HomeMy Public PortalAbout1999-02043 Member Jim Johnson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.99-20 RESOLUTION GRANTING AMENDED CONDITIONAL USE PERMIT TO HOLY NAME OF JESUS CATHOLIC CHURCH WHEREAS, Holy Name of Jesus Catholic Church (the "Applicant") is the fee owner of land in Medina located at the intersection of Co. Rd. 24 and Brockton Lane (the "Subject Property"); and WHEREAS, the Applicant operates a church and school on the Subject Property, pursuant to a conditional use permit; and WHEREAS, the Applicant has requested permission to expand the church and school facility, which expansion requires an amendment to its conditional use permit; and WHEREAS, this matter was reviewed by the planning commission at its meetings of November 10, 1998 and December 8, 1998 and by the city council at its meeting on January 5, 1999; and WHEREAS, it has been determined that granting the requested amendment to the Applicant's conditional use permit for the stated purpose will not adversely impact the development of adjacent properties for the purposes for which they are currently zoned. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that an amended conditional use permit be granted to the Applicant for the purpose of allowing an expansion of the church and school on the Subject Property, subject to the following terms and conditions: 1. The building expansion may not exceed a total of 88,000 square feet; RHB-156428 ME230-285 99-20 04-06-99 44 2. The Applicant must make the improvements to the intersection of Co. Rd. 24 and Brockton Lane required by the Hennepin County Road Department and the Medina public works director, city engineer, and police chief. The Applicant must make arrangements with the Medina police department to use an officer to direct traffic after church services and special events; 3. No parking is allowed in the parking lot on the north side of Co. Rd. 24 except for special events, not to exceed four per year, and upon notification of the Medina police chief; 4. The site plan must be reviewed and approved by the Minnehaha Creek Watershed District; 5. The Applicant must submit to the city engineer for review and approval the storm water calculations and water quality and storage area calculations for the site; 6. The westerly parking area on Co. Rd. 24 must be reconfigured so that there is only one point of egress to Co. Rd. 24 and so that school buses can maneuver through the lot. The construction specifications for the easterly parking lot expansion and driveways must be approved by the city engineer; 7. The building expansion and site improvements must be constructed to meet building and fire code requirements; 8. Additional spruce trees must be provided on the north side of the easterly parking area to provide screening from residential properties. The landscaping shall consist of two rows of eight foot Black Hills spruce, 12 feet on center, the exact location of which is dependent on the location of the access point. Berming and landscaping along Brockton Road will start south of the trees in a location to be approved by city staff. Eight foot Black Hills spruce trees or other appropriate landscaping must be provided to the neighbors on the east side of Brockton Lane to be used for landscaping their properties to screen their properties from the parking lot; 9. There shall be no parking on Holy Name Drive, Co. Rd. 24, or Brockton Lane, in accordance with the requirements of the Medina public works department and the police chief; 10. Additional landscaping within the parking areas must be provided, including islands with trees, to be approved by city staff in order to minimize the visual impact on the surrounding properties; 11. All areas not covered by hard surface must be seeded and maintained. All landscaping must be maintained and plant materials which die must be replaced; 12. Security lighting on the site must be controlled by a light sensor. All other exterior lights must be placed on a rimer. No exterior lighting shall be permitted when the building is not in use other than the exterior security lighting. Egress lighting shall average .5 foot candle at the building; RHB-156428 ME230-285 99-20 04-06-99 45 13. All garbage and recycling containers must be located inside a permanent enclosure on a concrete surface with an exterior material compatible with that used for construction of the main building; 14. All plans must be reviewed and approved by the Medina chief of police; 15. There shall be no outside loud speakers or amplified sound systems other than the ringing of the church bell in the pylon, which is limited to special occasions; 16. The buildings and grounds shall be used only for church -related activities. Special events will require a special use permit even though they are sponsored by the Applicant; 17. Exterior building materials must meet building code requirements; 18. There shall be no permanent residential use of the building expansion area; 19. All construction on the site shall meet the city building requirements; 20. All exterior lighting must be downcast only with the fixture designed and installed so that the lighting is recessed and enclosed on all sides except for the bottom and no light is directed directly on any other property or public right-of-way. Existing exterior fixtures must be brought into conformance with this requirement prior to issuance of a certificate of completion on this project. The lighting shall be designed and installed in accordance with plans submitted by the Applicant and with the recommendation of city staff. Artificial light contribution to the property line shall be zero foot candle; 21. The applicant must submit to the city a letter of credit in an amount to be determined by the city engineer to cover all site improvements and exterior lighting; 22. The Applicant must comply with the terms and conditions of the approved site plan, which is hereby incorporated by reference; 23. This conditional use permit may be reviewed annually or as deemed necessary to ensure compliance with the conditions set forth herein. Violations of the terms of this conditional use permit may result in the imposition of additional conditions; 24. The Applicant must pay to the city an administrative fee sufficient to reimburse the city for the cost of reviewing the application; and 25. The Applicant must submit its proposal to the city of Plymouth, the Metropolitan Council, and the Minnehaha Creek Watershed District to determine if there are additional SAC fees required prior to issuance of a building permit. RHB-156428 ME230-285 99-20 04-06-99 46 NOW, THEREFORE, BE IT FURTHER RESOLVED, by the city council of the city of Medina that this resolution supersedes Resolution Nos. 82-14, 86-41, 90-43 and 91-54 relating to the Subject Property.
