HomeMy Public PortalAbout1999-02453 Member Zietlow introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.99-24 RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO VALVOLINE INSTANT OIL CHANGE WHEREAS, Valvoline Instant Oil Change (the "Applicant") has requested permission to construct a 57'4" by 34' building to be located at 215 Clydesdale Trail on Lot 1, Block 1, Cate's Medina Addition (the "Property"); and WHEREAS, construction and operation of a commercial automotive facility of this nature requires a conditional use permit under the city's zoning ordinance; and WHEREAS, this matter was reviewed by the planning commission at its meeting on March 9, 1999 and by the city council at its meeting on April 6, 1999; and WHEREAS, it was determined that the Applicant's proposal will not adversely impact adjacent properties for the purposes for which they are currently zoned. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that a conditional use permit be issued to the Applicant for the stated purpose, subject to the following terms and conditions: 1. The total square footage of the building to be constructed on the Property shall not exceed 2300 square feet on the main level; 2. The Applicant must comply with all requirements of the Elm Creek Watershed District; 3. The Applicant must comply with all requirements of the Medina city engineer; 4. All exterior lighting must be downcast only (shoebox style) with all sides enclosed except the bottom and the globe and light source may not be visible from other properties; 5. All exterior lighting must meet the lighting and glare ordinance requirements of the city; 6. The NURP pond may be used as long as it is maintained on the Property; RHB-161459 ME230-291 99-24 04-20-99 54 7. The parking lot lighting and barrel lighting on the building must be turned off at 10:00 p.m. and may not be turned on until 7:00 a.m. the following day; 8. The barrel lighting on the building must be made of dark translucent material and may not include more than 400 watts of lighting on each of the north and south sides (total of 800 watts); 9. The maximum height of any exterior light pole is 20 feet; 10. The paving and curbs must be constructed in accordance with the requirements of the city engineer; 11. No building permit will be issued to the Applicant until Clydesdale Trail is graded and the base material is installed to the satisfaction of the city engineer; 12. No occupancy of the building will be allowed until the parking lot, cul de sac, storm sewer, sanitary sewer, and water improvements and the grading, base and first lift of paving for the street have been completed to the satisfaction of the city engineer; 13. The building must be constructed to meet all building and fire code requirements of the city; 14. The Applicant must pay for two additional SAC units and two sewer and water connection fees to the city of Medina prior to issuance of the building permit; 15. Four 2 1/2" maple trees must be installed by the Applicant on the Property adjacent to Clydesdale Trail and all landscaping on the Property must be maintained or replaced if it dies; 16. No outside bells or outside speakers shall be permitted on the Property; 17. No outside storage shall be permitted on the Property; 18. The maintenance plan for the flammable waste trap must be reviewed and approved by the city staff; 19. The city will not require screening of the rooftop ventilator because the ventilator will not be visible from other properties; 20. No business may be conducted on the site until all conditions of this permit have been met, as verified by the city staff; 21. The final plat must be approved and filed with Hennepin County before this conditional use permit is finalized; RHB-161459 ME230-291 99-24 04-20-99 55 22. The city will require a development agreement in a form satisfactory to the city attorney with an escrow in a sufficient amount to pay for the site, sanitary sewer and water line improvements; 23. Violation of any term or condition of this conditional use permit shall be deemed to be a violation of the city zoning ordinance and shall be grounds for termination or revocation of this permit; and 24. The Applicant must pay to the city a fee in the amount determined by the city staff to represent the cost to the city of reviewing this conditional use permit. Dated: April 20, 1999.
