The Regular meeting of the Bal Harbour Village Council was held at
9:30 A.M., Tuesday, May 28, 1985.
Present: Mrs. Antiles and Messrs. Laikin, McKeehan, Sherman and Taplin
Also present were: John F. Kelly, Acting Village Manager; Alan S. Gold,
Village Attorney; and Betty Carver, Deputy Village Clerk.
On motion of Mrs. Antiles, seconded by Mr. Taplin, and unanimously voted,
the minutes of the meetings of April 30, 1985 and May 7, 1985 were approveed.
Mayor Sherman asked Acting Manager Kelly to give

Mr. Kelly also reported that a financial settlement with the Bal Harbour
Shops on a 50-50 basis has been reached for the Italian Gala 1985.
A proposed ordinance was read by title only by Mr. Gold amending Chapter 16,
Article II of the Village Code, (Local Improvements) to provide for security
assessments. On motion of Mrs. Antiles, seconded by Mr. Taplin and voted,
the ordinance passed on first reading.

Alan Gold suggested that the decision on the rate to be used in the
computation of lump sum payments for pensions be deferred until such time
as the revised pension ordinance is adopted.
Mayor Sherman reported that the new signs for the apartment houses on
the west side of Collins Avenue will be installed by June 1st.
George Desharnais reported on the status of the new entrance signs for
the Village. The plans are to be ready before the end of May. Ludovici &
Orange are redesigning the sign and the method of construction.
George Desharnais gave a report on his findings on the installation of
smoke alarm systems to central consoles in the high rise apartment buildings.
Broward and Palm Beach Counties do not have an ordinance requiring this be
done in buildings, it is completely voluntary. Mr. Desharnais has found a
company who would do the installation for $300.00 per apartment unit, in-
cluding the panel. He is to do further study on the installation.
Mr. Sherman said that a report from the Resort Tax Advisory Committee
meetings which have been held indicates that the allocation of the 3% Resort
Tax being collected should be 1% earmarked for beach nourishment and 28 be
earmarked for beach maintenance and advertising.

Mr. Lou Brandt of the Regency Hotel Spa asked to have the floor and ex-
pressed his opinions on the quality of the advertising for Bal Harbour and
the selections of the placement of the ads. He stated that his hotel and the
Singapore Hotel did not benefit from the advertising being run in magazines
such as "Architectual Digest" and "Gourmet", etc. He feels that the ad-
vertising money could be better spent advertising in the travel section
of such newspapers as the New York Times, Chicago Tribune, St. Louis Post
Dispatch, etc. Mr. Sherman assured Mr. Brandt that his comments would cer-
tainly be taken into consideration.
Mr. Kelly explained that new parking meters are being purchased for the
west parking lots and he recommends that the rate be changed to two hours
for one quarter. It was moved by Mr. McKeehan, seconded by Mrs. Antiles and
voted that the parking meter rate be changed in the new parking lot as well
as under the Haulover Bridge, to two hours for one quarter.
Mr. Sherman asked Mr. Kelly to investigate hold harmless proviso and
legal cost reimbursement insurance for the Mayor and members of the Council.
He is to look into the cost, coverage, etc.
Mr. Sherman stated that he had many complaints from residents about
bicycle riders on the sidewalks. He has written a letter to the Florida
Department of Transportation requesting that the lanes on Collins Avenue be
restriped, both north and south, to reduce two of the lanes on each side
from 12' to 11' in order to allow for a 14' outside lane on each side of
Collins Avenue for bicyclists. Acting Chief Baquero said that the policemen
would enforce the bicycle law, checking for lights, etc. and prohibiting
bicycles from being ridden on the sidewalks. Mr. Gold will look into the
legality of this prohibition before any ordinance is proposed.
It has been recommended that fireworks be prohibited from being shot
from the beach, but from a platform 50'-100' offshore, by a firworksdisplay,
with proof of insurance, indemnifying Bal Harbour Village. Mr. Kelly has
been instructed to get expert advice on this subject.
Acting Chief Baquero stated that there is no longer a check being done
on fingerprints taken for ID cards. He further stated that we charge $2.00
for each card, when, in fact, it costs $4.50 to issue one. Mr. Gold is to
research this issue to update his earlier legal opinion. Mr. Kelly and
Chief Baquero are to meet with the security chiefs of all buildings and the
Bal Harbour Shops.
On motion of Mrs. Antiles, seconded by Mr. McKeehan the meeting was
adjourned at 11:30 A.M.
