HomeMy Public PortalAbout1999-03581 Member Zietlow introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.99-35 RESOLUTION GRANTING PRELIMINARY PLAT APPROVAL TO GARY KIRT WHEREAS, Gary Kirt (the "Applicant") is the fee owner of property located at 1595 Hamel Road (the "Property"); and WHEREAS, the Applicant has requested permission to plat the Property into three lots; and WHEREAS, this matter was reviewed by the planning commission at its meeting on May 11, 1999; and WHEREAS, this matter has been reviewed by the city council for its compliance with the ordinances and requirements of the city. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, that preliminary plat approval is hereby granted to the Applicant for the plat of the Property, subject to the following terms and conditions: 1. The Applicant must pay a park dedication fee for Lot 3; 2. The final plat must dedicate standard drainage and utility easements on all property lines; 3. Additional right of way for Hamel Road must be dedicated on the final plat as required by the city engineer; 4. The shed on Lot 3 must be removed before final plat approval; 5. All structures not meeting the 150' setback must be removed if they are to be used for animals; 6. It is recognized that the stable meets the 150' setback; RHB-163725 ME230-297 99-35 06-01-99 82 7. The Applicant must dedicate on the final plat right-of-way for the potential new road along the western border of the Property. The right-of-way shall be 35' in width from the north Property line and widen to 60' at the southern end of the Property to accommodate a driveway for two lots to Blackfoot Trail; 8. The Applicant must pay to the city an administrative fee in an amount necessary to reimburse the city for the cost of reviewing and approving this subdivision; and 9. The Applicant must submit the final plat for approval to the zoning administrator within 180 days of the date of this resolution or the approval hereby granted shall be null and void. The final plat must be in compliance with the terms and conditions of the preliminary plat approval and of the ordinances and other requirements of the city. Dated: June 1, 1999.
