Home My Public Portal About2003-17 - ALLEY BETWEEN 430 AND 436 ANDERSON ST�%- ;r ORDINANCE 2003- /1 � AN ORDINANCE APPROVING THE VACATION OF ALLEY BETWEEN 430 AND 436 ANDERSON STREET IT WHEREAS, Glen and Edith Welliver are owners of certain real estate located in the area under jurisdiction of the Common Council of the City of Greencastle; and and WHEREAS, there are certain public ways contiguous to and contained within said real estate; WHEREAS, a list of abutting or nearby land owners of the property wherein the public way lies is attached hereto and made a part hereof as Attachment A; and WHEREAS, the public way to be vacated lies wholly within the jurisdiction of the Common Council of the City of Greencastle, Indiana; and WHEREAS, the Plan Commission of the City of Greencastle, Indiana, did at its regular meeting held September 22, 2003, approve the petition of Glen and Edith Welliver for the vacation of the alley and right of way located in the city of Greencastle, Indiana; and WHEREAS, the Common Council of the City of Greencastle, Indiana, pursuant to law, published notice that this matter would come before the common council for a public hearing at the � regular meeting of the Common Council to be held Tuesday, October 14, 2003, at 7:00 p.m. at the Greencastle City Hall, One North Locust Street, Greencastle, Indiana; and WHEREAS, the adjoining property owners have consented to, or have been notified pursuant to statute, as to the vacation of the public way; and WHEREAS, the Common Council of the City of Greencastle, Indiana, has, after public hearing, determined that vacating the following described public way is in the public and economic interest of the City of Greencastle, such closing will not reasonably interfere with the flow of traffic for the City of Greencastle road system, and that the relief requested in said petition should be granted, and that the portion of the described public way located in the City of Greencastle, Indiana, should be vacated. NOW THEREFORE be it ordained by the Common Council of the City of Greencastle, Indiana, that the following alley and right of way located in the City of Greencastle, Putnam County, Indiana, and more particularly described as follows: Situate in the State of Indiana, County of Putnam and being a part of Lynch's Second Survey to the town (now City) of Greencastle, Indiana more particularly described to- wit: " Beginning at the Northwest. corner of Lot 7 in Lynch's Second Survey of Lots numbered 77, 78, and 79 in the Eastern Enlargement to the Town, now City, of • Greencastle, Indiana; thence South with the West line of said Lot 7, 200.0 feet to the Southwest corner thereof; thence West 12.0 feet to the Southeast comer of Lot 8 in said Lynch's Second Survey; thence North 200.0 feet with the East line of said Lot 8 to the Northeast corner thereof; thence East 12.0 feet to the point of beginning, containing 0.06 of an acre, more or less. are hereby vacated as a public right of way of the City of Greencastle, Putnam County, Indiana, and that such land shall cease to be a public alley or right of way, and that title to such vacated land shall revert to the proper landowners pursuant to law. This Ordinance shall have full force and effect of law immediately upon its passage by the Common Council of the City of Greencastle, Indiana.
