HomeMy Public PortalAbout15-9069 FORECLOSE ON MUNICIPAL CLAIMS AGAINST MILLER LEGG CAPTIAL HOLDINGS Sponsored by: City Attorney RESOLUTION NO. 15-9069 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, RATIFYING THE BROWN LAW GROUP, LLC'S INITIATION OF A LITIGATION TO FORECLOSE ON MUNICIPAL CLAIMS OF LIEN AGAINST MILLER LEGG CAPITAL HOLDINGS, LLC ON THE PROPERTY LOCATED AT 1700 SERVICE ROAD, THE CLAIM AMOUNT OF WHICH IS ESTIMATED AT $1.7M; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, The City of Opa-locka, Florida levied several code enforcement liens against the property located at 1700 Service Road, Opa-locka, Florida, on May 20, 2015, that is currently owned by Miller Legg Capital Holdings, LLC; WHEREAS, The Brown Law Group, LLC, on behalf of the City of Opa-Locka, initiated litigation to foreclose on those liens in order to recover the funds owed to the City or to gain ownership of the property through foreclosure, if the lien amounts are not paid; and WHEREAS, The Brown Law Group, LLC has advanced One Thousand Nine Hundred Fifty-Eight Dollars and Twenty-Seven Cents ($1,958.27) for the filing of the litigation, service of process, and for the filing of the lis pendens under the initial authority of the then Interim City Manager, Ed Brown, and now seeks reimbursement of same. NOW THEREFORE, BE IT RESOLVED THAT THE CITY COMMISSION OF THE CITY OF OPA LOCKA, FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference; Section 2. The actions of The Brown Law Group, LLC in initiating the lien foreclosure litigation and all related actions necessary thereto, are hereby ratified in their entirety. Resolution No. 15-9069 Section 3. The Brown Law Group is hereby authorized to continue the representation of the City in the lien foreclosure litigation against Miller Legg Capital Holdings, LLC. Section 4. The City Manager is hereby authorized to reimburse The Brown Law Group, LLC in the amount of $1958.27 for funds advanced on behalf of the City in bringing the lien foreclosure litigation against Miller Legg Capital Holdings, LLC. Section 5. This resolution shall take effect immediately upon adoption PASSED AND ADOPTED this 9th day of September, 2015. / y'ra L.
