Mayor Chavez called the Regular City Council meeting to order at 7:33 p.m. 2. ROLL CALL PRESENT: Councilmember-Fish, Man, Sternquist, Yu, Chavez ABSENT: Councilmember-None ALSO PRESENT: City Manager Cook, City Attorney Vail, City Clerk Kuo, Administrative Services Director Hause, Community Development Director Forbes, Parks and Recreation Director Burroughs, and Assistant to the City Manager I Economic Development Manager Haworth Mayor Chavez and City Council held a moment of silence for the victims of the San Bernardino attacks. 3. INVOCATION Pastor Jim Walden, First Baptist Temple City, provided the Invocation. 4. PLEDGE OF ALLEGIANCE Troop 161 led those present in the Pledge of Allegiance. 5. CEREMONIAL/PRESENTATIONS A. LONGDEN ROBOTICS TEAMS-EPIC Tigers and Majestic TACO EPIC (Enthusiastic Positive Intelligent Creative) Tigers and TACO (Technically Awesome Creative Organization) each gave a presentation they developed regarding engineering solution to pervasive problem of food waste and growing global issue of e-waste. 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Jing Li, Temple City Library Manager, announced upcoming library events for the month of December. City Council Minutes December 15, 2015 Page 2 of 11 Jessica Huang, Temple City Youth member, shared with City Council the objectives for the Youth Committee and announced upcoming Youth Disaster Preparedness Training on January 8,9, and 10. 7. CONSENT CALENDAR Mayor Pro Tem Yu made a motion to approve the items on the consent calendar. APPROVAL OF MINUTES The City Council is requested to review and approve: 1) Minutes of the City Council Study Session Meeting of December 1, 2015; and 2) Minutes of the Regular City Council Meeting of December 1, 2015. Action: Approved. B. PARKS AND RECREATION COMMISSION ACTIONS -MEETING OF NOVEMBER 18, 2015 The City Council is requested to review the Parks and Recreation Commission actions of their meeting of November 18, 2015. Action: Received and filed. C. PLANNING COMMISSION ACTIONS-MEETING OF DECEMBER 8, 2015 The City Council is requested to review the Planning Commission actions of their meeting of December 8, 2015. Action: Received and filed. D. FINAL SUBDIVISION MAP APPROVAL FOR TRACT MAP NO. 66051, A SUBDIVISION PROJECT FOR THE CONSTRUCTION OF FIVE DETACHED CONDOMINIUM UNITS AT 5138-5148 SERENO DRIVE City Council Minutes December 15, 2015 Page 3 of 11 Approval of the final map will allow the developer to finalize the subdivision map and start construction of the project. Action: 1) Received the Subdivision Improvement Agreement; 2) Approved the final subdivision map for Tract Map No. 66051; 3) Authorized the City Manager to execute the Subdivision Improvement Agreement; and 4) Authorized the City Clerk to certify Tract map No. 66051. E. FINAL SUBDIVISION MAP APPROVAL FOR PARCEL MAP NO. 72861, A FLAG LOT SUBDIVISION FOR THE CREATION OF TWO SINGLE-FAMILY LOTS AT 10525 FREER STREET Approval of the final map would enable the developer to finalize the subdivision, and obtain building permits for the construction of a single-family house on each parcel. Action: 1) Received the Subdivision Improvement Agreement; 2) Approved the final subdivision map for Tract Map No. 72861; 3) Authorized the City Manager to execute the Subdivision Improvement Agreement; and 4) Authorized the City Clerk to certify Tract map No. 72861. F. REVIEW AND APPROVAL OF LIVE OAK PARK JOGGING PATH DESIGN PLANS AND AUTHORIZATION TO BID Approval of the design of the Walking/Jogging Path and solicitation for construction bids will allow staff to complete the project prior to the June 30, 2016, grant fund deadline. Action: G. VISA CARD REPORT Approved the design plans submitted by Community Works Design Group and authorize staff to solicit construction bids for the Live Oak Park Jogging Path Project. The City Council is requested to review, receive and file the Visa Card Report. Action: Received and filed report. City Council Minutes December 15, 2015 Page 4 of 11 H. ADOPTION OF RESOLUTION NO. 15-5138 APPROVING PAYMENT OF BILLS The City Council is requested to adopt Resolution No. 15-5138 authorizing the payment of bills. Action: Adopted Resolution No. 15-5138. Mayor Chavez changed the order of the meeting and heard items for the Successor Agency out of agenda order. 17. RECESS TO SUCCESSOR AGENCY TO THE TEMPLE CITY COMMUNITY REDEVELOPMENT AGENCY MEETING At 8:02p.m., the City Council recessed to the Successor Agency Meeting. Minutes of the Successor Agency Meeting are set forth in full in the Successor Agency's records. RECONVENE AS CITY COUNCIL The City Council meeting was reconvened at 8:09 p.m. with all Councilmembers present. 