Member Zietlow introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO.99-34
RESOLUTION GRANTING VARIANCE TO TOM
TURNHAM FOR THE PROPERTY AT 1512 DEERHILL
ROAD
WHEREAS, Tom Turnham (the "Applicant") is the owner of property located at 1512
Deerhill Road (the "Property"); and
WHEREAS, the Applicant has proposed to subdivide the Property into two lots; and
WHEREAS, the city's zoning ordinance requires five acres of good soils in conjunction
with a mound septic system whereas only two acres for a trench septic system; and
WHEREAS, the Applicant has proposed to create a lot which has less than the required
acreage of good soils to be used with a mound system; and
WHEREAS, this matter was reviewed by the planning commission at its meeting on May
11, 1999 and by the city council at its meeting on May 18, 1999; and
WHEREAS, it has been determined that granting the Applicant's request for a variance
will not adversely impact the development of adjacent properties for the purposes for which they
are zoned.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota, that a variance be granted from the city's soils requirements to the Applicant for the
Property, subject to the following terms and conditions:
1. The Applicant must utilize the variance by subdividing his Property within one year
of the date of this resolution or the variance hereby granted will be null and void; and
2. The Applicant must pay to the city an administrative fee in the amount necessary to
reimburse the city for the cost to review and approve this application.

NOW, THEREFORE, BE IT FURTHER RESOLVED by the city council of the city of
Medina, Minnesota, that the variance hereby granted is justified by the hardship to the Applicant of
having been assessed for two buildable lots in connection with the Tamarack Drive road
improvement project. It is further noted that this is consistent with other land use discussions
concerning properties divided prior to July 1, 1999, and that there is a functional septic system on
tract B and if it were to fail soils on tract A would not need to be used for a new system.

The motion for the adoption of the foregoing resolution was duly seconded by member Hamilton
and upon vote being taken thereon, the following voted in favor thereof:
Ferris, Hamilton, Johnson, and Zietlow
and the following voted against same: None Absent: Smith
Whereupon said resolution was declared duly passed and adopted.
