RESOLUTION N0. 66,- .
RESOLUTION OVERRULING PROTESTS IN CONNECTION
. WITH THE HEARING ON DEBT LIMITATION FOR TI-lE
. PROPOSED IMPROVEMENT OF DUNCAN AVENUE ET AL,
, BETWEEN FERNWOOD AVENUE AND LAVINIA AVENUE
BY THE CONSTRUCTION OF.CONCRETE CURB AND
GUT'I'ER AND DRIVEWAY APPROACHES, TOGETHER
WITH ALL INCIDENTAL AND APPURTENANT WORK. �
WHEREAS, the City Counoil of the City of Lynwood did,
' on the 15th day of March 1g66 approve an investigation report
under thejprovisions of Division 4 of the Streets and Highway Code,
_ cited a.s ° Special Assessment Investigation, Limitation and Ma.jority
Protest Act of 1931," as amended, upon the proposed improVement of
Dunean Avenue et al, befween Fernwood•AVenue and Lavinia Avenue, '
by the construction of conerete curb and gutter and driveway
approaches, together with all incidental a.nd appurtenant work, a.s �
� shown on Plan No. 1966-F-3 on file in the office of the City Clerk '
of said city, a.nd
WHEREAS, said report having been duly prepared and £iled,
._ a.,hearing wa,s held by sa,id City Council on the 19t,h day of April,
1g66 in .the manner provided,in said Act above referred to, and
WHEREAS, more than thirty days have expired since the
date of ma,iling notices of hearing on said report,
.NOW, THEREFORE, the City Council of the City of Lynwood
does hereby resolve as follows:
1. That the protests made at said hearing on said
investigation report be,and the same are hereby overruled;
2, That the public interest, convenience, and necessity
require the doing and making of the public improvement set forth
and described in said report ab.ove referred to and substantia,lly
in the manner set forth; �
3. That•the project consisting of the proposed
improvement above referred to is,fea'sible, and tha.t the la.nd to
, be assessed will b'e'able to carry the burden of said proposed
..
assessment; - �
4. That the estimated total amount proposed to be ,
assessed upon any or all lots or parceTs of'_land for the costs and
expenses'of said'proposed improvement does not exceed the limita.tion
of indebtedness established and set forth in said a.ct above referred.
- to and will not, by the levy thereof, cause said limitation to be
exceeded in'any instance; '
5. Tha,t no majority protest has been filed with the ,
� Clerk of the legislative body by the owners of the property proposed
to be assessed to pay the costs and expenses of said proposed
improvement;
, 6. ,That it is hereby ordered that the proceedings for �
the making of sa.id proposed,improvement be undertaken pursuant to,
the provisions of an Act' of the Legislature of the State of � '
I California designated as Division 7 of�the.,Streets`and Highways
Code, cited as the "Improvement Act of 1911, and amendments thereto".
