. WHEREAS, the City Council of the City of Lynwood did,
on the 2nd day of August, 1g66 approve an invetitiga,tion report
under the provisione of Diviaion 4 of the Street and Itighway Code,
cited a,a "Special Assesament Inveatigation, Limitation and Najority
Protest Act of 1g31 as amended, upon the propoaed improvement
' of Duncan Avenue et al, between Fernwood Avenue and Lavinia
Avenue, by the construction of concrete curb and gutter and
driveway approaches, together witi� all incidental and appurtenant
work, as shown on Plan No. 1966-I-I-3 on file in the o£fice of the
, City Clerk of said city, and
WHEREAS, said report having been duly prepared and filed,
a hearing wa� held by said City Council on the 20th day o£
' September; 1g66 in the manner provided in said Act above referred
to, and
WHEREAS, more than thirty da.ys have expired eince the
., date o£ mailing notices of hearing on said report,
NOW, THEREFORE, the City Council of the Cify of Lynwood
does hereby resolve as follows:
l. That the protests made at said hearing on said
. investigation report be and the same are hereby overruled;
2, That the public interest, convenience, and necessity
require the doing and making of the public improvement set forth
and described in said report above referred to ancl substantially
in the manner set forth;
• 3. �That the project consisting of the proposed
improvement above referred to is feasible, and thaf the land to
be,aasessed will be able to carry the burden of said proposed
a4sessment;
4. That the estimated total amount propoaed to be
assessed upon any or all lots or parcels of land for the costs and
expenses of said proposed improvement does not exceed the limitation
` of indebtedness established and set forth in said act above referred
to and will not, by the leVy thereof, cause said-limitation to be
exceeded in any instance;
5. That no majority protest"has been filed with the
Clerk of the legislative body by the ownerv of the'property proposed
to be assessed to pay the costs and expenses o£ said proposed
improvement;
6, That it is hereby ordered that the proceedings for
the making of said proposed improvement be undertaken pursuant to
the provisions of an Act of the Legislature of the State of
California designated a� Division 7 0£ the Streets and Highways ,
�,
�Code, cited as the ° Improvement Act o£ 1911, and amendments thereto",
- APPROVED and ADOPTED this 20th day o£ September, 1966.