8. PUBLIC HEARING A. APPEAL OF PARKS AND RECREATION COMMISSION DECISION TO NOT REMOVE A VALLEY OAK TREE LOCATED AT 9836 ESTRELLA AVENUE The Parks and Recreation Department received a request from the property owner requesting that the City-owned Valley Oak tree located in front of their home be removed. Parks and Recreation Director Burroughs gave a brief summary of the staff report. City Council asked staff questions regarding the tree removal. Mayor Chavez opened public hearing. Patrick Tilakamonkul and Chuang Chen, appellant, spoke regarding their request to remove the Valley Oak tree on their property. Councilmembers asked Mr. Tilakamonkul and Mrs. Chen questions regarding their request. City Council Minutes December 15, 2015 Page 5 of 11 Steve Stafford, Temple City resident, spoke in favor of upholding the Parks and Recreation Commission decision to not remove the tree. Hearing no further request to speak, Mayor Chavez closed public hearing. City Council commented and discussed regarding the request for tree removal. City Attorney Vail answered Councilmember's question regarding if removal of the tree based on religious belief would set precedence in the City. He spoke briefly regarding "Reasonable Accommodation" and Religious Land Use Institutional Person's Act" but did not feel either of these applies to the appellant's situation. Mayor Pro Tern Yu made a motion to approve the removal of the Valley Oak and replanting of another tree on City's right-of-way, provided that the homeowner pays for all the expenses. Seconded by Councilmember Man and approved by the following votes: AYES: ABSTAINED: NOES: ABSENT: Councilmember: Man, Yu, Chavez Councilmember: None Councilmember: Fish, Sternquist Councilmember: None City Council recessed the meeting at 9:04p.m. and reconvened at 9:11 p.m. with all Councilmembers present. 9. UNFINISHED BUSINESS-None 10. NEW BUSINESS A. UPDATE ON POTENTIAL NEW CHILDREN'S LIBRARY Several upgrades to the current library have taken place for the last few years, but the overall space of the current library is outstripping its current needs and demands. Councilmember Sternquist spoke regarding her meetings with Supervisor Antonovich and his staff regarding a new children's library for the City. She requests City Council to consider partnering with the County for this unique concept and opportunity. City Manager Cook gave a brief presentation on potential sites in the City for a new Children's Library. City Council Minutes December 15, 2015 Page 6 of 11 Councilmembers asked questions regarding the potential sites for a new Children's Library. Mayor Chavez opened public comment. Munir Bhatti, Temple City resident/President of the Friends of the Library, commented on building on top of the current library structure and about various Children's Libraries he's visited. Jerry Jambazian, Temple City business owner, commented on separating the Children's Library from the current library. Mayor Chavez shared that City Council did receive 3 emails supporting a new Children's Library. City Council discussed and commented regarding the potential of a new Children's Library. Councilmember Fish made a motion to receive and file the report, directed staff to continue to work with the County for a new Children's Library, and continue to explore potential sites for the new Children's Library. ADOPTION OF ORGANIC WASTE RECYCLING PROGRAM Resolution No. 15-5136 adopts a program for recycling of organic waste for businesses in the City as required by Assembly Bill 1826. Community Development Director Forbes gave a brief summary of the staff report. Mayor Chavez opened public comment. Hearing no request to speak, Mayor Chavez closed public comment. Councilmember Man made a motion to adopted Resolution No. 15-5136 adopting an organic waste recycling program. D. THIRD AMENDMENT TO THE DIGITAL BILLBOARD ADVERTISING AND AMORTIZATION AGREEMENT BETWEEN THE CITY OF TEMPLE CITY AND TEMPLE CITY GATEWAY, LLC The Third Amendment includes a new provision (section 8) that will allow Temple City Gateway, LLC, to pay the City an in-lieu payment if a canopy is not installed. Assistant to the City Manager/Economic Development Manager Haworth gave a summary of the staff report. Mayor Chavez opened public comment. Mayor Pro Tem Yu made a motion to approve the Third Amendment to the Digital Billboard Advertising and Amortization Agreement between the City of Temple City and Temple City Gateway, LLC, removing