishing to speak to come forward. Geoffrey Simpson, 4921 Persimmon. Avenue, stated the water main has caused numerous problems in the past due to seepage and was inquiring if that problem would be solved prior to paving of the street and also if an effort will be made to meet the apron grades to the garages. Mayor Gillanders stated Southern California Water Company is aware of the problem and has agreed to lay anew water main prior to paving of the alley assuming they will not encounter any budgetary constraints. Also, they should be able to utilize the existing aprons to the garages by varying the grade. Ruth Jenkins, 4938 El. Monte, stated there is always flooding at this property since it is located at the lower portion of the grade. Mayor Gillanders responded that in all likelihood they will have to re- engineer the entire alley since it slopes in a series of downsteps and if they find properties too low, adjustments can be made by the construction of a concrete center gutter whereby water can be diverted down the middle and requested staff make a notation to the engineers regarding flooding problems of some of the residents. Mayor Gillanders stated in talking to some of the residents at the end of Grand Avenue between El Monte and the alley on the south side of Grand, they expressed concern for the safety of pedestrians, especially children when walking to Cleminson School due to the overgrowth of vege- tation which has protruded into the street thereby completely eliminat- ing the walking area resulting in a hazardous pedestrian situation. Council concurred with Councilman Dennis' suggestion that due to the pedestrian safety factors involved, steps should be taken now to imple- ment the removal of the overgrowth and not delay it until reconstruction of the alley takes place and instructed staff to further inspect the area. Councilman Atkins moved to close public hearing; approve the Negative Declaration; find the project is in the best interest of the public; adopt Resolution No. 83 -2202 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ORDERING THE CONSTRUCTION OF CERTAIN IMPROVEMENTS PURSUANT TO SECTION 5870 ET SEQ. OF THE STREETS AND HIGHWAYS CODE; and instruct the Superintendent of Streets to cause the work to be accom- plished and to report on the improvements when the work is completed, seconded by Councilman Swain and unanimously carried. 7. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Reverend Albert Frederico, Associate Pastor, Temple City Seventh -day Adventist Church, stated that on behalf of the Health and Risk Evalua- tion Program which will be held on October 30 at the Temple City Seventh -day Adventist Church, Mayor Gillanders was being presented wit a complimentary pass for the complete testing series comprised of a treadmill test, blood chemistries test and a lung function test. Mayor Gillanders expressed his appreciation, thanked Reverend Frederico and stated it is a marvelous opportunity for the residents of the com- munity and a great public service. Jim Roth, 5822 North Sultana, stated they have initiated a petition regarding the parking situation at Edwards Theatre which will be heard at the next Traffic Commission meeting. He was here this evening to impress upon Council how strongly the residents who live in the sur- rounding area of the theatre feel regarding the noise which disrupts their entire families into late evening hours. Mayor Gillanders stated the City recognizes that a problem does exist, however, City Council would like to receive the professional expertise of the Traffic Engineer. and Traffic Commission prior to the time Council takes action. RECESS TO CRA: At this time, Council recessed to meet as the Community Redevelopment Agency, approved the minutes of the regular meeting of October 4, 1983, and adopted resolution approving warrants and demands. The minutes are set forth in full in the records of the Agency. RECONVENE AS CITY COUNCIL: • 10. ACTION ON REQUEST BY CRA: There was no action to be taken. 11. MATTERS FROM CITY OFFICIALS: A. REQUEST FOR LEAVE OF ABSENCE FOR MARILYN PROCK Councilman Atkins moved to authorize the final extension of the leave of absence without pay for Marilyn Prock through October 31, 1983, seconded by Councilman. Dennis and unanimously carried. B. SOUTHERN CALIFORNIA EDISON COMPANY - RELICENSING OF HYDRO- ELECTRIC FACILITIES Councilman Atkins referred to correspondence from the Edison Company regarding request for a resolution supporting the recent Federal Energy Regulatory Commission (FERC) decision that. "preference" (by the 1920 Federal Power Act is given to state and municipalities competing with a utility for an original license to construct a hydroelectric plant) does not apply to relicensing. It was also requested the reso- lution support Edison's current applications to relicense two projects located near. the Mammoth Mountain area. Councilman Atkins moved that staff redraft Southern California Edison's proposed resolution for adotpion at the November 1 City Council meeting, seconded by Councilman Swain and unanimously carried. C. SISTER CITY Mayor Gillanders stated he had received a communication from our pro- posed Sister City in Hawkesbury Shire indicating they would be visit - ing.Temple City for our Camellia Festival.
