Q 1 CITY OF COMPTON £.ESOLUTION N0. 9154 2 CITY OF LYNWOOD RESOLUTION N0. 66-63 ''_' 3 : JOINT R�SOLUTIONS OF THE CITIES OF COMPTON AND 4 LYNWOOD,_MUNICIPAL CORPORATIONS, AGREEING TO AND REQUESTING THE CALIFORNIA STATE BOARD OF ;., 5 EQUALIZATION TO APPORTION LOCAL SALES TAXES IMPOSED PURSUANT�TO THE BRADLEY-BURNS UNIFORM 6 LOCAL SALES AND USE TAX LAW.WITH RESPECT TO TAXABLE SALES RECEIPTS OF SEARS, ROEBUCK.AND CO., 7 AT THE PREMISES COMMONLY KNOWN AS 2100 NORTH LONG BEACH BLVD., COMPTON, CALIFORNIA. 8 . . . 9 WHERE:AS, the CITY OF COMPTON and the CITY OF LYNWOOD 10 have each heretofore adopted Ordinances under the provisions of 11 the Bradley-Burns Uniform Local Sales and Use Tax Law and each of 12 such Cities has contracted with the State Board of Equalization 13 to perform all functions incident to the administration and 14 operation of the sales and use tax ordinance, and 15 WHEREAS, the territorial boundary lines of said two �-'- - , 16 Cities bisect the Automotive Sales and Service Department of the � 17 Sears, Roebuck and Co. retail store at the premises commonly 18 known as 2100 North Long Beach Blvd., Compton, California, and 19 by reason of that fact it has become necessary to make a fair and 20 equitable division of retail sales tax revenues arising by reason 21 of retail sales effected by said Automotive Sales and Service 22 Department, and 23 WHEREAS, Sears, Roebuck and Co. reports and pays its 24 sales tax on the total gross sales for the entire retail store, � 25 only one portion of which and one department is bisected by the 26 common boundary of said two cities; that approximately 3.75% of � 27 the total taxable sales of the entire retail store is attributabl r- � 28 to the Automotive Sales.and Service Department and that approxi- 29 mately 48% of the building area housing said department is 30 physically situated in the City of Lynwood and.the balance is 31 situated in the City of Compton. 82 NOW, THEREFORE, BE IT RESOLVED that the City Councils -1- i 1 of . the Cities of Compton and Lynwood do find and determine and 2 agree: ' 3 SECTION 1. Tfiat 2% of the total sales tax revenue due 4 said Cities under,and by virtue of the Ordinances of said Cities 5 adopted pursuant.to the Bradley-Burns Uniform Local Sales and Use 6 Tax Law, due and as a result of retail sales of the entire Sears, 7 Roebuck and Co. retail store situated at 2100 North Long Beach 8 Blvd., Compton, California, be allocated, credited to and paid 9 to the City of.Lynwood, and the remaining 98% thereof be allocated 10 credited to and paid to the City bf Compton. • 11 SECTION 2. That upon adoption by both of said Cities 12 of this Join't Resolution, that a certified copy hereof be for- 13 warded to the State Board of Equalization together with the 14 request that it allocate, credit, and pay to the respective Cities � 15 that portion of total sales tax revenues above provided. .' 16 SECTION 3.