a canopy requirement as a performance benchmark for billboard operation; directed staff to request Planning Commission approval to amend Conditional Use Permit No. 11- 2332, removing the canopy requirement associated with property improvements at 5402 Rosemead Blvd.; and upon Planning Commission approval of the amended Conditional Use Permit, authorize the City Manager to execute the Third Amendment with Temple City Gateway, LLC. REDEVELOPMENT OPTIONS FOR 5800 TEMPLE CITY BOULEVARD The City Council will discuss redevelopment options for 5800 Temple City Boulevard. Assistant to the City Manager/Economic Development Manager Haworth gave a summary of the staff report. City Council Minutes December 15, 2015 Page 8 of 11 City Council discussed and commented regarding the options for 5800 Temple City Boulevard. Mayor Chavez opened public comment. Hearing no request to speak, Mayor Chavez closed public comment. City Council spoke in favor of converting the site to a parking lot. Councilmember Fish made a motion to receive the presentation and directed staff to work towards converting the site to a parking lot. INFORMATION ABOUT JOINING THE NATIONAL FLOOD INSURANCE PROGRAM In 1968, Congress created the National Flood Insurance Program to help provide means for property owners to financially protect themselves. Since standard homeowners insurance doesn't cover flooding, the National Flood Insurance Program offers flood insurance to homeowners, renters, and business owners. In order for residents to qualify for flood insurance, the City must participate in the National Flood Insurance Program. Public Safety Supervisor Ariizumi gave a summary of the staff report. City Council commented and discussed on the process to become eligible to join the National Flood Insurance Program. Mayor Pro Tem Yu made a motion to receive and file this report and direct staff to bring back additional information how the City can assist the residents to qualify for the National Flood Insurance Program. Edison Public Affairs Changes Shared that Southern California Edison has downsized their staff in the Public Affairs and we have a new customer service representative for the City. C. El Nino Update Reported on a recent meeting with local utility providers, local agencies and County regarding the upcoming El Nino season preparation. D. Community Events Complimented staff on the numerous successful Parks and Recreation events and thanked the Sheriffs for their assistance for the city events. 13. UPDATE FROM CITY ATTORNEY-None 14. FUTURE DEVELOPMENT OF CITY PROPERTIES STANDING COMMITTEE (Mayor Pro Tern Yu and Councilmember Man)-Formed 2/18/2014 No report. F. AUDIT STANDING COMMITTEE (Mayor Chavez and Mayor Pro Tern Yu)-Formed 7/15/2014 Mayor Pro Tern Yu reported on the standing committee's meeting regarding City's outside audit report. Staff will share result with City Council at a meeting in January or February. G. WATER CONSERVATION AD HOC (Mayor Chavez and Councilmember Fish) -Formed 6/2/2015 Mayor Chavez announced that the Ad Hoc will be meeting with the Youth Committee Water Conservation Working Group on Tuesday, December 22, 530 p.m. H. FACILITIES, PUBLIC WORKS, AND INFRASTRUCTURE AD HOC COMMITTEE (Mayor Pro Tern Yu and Councilmember Man) -Formed 2/4/2014 No report. I. DECORATIVE STREET DESIGN ELEMENT AD HOC COMMITTEE (Mayor Pro Tern Yu and Councilmember Man)-Formed 11/3/2015 No report. Mayor Chavez established an Ad Hoc for the New Children's Library and appointed Councilmember Fish and Sternquist to the Ad Hoc. Mayor Chavez also established an Ad Hoc to work with staff and City Attorney on next steps for amending City's Charter relating to City Council Term Limit. He appointed himself and Mayor Pro Tern Yu to the Ad Hoc. 15. COUNCIL ITEMS SEPARATE FROM THE CITY MANAGER'S REGULAR AGENDA A. COUNCILMEMBER FISH Commented on the successful Lights on Temple City event, congratulated the Longden Robotics Team for their accomplishments, and thanked City City Council Minutes December 15, 2015 Page 11 of 11 Manager for checking in with the Temple City Unified School District to make sure the schools were doing ok and not affected by the bomb threat the Los Angeles Unified School District received. B. COUNCILMEMBER MAN Commented on the successful Lights on Temple City event. C. COUNCILMEMBER STERNQUIST Commented on the potential new Children's Library and council's support for this project. D. MAYOR PROTEM YU -None E. MAYOR CHAVEZ Commented on the successful compost give-a-way this past weekend and wished everyone a happy holiday. 16.
